Mr*** purchased the vehicle in question on April 18, with 58,miles on the odometer. We provided Mr *** with a day, 2,mile used car warranty covering major mechanical issues, subject to a $deductible and assuming that the vehicle was returned to us for
repair.Mr*** informed us in May that he was experiencing a transmission issue. Further, due to his location (He lives in Watertown) he wanted to have the vehicle looked at, and repairs completed closer to home. We generally arrange to have off-brand vehicles repaired at our network of dealerships, however since he was insistent that *** ** *** perform the repairs, and given the reputation that *** ** *** has regarding repairs of this type, we agreed to allow him to bring it to them. *** ** *** diagnosed the transmission issue and performed the repairs. Colonial paid the entire cost of the repairs, totaling $763.75. As Mr*** points out in his concern, *** ** *** '...everything was fine with the transmission.' Mr*** drove the vehicle without issue until September. The warranty that Mr*** received with the car has been expired since June 18. I spoke to ***, the advisor responsible for the vehicle when it went to *** ** *** for repair, and he confirmed that the original repair and the subsequent issue, although they both are transmission related, are not the same issue. Their master technician (#best in the country) confirms this. The first issue, a lurching when the vehicle comes to a complete stop, and the current issue, hard shifting after minutes of stop-atraffic are not the same.When Mr*** purchased the vehicle, we went over all of the options available to him regarding coverages available to him. Mr*** declined all of the options available to him and signed the waiver of coverages. He also signed the Limited Used Car Warranty indicating that the coverage was for days or 2,miles, whichever comes first. Although we are thorough in our explanation of the coverage and the possible ramifications should coverage be declined, we cannot insist that coverage be purchased. further, we are not obligated to provide coverage in the event that coverage is declined. We don't pressure customers into purchasing coverage, however we do explain that after days the used vehicle coverage ends. Again, declining additional coverage does not obligate the selling dealer in any manner, and under no circumstances are we obligated to guarantee the work performed by others.
