Aquarian Pools did finally come out and level their piles of dirt and trenches that they left, however they still did not replace the chlorine that I used waiting on them to finish the pool and they also charged me an extra $for some unknown reasonI wouldn't have paid the $but if I didn't then they could of denied me the warranty, so I really didn't have any choiceSince I have already paid over $45,for this pool experience I couldn't take a chance on them having a loop hole not to warranty it! So it was easier to pay the extra $127.00! So I would still like to get the chlorine that I used replaced and have them send me my extra $back and still cover the warrantyThanks for your inquiry

In response to Aquarians latest accusations, apparently now the delays were caused by me “performing task around the pool”! So what lie will they come up with next? Maybe an alien ship landed in my back yard and prevented good ole Aquarian from doing their job!
Anyway, I am still waiting on this pool to be completed and the county’s final inspection to be done; which I already gave Aquarian the money for! And yes the E-Z Vac/ DVliterature says that the 32’x16’ kit comes with 40’ of hose however the literature does not mention that some of the hose overlaps itself because they are small pieces of hose that you have to assemble. I suppose that is why the manufacturer RECOMMENDED this kit for a 32’x16’ pool not a 36’x18’ pool like I have. But in typical Aquarian fashion they want me to just live with their mistake! Even the literature that *** sent to the Revdex.com says that this kit is for a 32’x16’ pool and again I HAVE A 36’X18’ POOL! Really?
The dirt they left piled still needs leveled, the pipes from the pool still need covered (please see the attached pictures), and the new driveway that their heavy equipment made needs to be at least leveled so I can plant grass (since I am sure they won’t plant grass). Also the chlorine I used while waiting on Aquarian to finish the pool needs to be replaced (and the pool is still not finished), and the so called “pool school“ needs to be given
So I am still waiting on Aquarian to finish this job, AND WHAT EXCUSE DO THEY HAVE NOW?

We have performed a pool instruction pool school with Mr*** at his home We did offer to stop out and do some additional grade work for him around the area
We had our Construction Supervisor stop out and provide some additional grade work for Mr*** We also provided sections of hose for Mr***s pool cleaner
We left a final bill for $and have received full payment on his account
I have stated in the past in writing and on phone conversations with Mr*** that his pool was originally purchased with 3' of concrete decking around the perimeter of the pool He added a diving board and needed an amount of additional concrete to provide space for the diving board to be placed The cost for the additional concrete was $
I have had phone conversations with Mr*** in regards to the cost of the chlorine used in his pool Normally we do not have delays during the project, where customers wish to perform stages of the project on their own I have explained that we were not responsible for chemicals used to keep the pool clear during the delays while we waited for him to complete his workIf we had been permitted to keep working in a timely manner, this would have not been an issue

Mr*** returned my call on 10-13-and asked if we would forgive his final balance of $
I contacted Mr*** back on 10-14-and explained that we had completed the work that he contracted us to perform I would give him additional sections of pool cleaner hose to ensure that the cleaner had plenty of hose to reach the end of the pool As I have stated before the manufacturer enclosed 40' of hose and the the pool being 36' with the skimmer placed on the side, 40' should be plenty I will supply additional sections for Mr***
I explained that we would like to schedule a pool school to go over operation of the pool and then collect the final balance of $
Mr*** asked about a final pool inspection by the Clinton County Building Department I told him they may not schedule until a fence is installed I called the county and scheduled a final inspection, it turns out they will do the inspection without a fence installed and do not need a fence as part of the code in that area
I have instructed our office to contact Mr*** about scheduling his pool school and delivering the sections of hose I have for him
Mr*** continues to state that we have not finished grading his yard I explained that per his estimate sheet and contract, we perform a "machine grade" not a landscape grade and this has been completed Mr*** has had other contractors in the area working on the septic field and installing a retaining wall during the time our work was performed
Mr*** made threatening comments about uploading photos of his backyard to me It seems he is using the Revdex.com as a tool to strong-arm our company into doing additional work for no cost to him I find it sad that a company cannot do a good job and perform the work that was agreed on paper with out someone using some thing like this to try to get more for nothing or their name gets smeared
I hope to see this matter come to an end and we can both move on from this experience

In response to Mr. [redacted]'s latest claims.
 
I left him a VM last week about the cleaner hose length.  I also tried to call again today and got his voice mail.  I would like to work with him about the cleaner and set up a pool school.  If Mr. [redacted] will not return my calls, it makes it hard to work out details.
 
