I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint The job was still on going and not finished when I last spoke with and/or saw a representative from EMZ MasonsI never believed they would leave the project in this conditionI have had another contractor who builds homes look at the project and he can't believe it was left this way I do not accept the company's position that they have been too busyI am certain that if I owed them money they would be here fixing the problemsI have spoke with an attorney and the Justice of the Peace officeIf the company does not promptly come fix this I have no choice but to seek punitive relief through the courts including all legal fees and seek judgment against EMZ Masons and their business assets

Dear Mr. [redacted] Thank you for informing us of Mr. [redacted] concerns regarding his treatments. In the Aesthetic industry the outcome of ANY cosmetic procedure is always an unknown and unpredictable. During my initial consultation with Mr. [redacted] I informed him, as I do all patients, that the number...

of treatments varies with everyone due to the huge diversity of patients, their skin type, sun damage, previous procedures, age and more. For patients of his age we like to start with four treatments spread out over 3 to 4 months, access the results and continue treatments from there if needed. Mr. [redacted] understood this and signed his informed consent. HIPPA law prohibits me from sending the copy he signed). Mr. [redacted] then paid for his four treatments, which is customary. When we completed the four treatments, Mr. [redacted] expressed his dissatisfaction. In an effort to achieve a better result and please Mr. [redacted] we offered to do another treatment, at NO COST to him even though he knew that it may take more than four treatments to begin with. There was no “Sorry Charlie” moment. When that treatment failed to achieve satisfactory results, we offered to continue treating at no charge. Mr. [redacted] refused further treatments and never asked for a refund of any kind. Without the opportunity to even discuss any options, Mr. [redacted] stormed out of the office spouting somewhat threatening remarks. The time line given in the “complaint” is fairly accurate but the conclusions are flawed if not totally inaccurate. As was mentioned by Mr. [redacted] we have admittedly had a few less than desirable results, but he failed finish my statement. Those patients, also over 75, had four treatments with similar results but continued treatments knowing they may need more and are now seeing improvement. As I previously mentioned, it may very well take more than four treatments to achieve a patients expectations. This however has absolutely nothing to do with Mr. [redacted]. We have treated hundreds of patients that have been more than happy with their results. According to our agreement, we are under no obligation to return any of his money. However, with respect to our industry and in the manner of good relations, we would like to resolve this matter by offering to return $450 to Mr. [redacted]. This Thursday I'll have time to see what the issue. I have a new project to start Monday and won't be finished till after Christmas. I can fix the problem this couple of days before I start the new project. Also I have another project lining up for January, just to let him know I got work lined up and I'm busy with work. P.s I'm a hand on contractor it's not easy for me to move around once I start on a project.
