Front porch roof leak resulting in damage to drywall and paint. Builder would not communicate nor fix the problem.I had Apex homebuilders build a house for me in Atoka, TN and I closed in August of 2013. Recently my front porch roof began to leak and caused damage to my drywall and paint under the porch. I made many attempts to contact the builder but was ignored as my home was over 1 year old and no longer under the builder warranty. I called in my own roofer and discovered that the paint contractors that the builder hired cut holes in two areas on the porch roof shingles down to the wood with their ladders.This caused the roof to start leaking and the builder should make it right due to his contractors' negligence. The cost of the roof repair is estimated at $300.00 and the drywall and painting will be additional. I am very disappointed with Apex Homebuilders and would not recommend anyone to them.Desired SettlementI am seeking Apex Homes refund the cost to repair the roof and damage caused by the leak.Business Response Apex Home Builders[redacted] XXXXXXXX-XXX-XXXXResponse to consumer's complaint:Mr. [redacted] has purchased 3 homes from Apex Home Builders. We only offer a one year builder warranty with all our homes. His warranty was up in August of 2013. Mr. [redacted] sent us texts in regards to the roof issues starting on Sunday, March 8, 2015 through March 21, 2015. He stated the gutters had been cleaned out, but that they were not draining. He stated they were poorly installed, which was not the case when looked at.He had a roofer come out to look at it and said that the gutters were just dirty. He asked us if we could fix it and he would pay for it. We sent Mr. [redacted] the number to our roofer and he said he would call once the rain finally stopped. Then we received yet another text stating that his roofer found two cut holes in two areas of the porch. He sent us pictures, which doesn't look like holes at all. This could've been done by his roofer. The roof would've leaked from the beginning if there were two holes in the roof. This is not something that would happen 18 months later.He stated in other texts that it was our stone contractor and then it was our painter who did the damage. We stated to Mr. [redacted] again, that our warranty is only one year. The ladder in which the painting contractor used cut two holes in the shingles causing the leak. The roof had not leaked until the area received ice and snow which allowed the ice to sit for days on the roof and melt slowly penetrating the holes. Remember the ice melts from the bottom and has to go somewhere. Apex Homebuilders has always done an exceptional job with fixing anything that is wrong with the workmanship of the home but in this case they did not attempt to resolve the roof issue and ignored my emails and text messages. This leak was caused solely by holes in the shingles by the Builder's painting contractor. Now due to the neglect of Apex I had to spend another $400.00 in repair cost.Final Business Response Please see attached warranty that was signed by Mr. [redacted] on August 8, 2013. We also have several text messages from Mr. [redacted] stating he was having his roofer reroof the area, so this could have been done by that company.