I have included a copy of the literature from the DV5000 inground pool cleaner he purchased with his pool.  Mr. [redacted] keeps referring to a EZ-Vac.  An EZ Vac is an above ground pool cleaner and not used in inground pools.
 
The literature shows that the unit comes with 40' of hose.  I have tried to speak with him to figure out what is going on.  I have had issue with Mr. [redacted] stating things that were never said to him in an attempt to get more work done than was contracted and paid for. I will gladly work out this hose issue with him to get this project completed and behind us both.
 
Mr. [redacted] seems to forget that the delays that caused his pool to take longer than normal, were from him performing tasks around the pool himself and not allowing us to work on the pool until he had performed certain tasks "his way".  Aquarian Pools did not cause his delays, nor did we cause the pool to turn green while waiting for him to perform the tasks around the yard.
 
The issue with payment. A number of times Mr. [redacted] has stated that he would not pay his bill at the contracted times and at one point I had to contact him and inform him we would not be back until he had made good on the contracted terms of the project payment before work can be restarted.  With this issue I have little faith that any items added would be paid for and ask that he pay for those items at or before delivery.  We are not trying to do anything wrong, we just expect the terms to be met from both sides and do not feel confident in this situation.
 
I have contacted the manufacturer of the pool cleaner and asked to be sent additional hose to help get his matter closed.
 
When Mr. [redacted] contacts me, we can set up a pool school and move on.

Ok, I will address the issues that Aquarian Pools spoke of in the order they mentioned them.
     First, [redacted] did not show up for the first 2 appointments. . I then went to the store and asked [redacted] & [redacted] why,  they informed me [redacted] would call me.   He called me that evening and said he would be there the next day (sometime?).  It was too late for me to call off work however Aquarian insisted on coming the next day , not everybody can be on Aquarian time.  So I called [redacted] and asked how would [redacted] know where we wanted the pool since I could not be there and [redacted] never came to my house any of the prior evenings like [redacted] said he would.  Then [redacted] said "Don't worry, [redacted] always takes measurements, so he knows where you want your pool , because he came to the house and painted where you wanted it ".  [redacted] and I were the only ones that discussed where to put the pool.  My wife never entered any of these discussions, Until I was at work then they cornered her and told her " If we don't dig the pool now then we will have to come back at a later date".   When He came to the door to get my wife He told her that he needed to show her something.  Once she was in the back overlooking the painted pool shape they had drawn out , He proceeded to ask her if it looked ok to her.  She immediately explained to him that she had no knowledge of where the pool should go and told [redacted] he was supposed to be there the night before to discuss it with me.  He continued  to press her to say if it looked good and when she told him she thought it should be moved more slanted He acted pained and agitated.  She then went into the house and they came and asked her to come out again which she did but expressed to [redacted] that she felt  uncomfortable with the situation.  She then began calling me and taking pictures  on her cell phone and emailing them to me trying to show what they had outlined.  [redacted] kept asking if it looked ok, she kept asking him what did him and her husband discuss.  He never gave an answer but seemed impatient.  Finally she told him she did not know but it looked ok to her. then proceeded back into our house.    It actually was moved further away from the deck by my wife which saved us some structural damage to our deck.   
     As far as me not paying ,  I have all the check stubs proving that I paid everything every time I was supposed to .  The first check I even drove to the store to deliver the day that the pool that the pool was dug on 7/1/14.   Because I thought the excavator people forgot it , and according to US Bank Aquarian pools cashed it the next day.  So this is an outright lie to say that payment held anything. 
     As far as me delaying the installation of the liner ,  This is another bold faced lie.  They never showed up for the previous three appointments.  Then again they showed up without calling me to say they needed to put some parts on the pool.  However I had rented a small excavator for the weekend so I could put the retaining wall by the pool.  So they could not work in that area of the pool while I was digging there.  However another two workers showed up within an hour and did all their work from inside the pool.  So my rented time on the excavator did not even slow them down. 
     As far as the gravel and rebar, this is actually honest !  I did tell [redacted] at Aquarian pools that I did not want him to pour the concrete right on the mud.  But then of course in their usual shotty  method of doing things, [redacted] & [redacted] proceeded to tell me ( with a straight face)  that "you don't have to put gravel under concrete"!  [redacted] said the concrete around his pool has lasted 15 years and they poured it right on the mud.  So yes, I told them to wait till I had gravel down, which took about 1 week.
     As far as the grade that they "cut down at no charge"  They cut it backwards so that the water was draining back towards the wall and house.  When I told [redacted] this wile we were on the phone , he said " That is what you want".   So since he obviously doesn't know construction or care , I had to once again rent more equipment and dig it out myself the correct way so that the water would drain away from the house and wall. 
     As far as the eight thousand dollars and addendum, this is another lie.  Yes, I did want another $8,000.00 of concrete poured as [redacted] and I discussed months earlier.   They never ever gave me any "addendum" or paperwork of any kind to sign.  [redacted] and [redacted] both told me that the concrete company was a separate company.  So I called the owner of RW CONCRETE and asked if he knew what the total charge would be.  He said that he had no idea, but he would know the next day when he started to pour.  Then thirty minutes later [redacted] called and said it was going to cost $8,001.00 and that he needed the check before any cement was ordered.  Knowing how these guys have been for the past three months and how they show up when ever they want, and do a little bit of work.  I told [redacted] that I would give the check to the concrete company / Rob , when he showed up to put the cement in.  Which would be the first time ever that I paid for construction work before anything was done !   Again , I always paid Aquarian early or on time and I have the bank statements to prove it ! 
     Again [redacted] and [redacted] knew about the hoses and Nozzles being short / missing a month and a half ago.  Yesterday [redacted] showed up with the Nozzles and then tried to get me to accept some mis-matched cheap substitute hose for the   E-Z Vac,  So I am still waiting on the hose.  And when [redacted] showed up , He never called and walked around the back of the house to lay the cheap hoses down.  I caught him and told him to take them back, and get me the right hose.  And what a surprise ... [redacted] never called! 
     They did finally pour the three foot of concrete around the pool today.  Now they still need to bring the right E-Z Vac for this pool , clean up their garbage mess, put the ladder , poles and diving board in, clean the pool  (cement is now in it)  , give me my liquid shock that I have used to keep the pool clean while I waited on them, give us the "Pool School"  so we know how to close this pool, cover the exposed pipes, and level out their piles of mud everywhere.

