*** ** *** Case no*** Dear Ms*** ***, We have recieved your response letterWe appreciate your attempt to find a solution to the matterWe regret to imform you that we are unable to accomodate your request to void the contractWe understand our decision is fustrating but the contract has become legally binding and *** *** owns the rights to collection of paymentsWe have reviewed Mr***s contract and sale process and do not see any evidence of fraud taking placeWe can assure you and the Revdex.com that we did not take advantage of your father in any wayMr***s son was not only present for the entire length of the demonstration but was also there present during the sales write up and also consented to the saleWe were told it was Mr***s son who does most of the cleaning so we got him very involved in the demonstration/sales processMr*** was also a repeat *** owner and was very familiar with its operation and usageWe cannot comment on Mr***s current hearing ability, however during the time of the demonstration/sales process Mr*** did not exibit a hearing impairment nor did he mention for us to repeat anything we said during the sales process (over *** long)*** *** has also no notes of Mr*** having any trouble responding to their questions during the verification processAbout days after the sale occurred Mr*** called our office and spoke to one of the owners and he also stated Mr*** did not show any impairments with hearing as he responded very well to the conversationThere are many factors we take into account when selling a ***And one of them is ageWe take extra caution when selling to the advanced elderlyOne of the owners did meet your father on the day of the sale and felt Mr*** is very capable of sound decisions at just years oldAlongside that his son was present and consented to the sale to move forward we unfortunately cannot find fault within our sales practicesAlthough we are unable to void the contract, we would like to extend Mr*** with a good faith gesture by giving him our most expensive optional equimpent......*** ***, and year supplies of scented oils free of chargeThis package is retailed for $We can have this delivered to Mr***s home free of chargeWe look forward to hearing from youThank you

I am rejecting this response.I believe Aqua Dynamic's salesperson preyed on the kindness of my father, [redacted], who is a senior citizen. There are several reasons why I am rejecting this response from Aqua Dynamics. #1 Aqua Dynamics is claiming that they verbally went over the contract with my father. He is partially deaf and is being treated for the condition with the [redacted]. #2 As most elderly people are, he is not as sharp as he used to be and was not clear on the financing terms. I understand that Aqua Dynamics is in the business of selling products and feels they are contractually entitled to the terms of the agreement. However, the right thing to do is to void this contract. My father is on a fixed income and cannot afford this debt with such ridiculous financing terms. My current offer is for Aqua Dynamics to void the contract. No refund is needed on payments that have already  been collected. If we are unable to come to an agreement and the Revdex.com cannot facilitate a favorable outcome, my next plan of action will be to file with the Department of Commerce and Consumer Affairs. They have a neat little department that deals specifically with complaints affecting the elderly.

Dear Revdex.com,Thank you for the opportunity to respond to this formal complaint. We are sorry to hear that [redacted] is not satisfied with her father's([redacted])purchase of the [redacted].We understand people's first impression of direct sales at times has a bad reputation.However, we go to...

great lengthsto set ourselves apart from our competition.We can confirm that Mr. [redacted] purchased the [redacted]cleaning system on February 2015. We offered 3 payment options when purchasing our cleaning system (Check, credit card,and monthly payments)  and Mr. [redacted] decided to purchase by way of a monthly agreement. All necessarypaperwork was drafted,verified orally and signed by Mr. [redacted]. 
Proper copies were left with Mr. [redacted] and the machine was thoroughly shown its usage before leaving the home.Well over a month had past when we received a call from Mr. [redacted]in March 2015. He felt that there was a mistake on his contract in regards to his interes trate. His impression is that he thought the interest rate was going to be 10%. We statedto Mr. [redacted] that we unfortunately do not have a program that offers that rate. The finance charge of 21.99% is set by a finance company called [redacted]. Mr. [redacted] stated that he wanted to cancel his purchase during this phone conversation due to the interest rate. We informed Mr. [redacted] that unfortunately he was more than 30 days beyond his 3 business day cancellation period as described on his contract. We tried to reason with Mr. [redacted] that his contract clearly stated 21.99% in the "Truth In Lending Boxes" . We explained the truth in lending boxes of all drafted contracts is a federal law mandated to be much larger than any other line or box on the
contract so the customer can clearly see their interest,total of payments, finance charge, and APR, etc. Mr. [redacted] was still not pleased and had stated that the interest rate should be lower. After further conversation we stated to Mr. [redacted]that the terms of his contract was not just orally verified between him and the salesperson, but also the financecompany [redacted]. We explained to Mr. [redacted] that [redacted] will not process any contract unless certain questions have been answered by the consumer in a satisfactory manner. One of these questionsis the buyer must verbally state that HE/SHE has read the contract and understands the terms and conditions of the contract.  We also informed Mr.[redacted] that [redacted] will record all verification processes to ensure quality assurance so there are no misunderstandings with the contract. It was at this time Mr. [redacted] became frustrated and made comments that the finance company, along with our company were not legitimate and in his words were "crooks".We understand at times there will be mistakes that happen on contracts and sales receipts. And we will fix them immediately.  Unfortunately we are unable void or alter the finance contractfor the followingreasons:The finance contract was drafted in the consumer's presence, verified by the sales person and the consumer, and signed during the presentation.A signed carbon copy of the contract was left with the consumer and matches the APR of 21.99% listed on the original.[redacted] also orally verified the terms of the contract with the buyer before they processed the paperwork and that phone call is recorded.[redacted] 3 business days has expired and the first attempt to cancel the contract was well over 30 days after signing and taking delivery of the merchandise.Mr. [redacted] is current on his loan payments and is showing goodwill by satisfying the conditions of the contract.We carefully reviewed this case and do not see evidence of fraud or unethical practices in regards to the sale or contract.Mrs. [redacted] stated thatshe has attempted to contact us in regardsto her father's contract. We apologize to Mrs. [redacted] for not being able to address her father's contract. Our company policy is that we take our customers confidential information very seriously and will not discuss anyone's financial contract or speak with someone regarding a finance contract other than the purchasing buyer whom was Mr. [redacted].In closing,our company did attempt to explain
the APR situation with Mr. [redacted]. 
We take every complaint seriouslyand this complaintseems to be about the terms of the contract,specifically the APR rather than sales practices, product/services or warranty.  The fact that [redacted] verified the terms with the consumerand the terms matches both copies we unfortunately are unable to void the liability to perform on the promise to pay.  If you have any questions you may reach us at [redacted].
