This company has the parking lot adjacent to the Marriott SpringHill Suites located at [redacted] TX. They maintain a large sign on the property that states "Hotel Parking", then boot your vehicle with in minutes of parking there with a hotel parking permit in your window. While I was there on the weekend of September 4th, they booted numerous cars that parked there from the hotel. The Hotel Management stated that they tried to put signs on their propert warning guests not to park there, but [redacted] threatened them that they would be cutting into their business. What these people are doing is unethical at best and seems more like criminal. They are basically stealing money and using extortion in the form of parking boots to hold vehicles hostage. In my opinion they are no better than a thief that steals money. Only the City of [redacted] provided them with a license to do this. Shame on the [redacted] for letting people like this have a business license in their city. Business's that do business like this bring down the reputation of this City.

Complainant parked her vehicle on a [redacted] parking lot, located on 305 [redacted], S.A. TX 78205, and failed to pay parking fee at the automated pay station located on the center...

of the lot.  As a result of her failure to pay, complainant's vehicle was immobilized and a boot fine of $35 + $2.89 tax was due in order to remove device.

This lot is located in downtown [redacted] and takes up an entire city block with the following streets as its borders,  Travis and Pecan run east and west.  [redacted] and [redacted] Ave run north and south.  With that being said, the city provides street parking on the [redacted] and [redacted] Ave.  There are 2 automated city meters on the city sidewalk of [redacted] and 2 on the city sidewalk on [redacted] Ave.  Those meters are there for people to pay if they park on the city street.  It turns out that complainant paid said city meter while parked on a privately owned lot managed by [redacted] parking.  The city meter clearly says City of [redacted] on it as well as the sticker she received upon paying.

As the complainant says on the 6th line of her complaint, "She and I had made the same mistake, and paid for parking at the wrong kiosk.", referring to another individual booted.  Attached are pictures of various signs located throughout the lot.  This lot is unmanned and is randomly audited by Apex.  We can put up signs with rates, instructions, and warnings, but we can't make people read them.

Apex is contracted out by [redacted] parking to enforce their lots.  Failure to comply with lot rules posted will result in vehicle being immobilized.  We are a parking enforcement company and stay in business by collecting fines on immobilized vehicles.  This is why we refused to accept complainant's parking fee after she realized she paid the wrong kiosk.

As far as complainant's desired settlement,

* We can not place any signs or stickers on city owned and operated meters to indicate where to pay.  Complainant needs to contact the City of [redacted] for that request.
* We don't keep record of how many people pay city meters rather than [redacted] pay station, even if we did it is none of her business.
* Refund request of $37.89 is denied due to complainant parked in a privately owned parking lot and paid a city meter located on a city sidewalk meant for vehicles parked on the city street.

Thank you,
