it is true that I sett non-refundable gift certificates on my website. The fact that the terms are
printed on the gift certificate proves that the terms were specified before the purchase.
Thegiftcardcafe.com confirmed that it is not possible that the terms could be withheld before
the purchase and then be printed on the certificate after the fact. I am unable to change this
feature on their website one way or the other. Once a business types in their terms, it will
appear on the purchasing screen as well as the certificate. They confirmed that if it's in one
place, it has to be in the other. Included in this letter is a screen shot of the terms before
purchase is made and a copy of the customer's emailed gift certificat F! .
A calf to the CA Dept. of Consumer Affairs assured me that it is legal for businesses to stipulate
that a gift certificate can be non-.refundabfe. This is a protection to small businesses, such as me,
since no matter what company a business chooses to sell gift certificates through, they always
take a percentage of the price, sometimes larger than consumers realize.
Resolution: 1. In the hopes of preventing a similar issue in the future, I will add an additional place on
my website stating the terms of gift certificates. Hopefully if a customer misses it in the shopping cart,
they will see it in the second place on the site.
2.Before receiving a letter from the Revdex.com, I had referred a
mutual friend that the customer and f have, to purchase the gift certificate from them. I have left it up to
them to make the arrangements.
3. My website never claims to CURE anyone. It doesn' t have that word anywhere on the site. I do
claim that Bowen helps to reduce, and in many cases eliminate pain and other physical and
emotional issues. Not only was this taught in my school but I have personally seen it in nearly
every person I have worked on. l'm very sorry that the customer is skeptical about Bowen.
However, there are various websites about Bowen and a number of books on the subject that
make the same claims. I'm not sure how to prove this other than to say that a person has to try
it to see it for themselves.
Resolution: Perhaps my wording on the website is too enthusiastic. I highly believe in Bowen Therapy. I
will look for ways to tone the wording down but I can't help that Bowen does work on nearly every Person..
p.s. as of 1/17/14 the customer and I have made peace. The gift certificate was purchased by a third party. I have rewarded and
toned down the wording on my website.
