Ms*** purchased a Ford Escape (VIN ***) on September from Apple Used Autos
The vehicle was represented at the time of sale as 'As-Is' and correctly displayed the required Buyers Guide noting the As-Is
condition
The customer received a copy of the Buyer's GuideOriginal document with customer signature acknowledging the 'As-Is' status as well as agreeing she was provided a copy of the Buyers Order is available for inspection
The Buyers Guide notes the following:
'You will pay all costs for any repairsThe dealer assumes no responsibility for any repairs regardless of any oral statements about the vehicle.'
Additionally the sale of this vehicle was backed by AppleAutos day mile return or a day exchange policyThe customer was also offered the choice of several extended warranties to cover future repairsMs*** declined all these optionsOriginal with customer signature available for inspection
Apple Used Autos contacted Ms*** two days later on September by phone and again on September via email as a follow-upShe did not respond to either communicationCall records available for inspection
Three months later Ms*** contacted Apple Used Autos demanding a full refund of the purchase price of this vehicle plus any and all costs of after the sale repairsAt the time of this call to AUA the customer acknowledged that she had not contacted this store prior to express any concerns or to ask for assistance with the Escape
Included in the pre-sale due diligence Apple Autos performed is a vehicle history check through Autocheck/Experian and that report shows a clean history: no accidents reportedCopy available for inspection
Even though the AppleAutos customer satisfaction guarantee had long since expired we agreed to repurchase the Escape back from the customerWe promptly repurchased the vehicle from her at the exact price she originally paid for the Escape several months previously less tax, title, license or other supposed after-sale repairs
We then performed an extensive inspection on the EscapeWe did make the determination that the vehicle did not evidence any indication that it was in a 'severe' accident
An air restraint (airbag) deployment is logged in one of the vehicle computers as a 'hard' code and is not subject to deletion from the system memory: this vehicle has not had its supplemental restraint system deployedThe airbags and related OEM safety equipment are original to the vehicle and are in good working orderThe condition and prior damage to this vehicle as described by the customer are simply not supported by the factsVehicle inspection records are available for inspection
Further, we determined the drains for the sunroof were plugged with road debris, a common maintenance item, we cleared the drains and water now runs through the drainage system normally
We regret that Ms*** is not satisfied with her experience with usWe made an exceptional post-sale adjustment for Ms***, an accommodation that at the time she agreed would settle the matterWhen Apple Used Autos agreed to repurchase the Escape from Ms*** we agreed that AUA would not consider any support outside of the original purchase price of the EscapeWe shook hands and issued her a check
Given the facts of the instant case we are not able to move forward with additional adjustments, refunds, or other considerations at this time for Ms***

I bought a used Cadillac at Apple used autosI was told it had new brakes in the rear this turned out to be falseI got them to fix this so that I would not return car(you have days in mn.) I was also told the plate stickers were coming (due in May I bought car May 5) I waited till April ! for stickers and finally went to DMV and found out they had not put in for plates(cost me $52.00) ( I also had to put in about grand in repairs)
