Please accept this as our response to the complaint ID number ***.On January 6th Mr*** called the rental office inquiring about the 3day notice to vacate for nonpaymentof rentAfter the assistant manager informed Mr*** that we had not
received his rent asof 1/6/he explained the payment was in the drop box, and she promptly explained that we haddosed the drop box on November 30thThe assistant manager went outside and checked the smallcrack in the wall where the drop box used to be with a flashlight and could see a small corner of paperstuffed into the crackIt was explained to Mr*** that the staff could see the check stuffed into thiscrack, wasn't sure how he was able to get the payment in there and let him know it was still late sincewe would have no way of knowing when it was placed in this crackSeveral notices were sent out to thecommunity to explain the drop box was no longer available as of 12/1/15.To retrieve the check our maintenance team had to cut into the siding of our building and open the wall.Later that evening two younger residents came to the rental office stating they were from A-andwould like the check back, the assistant manager then returned the payment to them to take home toMr***.Apple Park went to a paperless system, eliminating the drop box as well on December 1st and allresidents were notified with notices on their doors November 23rd, I have attached the notice thatwent out to all residentsIn addition to the letter on the resident's doors we also had and currentlyhave notices posted at the rental office front door, side door to the recreation facility, the windowabove where the drop box was located, also notices on employee desks as well as in the lobby forresidents to seeAccording to Mr***'s lease agreement the rent payment is due on the 1'' of eachmonth and by no later than the 3rdIf he had not called on December 6th the morning after he wasserved his day notice we would not have known his payment was inside the wall where he in ouropinion purposefully stuffed the check into the crackWe unfortunately will not be reversing the latefee that he has already satisfied and paid in full as he had the option to bring in his payment inpersonally or pay online.We thank you for your understanding in our right to enforce the lease agreement late fee policy in thismatter and please feel free to contact our office with any questions you may have.Sincerely,
