This is in response to complaint ID [redacted]. The customer came into the store on 02/01/2014 to purchase a [redacted] refrigerator. The purchase price for...

the refrigerator was $300, with a total of $322.50. Our policy here is that if we deliver an appliance to the customer and they have a warranty with it, we will send a service technician to their home to repair the appliance, should any problems arise during the warranty period. However, if the customer chooses to take the appliance themselves, the warranty is voided and the appliance is sold AS IS, with NO WARRANTY.
This was made very clear to the customer at the time of the sale. He inspected the fridge, found it to be working perfectly and decided that he wanted to purchase it. When we offered the delivery, he declined. It was again explained to the customer that it would be an AS IS sale if he delivered and installed it himself. He agreed, paid for the fridge and took it home.
We have this policy in place to protect ourselves. When a customer chooses to deliver and install the appliance themselves, we have no way of knowing what was done to the appliance once it leaves the store. Was it dropped? Was there a hard jar to the appliance? Was it banged around during transport? Because we cannot know the answer to these questions, we will only sell an appliance as an AS IS item if it is not delivered by one of our delivery professionals.
However, as a courtesy to the customer, we did send a technician out to check the fridge for the customer. Once the technician tested the appliance and found out what the problem was, he advised the customer how much it would cost to fix it. The customer then called in demanding a refund. It was again explained to the customer that because we did not deliver the appliance and it was working when he took it from the store, we cannot give him a refund. It was sold AS IS and has no warranty.
I am very sorry that the customer is having issues with the appliance, but it was working perfectly when he took it from the store. We have signs all over the store stating the AS ISpolicy and it was explained to the customer on several occassions BEFORE he made the purchase. We cannot give refunds for items sold as an AS IS item.