     It amazes me how this company can be so bold as to lie about something so easily proved false.  Like payment history.   It saddens me because this all started with such hope in this company .

In response to Mr. [redacted]'s complaint.  He chooses to leave out key details as to why his project has taken months to complete, all of them by his control.
 
Mr. [redacted] contracted with Aquarian Pools to purchase a 16x32 Gemini pool. He then decided to change the pool after a few days...

to a 18x36.
 
The 1rst reason the pool was delayed is Mr. [redacted] either did not know or neglected to tell us that the area he wished the pool to be placed was with in the area of his septic leach field.  Upon our site inspection [redacted] our Construction Supervisor advised him that the pool could not be placed in or within 10' of the septic system.  We then went thru numerous phone calls, home visits and meetings with Mr. [redacted] and Septic companies as we tried to come to a conclusion on wether we would move the pool or the septic system.  I personally met with Mr. [redacted] one evening to explain what could and could not be done with placement of the pool.  At that time Mr. [redacted] told me how I was going to install the pool.  I used a laser transit and showed him that the pool could not be placed in an area that would need to be filled and his response was "just use the dirt from the pool excavation".  I explained that the pool would not last in that configuration and I would not install the pool in that manner.
 
We then waited for Mr. [redacted] to make a decision what to do about the septic and pool placement.  After quite some time(I did not keep records of the wait). Mr. [redacted] informed us that he would have the septic field rerouted and the pool placed behind the home in the original location.  We told him that would be fine and to let us know when the septic company was to complete their word, so we could get started.  After time passed we found out that the septic was complete and we went out to excavate the pool.  [redacted] met Mr. [redacted] and painted out the location of the pool and scheduled the excavation.  The day the pool was to be dug, we asked Mr. [redacted] to be on site for about an hour. Mr. [redacted] stated he was not available, but his wife would be home.  [redacted] and our excavator showed up to excavate the pool and Mrs. [redacted] asked them to move the pool over.  She contacted Mr. [redacted] on the phone and explained the change that she had asked for, Mr. [redacted] agreed and we moved the pool over a few feet.
 
