Mr ***, in your attachments we see where you asked David about the warranty issues but no communication back was ever madeDavid is no longer with the companyWe also do not see where any warranty claim was actually done by you or the bimmer shop you had your car atYou did had a powertrain warranty that was for months or miles whichever came firstThat warranty does not include any cosmetic issues or leaksIt was to cover the major moving parts like your motor and transmission if they were to fail on youWe understand you have a leak and your headlights are faulty but these are things that are expected from a used vehicle and are not covered under a powertrain warrantyWe have offered to do the repairs for you at a discounted price and also offer you a loaner vehicleWe are here to help you and but the invoice you sent us just does not make sense

Issues Epic Auto Sales’s response of the Problem:*** *** *** purchased a BMW 335I with on 10/29/from Epic Auto Sales The vehicle was purchased from Epic Auto Sales as a cash transaction As part of the purchase the customer was provided a "Limited Power Train Warranty" from one of Epic Auto Sales 3rd party vendors The warranty is a month/ 3,mile limited power train warranty Which this warranty only covers engine and transmission After the purchase Mr*** states that a claim had been filed by Epic Auto Sales Epic Auto Sales can not file a claim for the customer since the vehicle belongs to the customer Mr*** provided information; stating his communication with sales associate in regards to the oil leak on the vehicleDuring the April communication he provided a estimate that ranged from several items from cosmetics to the oil leaks which totaled over 10k in repairs Majority of the items on the estimate are not covered by the power train warranty Some items on the estimate were extremely over priced and questionable such as a $3,quote to adjust headlightsOn April 21st, Mr*** was offered to bring the vehicle in for inspection and assistance on the oil leak issue only since the 3,mile warranty has passed it coverage time Epic Auto Sales also offered Mr*** a service loaner vehicle free of charge until the issue was resolved Both of the offer's were declined from Mr*** Epic Auto Sales has no problem in assisting Mr*** on some of the issues on the vehicleBut will decline repairs on unrelated cosmetics issues that are not covered or agreed on this transaction. vehicle has been inspectedThat lines only states the charge for the inspection is being charged and collected for the statePlease keep in mind that not all vehicles require an inspection during the time of saleIf the vehicle does not require inspection a refund would be issued once the vehicle is titled. Your vehicle was one that required an inspection which we had to perform. I am rejecting this response because: There must be two [redacted]s! Their secretary (if she's still there) is [redacted]. She told me [redacted] had told her to block calls to the owner and he informed me [redacted] that he is the final authority. I asked her to call the owner and ask him if I could talk with him. In a follow up call I was told the owner said to talk to [redacted]. I call that blocking calls. The attendant's name is [redacted] (if he's still there). A few days before the incident, I had had gone to the car wash and it broke as I was about to start thru. [redacted] told me that the chain had just broken, he said "maybe the car before me had put on their brakes" and that they had had problems with the chain. [redacted] had to help me back-out of the car wash. I have a big red van and [redacted] must have remembered me when I came back the day of the scrapes because he told me that a new chain had been installed. I think [redacted] would remember me because I showed him the van after the car wash and he gave the company names and numbers to call. So, some kind of maintenance had been done, and I mentioned to Mr. [redacted] that something must be out a adjustment, at least for larger vehicles. Mr. [redacted] did walk around the van and I remember asking him what he was looking for. I told him only the scrapes on the running board had occurred in the car wash. Other dings are parking lot dings, which I told him. Photos 095916 and 095912 are the scrapes. It's easy to see why there are no complaints, who knows about them but [redacted]? [redacted] is the company's complaint process.

We appreciate our clients, and go above and beyond to ensure their satisfaction so we are encouraged to attempt to resolve this matter.  I remember this van, and I remember starting with Mr. [redacted] quite a bit including taking photographs of his van with Mr. [redacted] at my side.  Further, I...

never blocked Mr. [redacted]’s calls.  In fact, I worked diligently to understand Mr. [redacted]’s account of how his van was allegedly damaged in our car wash as we had no adjustment maintenance issues despite Mr. [redacted]’s belief otherwise. Specifically, Mr. [redacted] asserts that our car wash scratched his van.  However, with Mr. [redacted], I, personally, examined his 2013 van walking around the entire vehicle.  What was apparent were scratches all over Mr. [redacted]’s 2013 van on, and along the running boards on both sides of his van.   The scratches on both the left and right side of Mr. [redacted]’s 2013 van also included chips in the van’s paint on both sides of the van.  Our car wash services have never caused damages to a vehicle similar to wear and tear on a 4-year old van, and we have not had any such complaints before or since.  Again, I took photographs of Mr. [redacted]’s van with Mr. [redacted] at my side, and explained the same to him as is written here:  Our services cannot and did not scratch both sides of his van including causing chips in the van’s paint, which Mr. [redacted] did not mention.    Please understand that if our services were scratching both sides of vehicles and caused paint to chip, other patrons would have, equally, complained as such.  Mr. [redacted] is the only patron presenting as such.   We value our patrons, so in effort to retain Mr. [redacted]’s business, we are willing to offer him a free car wash; however, please know that our offer is simply good will as our car wash did not cause such scratches to Mr. [redacted]’s four-year-old van.    We are offering Revdex.com the pictures we took of Mr. [redacted]’s van.  See below.    [redacted]

