Complaint[redacted], the owner, has not produced and delivered a metal driveway gate as promised. Now he has quit the job and left us hangingAfter accepting a deposit check for $1600On November 6,2014, [redacted] told me he would have the custom driveway & walk through gates fabricated, powder coated and installed in 3 weeks. As of December 29, he has only installed the three posts that are needed for the installation. One of them is 3/4" out of plumb, and it's only 5 1/2' tall. This steel post is set in concrete, and for it not to be right is unacceptable. He has since done nothing but give me bogus excuses on a weekly basis. After talking with him this morning, and listening to MORE excuses, he simply flaked out on the job. He said he was going to just drop off what little he has gotten done, and the materials he had purchased for the resrDesired SettlementI would hope to get back at least $800. of the $1,600. that he was given as a deposit. The material costs is all he should be compensated for, as he has not produce the gates, and is just dumping a bunch of steel tubing off at the job site..

Provided a $500 deposit for installation of an automatic gate. [redacted] (owner) came out to install posts and realized how he envisioned having this installed was not going to work and could not install it. Have called numerous times, left messages, sent e-mails, with no response. Left a message again yesterday (7/23/14) stating it was obvious he had no intention of returning my phone call nor refunding the deposit. I am submitting this on behalf of my mother - she is 81 years old. Took deposit, spent one day on the project around 45 days later, and has not been heard from since. Project left in the middle of completion. Took deposit of $1,650 on June 16, 2014 with remaining $1,650 due at completion (total of $3,300). Came on August 1, 2014 to begin project which included disconnecting (and they took away) existing driveway gate opener, pouring concrete for bigger driveway gate pole, and digging up driveway to lay electrical for putting new opener on opposite side of existing. Remaining work to be done includes hingeing and moving driveway gate to other side of driveway and supplying/installing new opener. They have not returned cell phone messages. The office phone number is too full to leave message, and company's email (which I had used to correspond in June 2014) was returned undeliverable. Contract states the new gate opener/installation is $2,450 and the work for new gate post and changing hinges to opposite side and welding is $850 (totaling $3,300). So they cashed my deposit for $1,650, but I received less than $850 (they only did partial of this work on Aug 1) in services. Desired SettlementAs stated in complaint summary, the contract was for $3,300 which included $2,450 for new driveway gate opener and $850 for new driveway gate pole, rewiring, and changing hinges/switching existing gate to opposite side of driveway. I paid a deposit of $1,650 for less than $850 in work. They also did not provide a new opener. A refund of $800 of my deposit is reasonable.
