Review: May 29, 2014 I signed a contract and deposited $500.00 on my Visa card. I was asked for payment (by [redacted]) in full but because they did not accept American Express and my Visa limit is lower they took the deposit.

Install date was set for July 9, 2014 with different company Aqua Fun recommended indicating that is who they use since they do not install themselves.

On June 30, 2014 I received a message from [redacted] at Aqua Fun telling me they were going to deliver my pool on Wednesday July 3, 2014 and did I want them to put it in the driveway or garage and to return the call. I returned the call that same day and left him a message saying that would not work for us and said we would need it delivered on July 7th or 8th. When he called me back again and we spoke he said that was our day. I explained we have (4) vehicles in our drive/garage and that we did not have the room for it to sit there for that long. He said, "well it's only a couple days". I said,. "No, it's 6-days which is almost a week". I also said, " if it was a day or maybe two we could do something else but not for that long." He told me he was not in my area on the 7th or 8th like we requested. I asked him when he would be in our area next an he said, "I have no idea." I told him I run a company based on areas so I understand where they are coming from but that someone had to have some sort of idea. He said he was the only one who made the schedule.

After that frustrating conversation I called [redacted] who sold me the pool and explained the problem. I told him at this late date we were just going to cancel our order and told him to refund our deposit. He said, "Um, I'm not sure if I can do that - we usually don't. Well for pools we don't usually just hot tubs. I would have to talk to my boss whose the owner about that." I said, "Great maybe the owner can give us a delivery date."

[redacted] called me back and said, "I just talked to my boss and he said to call and tell you he is the field so he can't talk to you and that he would call you tomorrow." I told [redacted] to have him contact my husband [redacted] and gave him the office number. Next day.... No call. Day after.... No call. Nothing.

On Wednesday - July 2, 2014 - I called and told [redacted] his boss never called us back so we are for sure cancelling our order. I followed up with a letter indicating our dissatisfaction with their company, confirming our order was cancelled and told them to refund my deposit to our credit card or to issue us a check. NO RESPONSE FROM ANYONE.

I waited what I believe is a VERY generous amount of time (OVER 30-DAYS) and followed up with yet another letter on August 6, 2014. I indicated in that letter the same things as before except that I would not attempt getting our deposit back via correspondence after this letter. I have now given them another 14-DAYS WITH NO RESPONSE.

There is also nothing in the store AND I have gone through all of our signed documents and there is nothing, no fine print either, indicating we could not cancel. I am now turning to you for assistance.Desired Settlement: Our money should have been refunded a long time ago. There is nothing stating an order can not be cancelled. Believe me I checked our documents closely before cancelling initially. The logical outcome is a refund of our deposit. Cash, check, money order, or back on our credit card period.