Since purchase of the vehicle in late October, Epic Auto Sales has since fired their entire staff and the company is under new management. As a result, their response is incorrect and untruthful. Below is the truthful history regarding the purchase of the vehicle, the repairs needed, and the agreements made.There are 2 open issues we are discussing. These 2 issues are provided separately below:Issue 1 - Faulty Headlights (Safety Hazard)* The vehicle was test driven on 10/29/2016 at which time the operation of the driver and passenger side headlights were in question.* Prior to purchase, Epic Auto Sales' Sales Manager agreed to replace any faulty headlights under warranty.* That same evening, the purchase contract was completed and I drove the vehicle back to Dallas from Houston.* During the drive from Houston to Dallas, both driver side and passenger side headlights were immediately identified as faulty and unsafe. They were pointing to the ground (approximately 10 feet from the front bumper) making it impossible and unsafe to properly see during night driving.* On 10/31/2016, the vehicle was taken to [redacted] in [redacted] and faulty motors in both Adaptive Headlight Assemblys were identified. It was disclosed that this fault should not have allowed the vehicle to pass inspection, yet Epic Auto Sales somehow managed to have the vehicle pass inspection anyway.* Epic Auto Sales' Salesman David [redacted] was contacted on Tuesday, 11/1/2016 and notified of the issue. A copy of the repair estimate was emailed to Mr. [redacted] and he said he would file a warranty claim to replace the faulty headlights. (see attachments: IMG_6032.PNG and IMG_6031.PNG)* On 11/2/1016 I received a text message from Mr. [redacted] indicating that he submitted a warranty claim (see attachment: IMG_6032.PNG) this would turn out to be a lie per Epic Auto Sales' own words in their response to this complaint ("Epic Auto Sales can not file a claim for the customer since the vehicle belongs to the customer.") Now, Epic Auto Sales is refusing to honor the agreement to replace the headlights under this excuse after they had already agreed to replace the headlights prior to purchase.Issue 2 - Faulty Differential (Power Train Warranty)* On March 23, 2017, the vehicle was taken back to [redacted] in Plano, TX (odometer reading 61142) due to a whining noise coming from the engine compartment.* The noise was identified as a faulty idler pulley.* On March 27, 2017, a third party warranty company (Endurance Auto Warranty) sent an insurance adjuster to review the warranty claim on the idler pulley. He performed a full vehicle inspection during this process.* During the vehicle inspection, the insurance adjuster identified a massive leak coming from the rear differential - an integral part of the power train assembly.* This leak was identified as a pre-existing condition present at time of purchase due to the massive amounts of differential fluid burned all over the undercarriage of the vehicle - another safety hazard.* Epic Auto Sales was contacted regarding this pre-existing condition and informed that Endurance and [redacted] stated this issue should have been identified during Epic Auto Sales' vehicle inspection process. It was noted that the vehicle should not have been released for purchase with this issue and that the problem should have been covered by Epic Auto Sales.* Epic Auto Sales has failed to provide any documentation proving the leak was not pre-existing. They have also failed to provide any inspection or warranty documentation whatsoever despite multiple calls and inquiries.* Epic Auto Sales also claims a loaner vehicle was refused, this is also UNTRUE!! Multiple calls were placed to Epic Auto Sales in attempt to obtain proper documentation regarding the differential and headlight assemblies and discuss the arrangements for a loaner vehicle while they fix these issues.* Epic Auto Sales declines to repair cosmetic issues, yet both the headlights and differential leak are a SAFETY and power train issues, respectively.I request relief through assistance provided by the Revdex.com and will pursue legal action if this is not corrected soon.

In attachment IMG_6032.png (once again attached to this response) you can clearly see David's response on NOVEMBER 2nd at 3:54 PM: "I sent the warranty claim where is the check".  When David sent this RESPONSE TO MY EMAIL, the car was still covered by Epic Auto Sales. David told me he would fill out a claim and send it over to the warranty company then notify me it was sent. After this was done I had agreed to send the check via [redacted] along with a tracking number. You can see I upheld my end of the agreement at 6:13 PM on November 2nd - the very same day. > We also do not see where any warranty claim was actually done by you or the bimmer shop you had your car at. Once again, David told me HE would file a claim. It was NEVER disclosed to me that I was responsible for filing ANY claim because your employees LIED to me. This is the WHOLE point of this complaint. Your employees lied that they would cover the repair for the faulty head lights. David McDuffie was YOUR employee at the time of the purchase. The fact that he is no longer employed by you is irrelevant to this complaint.  > You did had a powertrain warranty that was for 3 months or 3000 miles whichever came first. This is NOT NORMAL WEAR AND TEAR but a FAILURE OF THE POWER/DRIVE Train and was known by Epic Auto Sales at time of sale yet NEVER disclosed. Because of this, EPIC is responsible for the cost of the repairs as agreed by the warranty. The time frame has expired because Epic FAILED to respond to any of my messages. Again, the whole purpose THIS complaint is being filed.  > We have offered to do the repairs for you at a discounted price and also offer you a loaner vehicle. We are here to help you and but the invoice you sent us just does not make sense.I will NOT be driving the vehicle back to Houston for these repairs. That is unnecessary cost and burden for a problem that was NOT cause by me, but by EPIC to begin with. I would be happy to take the vehicle to the Plano or Frisco BMW dealership or another repair shop (local to me) to get a second opinion / estimate for repair and send it to Epic. I do not mind who performs the repair (as long as it is local) but Epic is responsible for all costs associated with these repairs.
