Dear Mr***, In responding to your concerns, I want to provide further input into the original contract that you had signed off on, as owner of your marketFirst, all devices, including a motion detector and existing glass sensors / doors were completed and tested back at this timeAs you
the owner under the contract is responsible to ensure the devices are intact and working on a regular basisIf they are malfunctioning, you are further responsible to contact our offices for service and would be charged as needed, since you have no service contract with our officesFurthermore, you are responsible under the contract too maintain all up to date emergency contacts with API and central station operation'sIn describing and reviewing the May, incident, when you contacted our offices, MrJ*** personally responded to your incident, with a service technician, at this time, we found your store had been renovated, walls added, security devices moved and removed ( ie motion detector)Mr*** was unavailable too meet with us at anytime, as well as MrW***MrJ*** spoke to you in depth regarding the theft incidentWe shared with you what was needed to update your system, but you wouldn't approve the service updates, MrJ*** took it upon himself to send out the technician and replace glass breaks and re-attach the wiring above the store ceiling tile, whereby someone unknown had cut a number of the security wires, including the essential motion that had been in placed at the original installationAs this unknown person tied the wire in place the system would have appeared to be in operation statusAt no time, did we ever state Mr*** was in direct connection with this act, however he is a absentee ownerIn conclusion, as Mr*** states at the contractual part of his concerns, he is seeking money's relating to the theft and had called early on regarding a reimbursement of the lossMrJ*** shared at the time, a contract for services was signed by himself, it clearly states the following:Purchase AgreementAPI is not responsible for third party actsThe equipment is owned by Mr*** after the completion of the system, Monitoring AgreementIt would be best for Mr*** to review the agreement, it clearly states API performed the duties at the time of the installation, further more reattached and replaced devicesAPI hasn't received any moneys from the services render back in May and why this complaint is filed is duly to Mr*** representative calling our office this week seeking credit on monitoring for As the contract was signed upon a yearly payment would be charged to his credit cardAs the contracts stated if Mr*** would want to cancel, provide us a day cancelation notice and we will provide a remaining credit at that timeRepresentatives from API, want to finally share we have made every effort to help, provide a clear message and lastly be responsive too our client's over the last years and we will continue to strive towards excellenceHowever, incidents like this we are sensitive too and understand Mr***'s concerns and as stated made every effort to help and move forward towards a remedyMr*** is always welcome too call our office and / or place in writing any further direction he would like to pursueSincerely,Edward J***

Complaint:
I am rejecting this response because: I very clearly stated that I do NOT want to renew my contract yet was automatically charged. Also the contract states the equipment was installed but was not. No walls were added and no renovations were made besides painting the walls and adding free standing shelving in the middle of the store. I personally did not remove or cut any wires or equipment nor was anybody else given access to the equipment or wiring. I know for 100% certain that a motion sensor was not installed. I had no way of knowing that the glass break sensors were not functioning properly until an incident occured

I am interested in Arbitration, however, my wife and I are expecting a baby between they 9th and 15thCould we schedule the arbitration for the second week of March?

Please find attached scanned copies of the signed Sales Agreement, Monitoring Agreement, Job Completion Form and Installation Checklist as well as drawings of the original store layout and one showing the changes that were made to the store after the initial installation.  The technician's notes give a detailed description of what was found during the original inspection as well as all of the work that API provided at no cost.   These facts were relayed to [redacted] in a phone conversation she had with Mr. W[redacted] on December 27th after she called inquiring about the invoice.

I would prefer to go to arbitration. My attorney [redacted] will be representing me.