After the excavation Mr. [redacted] contacted us to tell us that the pool was not in the correct area and he was not happy with the pool.  [redacted] and I went out to meet him and showed him the pool had only been moved over a few feet.  He felt the small change now caused the need for a retaining wall to be installed.  We explained that the pool before it was moved also needed a retaining wall and we felt he had been made aware of this fact.  Mr. [redacted] "thought" the dirt could be tapered as to not need a wall in the area.  I explained that the depth of the area looked to be around 6' tall and never could have been taped as he thought.
 
At this time Mr. [redacted] demanded that we stop production on the pool and allow him time to consult with a wall installed before we installed the pool panels and floor.  I explained that there was no need to delay the job.  Mr. [redacted] demanded that was to be done.  He told me I would build the wall and I explained we did not wish to contract any additional work for the wall as he had become increasingly hard to work with.  Mr. [redacted] had meetings with at least two wall bolding companies and decided to construct the wall himself.  He called to tell me to start back on the project as the wall builders had mentioned that was the proper course of action, to build the pool before the wall.
 
After the pool walls we constructed we asked Mr. [redacted] for the payment listed on the purchase agreement signed by him when he purchased the pool.  He told [redacted] he planned to not pay anything until the pool was complete.  [redacted] called me and asked what to do.  I contacted Mr. [redacted] to inform him we would not be performing any further work until he made good on the contracted payments.  Again slowing down the process.  Mr. [redacted] after some time agreed to pay the payment and work was continued.  
 
We were scheduled to install the pool floor and again were delayed by Mr. [redacted] during the installation of the liner.
 
As were getting ready to pour the contracted 3' perimeter of concrete decking Mr. [redacted] stated he wished to have the concrete poured over a bed of gravel and have metal rebar in the concrete. I indicated that we had started using fiber mesh vs. rebar years ago, he stated that he would complete the wall and install the gravel and wire mesh himself.  Again we waited.
 
Mr. [redacted] asked us to cut down the grade around the pool so he could install gravel. We did this without any additional charge to him.  After waiting weeks for him to complete the wall, gravel and rebar.  We were told we could pour the concrete decking.  We scheduled the concrete crew in and were told he wished to pour over $8000.00 worth of additional concrete.  [redacted] contacted him with a addendum as we had not contracted this additional work and asked for payment of the concrete.  Mr. [redacted] denied payment of the concrete.  At this time we had to cancel the delivery until a decision was made.  Our normal policy is any additional concrete is to be paid after forming, but before the concrete is delivered to the job site.  I had to call Mr. [redacted] to speak with him. I explained that this was how we always performed this and I would not make an exception, as he had been difficult to collect payment from in the past.
 
Mr. [redacted] contacted me later that evening to tell me he had been improperly shipped a short vacuum hose and was missing three eyeballs.  I told him I would have them delivered the next day. He stated that he would go ahead and pay for the concrete when it was poured.  I again explained that it must be paid before shipped to the home.
 
[redacted] was out yesterday to deliver the hose and eyes he noticed that the wire Mr. [redacted] had installed in the pool area, had not been bonded per the national electrical code nor had it been inspected.  Mr. [redacted] stated it did not need to be inspected as we had had a bonding inspection prior to his work.  I cannot complete concrete over an area that had not been properly bonded and inspected.
 
Mr. [redacted] and I had multiple conversations about the concrete ending in the fact we would pour the original 3' contracted and he would handle the rest.
 
Mr. [redacted] stated in his complaint that we would grade his yard and landscape it " beautiful"  We have in writing that we perform a "rough grade and final or landscape grade is the responsibility of the homeowner".  I also believe Mr. [redacted] has had other excavation equipment on site after our back hoe prints were made and cleaned up while building his wall and moving gravel.
 
I have no problem completing the work and I can assure you all the work performed has been and will continue to be professional.  Mr. [redacted] has some odd views on how things should be done and seems to believe he knows more that anyone who does any task on the project.
 
I am more than happy to complete the project, I hope that  Mr. [redacted] will stop interjecting issues and ideas that slow and sometimes stop progress.
 
I hope Mr. [redacted] can see where the fault lies in this issue and stop his threats to write letters, deface our company and its employees.

