We informed the client, *** ***, multiple times that his SDK has not been stable, and that we will need to have a fully functional SDK in place in order to achieve our goalsAlso, his contract states that "10,downloads" is a "Targeted Goal" not a guarantee (see attached contract)The
contract is based around services, not deliverables or benchmarksAlso, Mr***'s contract is for months priced at $5,per month (see page and of contract)Mr*** has only paid one invoice of $5,for Month (see attached invoice)Targeted goals and services in his contract are stated over a month periodHis contract also states on section "All requests for information or design assets must be fulfilled in a timely mannerFailure to provide the requested information to APPSPIRE.me, LLC in a way that hinders the performance of their services or delays work will be deemed a breach of contract." Since has still been unable to provide information on a stable SDK for the past several months, technically his contract is breachedSection of his contract states that if the contract has been breached by either party, only APPSPIRE.me is entitled to refunds"In the event of early termination permitted by this Agreement, APPSPIRE.me, LLC shall be entitled to a refund of any fees or pro-rata portion thereof paid by APPSPIRE.me, LLC for any remaining period of the Agreement from the date of termination." Since his contract is for months for $5,per month, *** *** has breached and owes Appspire.me $10,APPSPIRE.me also informed Mr*** that we can still achieve the 10,downloads via methods other than a stable SDK, but he did not respond (see attached email)At this juncture, we are willing to work with Mr*** and achieve 10,downloads for his app, ***, in lieu that he, and any person, business, or entity associated with him or his app, agrees not to leave a review about APPSPIRE.me on Revdex.com or any other sitesIf both parties agree, we are willing to move forwardPlease advise the next step