WOW THESE GUYS ARE VERY GOOD LIERS!!!! First, I never asked them to "forgive my final balance"! I did call [redacted] and told him that I was so tired of all this hassle from their family run store and I thought that he was also, so I proposed that I bring back the EZ-vac/DV-5000 since I STILL don't have the correct hose and can't use it. Then they could sell it to some other poor sap and make their money. Then I would hire another contractor to level their dirt PILES that they have around my yard and the class that I was supposed to get they could forget about (since it's almost winter now), and he could forget about all the chlorine that I have dumped in this pool waiting on them to clean it. [redacted] even admitted that the chlorine that I used helped them so they didn't have to clean the pool. But now he doesn't want to replace it! The only reason [redacted] called the County for a final inspection was because I told him that I wouldn't pay a dime of the $1,500 that I still owe them until the pool passes the final inspection! And according to the county, the pool is not finished and deemed safe until that final inspection is done! Although [redacted] tried his best to talk me out of the inspection, which is now going to be done sometime this week.
[redacted] claims to have "finished grading his yard" and then I had "other contractors in the area working on the septic field and installing a retaining wall during the time our work was performed". This is so obviously a LIE! I had to have my septic field moved BEFORE they could put the pool in, all this work was done when [redacted] was guessing at where the pool could go. So when the septic field was moved they never left any tracks around where  the Aquarian family put the pool and they certainly didn't leave big piles of mud! So yes I told [redacted] that I will upload the final pictures on the internet when this is all done and they tell me they are finished, and for some reason this seems to scare [redacted]!  
So here I STILL sit WAITING after a month of reporting them to the Revdex.com for the Aquarian family to;  give me enough hose to use the EZ Vac/DV-5000, pass the final inspection with the county, replace the chemicals that I have used while waiting on them (and I am still waiting!), give us the pool class, and level out their piles of dirt. Then I can give them the final payment of $1500 which is on our contract. For some strange reason [redacted] has put in his amount owed MORE THAN THEIR CONTRACT SAYS!!! In [redacted]s rebuttal he said that I asked him to forgive me $1627, I don't even owe this much! As per the contract that we BOTH SIGNED I owe a final payment of $1500! So I don't have any idea where [redacted] is getting this number from, I guess he doesn't like the fact that I went to the Revdex.com so he's trying to squeeze some extra money out of me!
I WANT THIS JOB DONE SO I CAN GET AWAY FROM THIS FAMILY!

Again I have to respond to Aquarian Pools comments and be bothered instead of them doing what they should! They seem to think that their needs are far more important than the customers. What is their excuse for not completing this pool now? Are they going to lie again about payments or something else? I filed this complaint back in September and they still have not completed this pool, wouldn't you think that a customer that goes to the Revdex.com would be their top priority? Well apparently not to them! 
Yes they have poured the concrete around the pool and finally installed the diving board. Which they wanted paid for before it was even installed and I told my wife, "do not pay until the board is installed". It was a good thing I insisted on this because once again they showed up without all the parts and had to come back at a "later date"! All this company seems to be worried about is their money and they don't care about the customer or their quality of work at all. [redacted] told me when I ordered the diving board that they would have to pour an extra 5' by 10' cement slab. However they poured just a very small concrete walk way around the diving board. So I don't know if [redacted] just lied to me before, trying to sell me extra concrete or if this diving board is going to break the concrete next year ( when we get to use it ) !  I guess we will find out about that next year!
The ladder and hand rail are finally installed and they did finally send someone out to pick up MOST of their trash and vacuum out the pool. HOWEVER they still have not given me the right E-Z vac, as it says right on the box that it is made for a 16' by 32' pool and I have a 18' by 36' pool, as my contract says! This story that they are saying that "it will work with a 40' pool is another lie! The total length of the hose is only 34', need I remind the "pool professionals" that my pool is 36' long plus an additional 4' for the steps and an additional 4' for the depth of the pool! This means I need a hose that is at least 44' long, so now maybe the "pool professionals" can get me the right E-Z vac that I ALREADY PAID FOR! Also they still have not covered the exposed pipes, they haven't given me back all the chlorine that I had to use to keep the pool from turning green while I waited on them to complete their job ( and I am still waiting on them), they still haven't given me the "pool school" and they haven't done anything with the piles of dirt that they have around my yard or the "new drive way" that I now have going down to the pool from their cement trucks and heavy equipment! So again I say what I said in my original complaint, I want this job COMPLETED in  professional manner and SOON!
They also never called me to make any arrangements for their people to come over, they just seem to show up whenever they want and walk around MY house like it's their house! They seem to think that they are the important ones and the customers are a necessary evil that they have to put up with to get their money. I EXPECT THEM TO CALL FIRST!
