Our attorney brought in a geotechnical engineerWe explained how during installation a heavy rain caused a hole to appear during construction This hole came about after the pool-crete was pored but before the liner was installedThe builder, Shawn G*** of Aquaworks in Hernando, stated their must have been a tree at one time even though there were no rootsShawn charged us for additional concrete to fill this holeThe concrete was poured on top of the pool-crete to make it levelThe engineer's opinion was "that the concrete settled, which is to be expected and he has never known a pool to be installed without issues"We were able to find out from dated pictures there was never a tree in the area of the pool
After the pool was filled with water we noticed the side where the concrete was poured was lower than the rest of the poolShawn pulled the liner up and placed spacersThe same side has continued to be lower than the rest of the poolWe sent pictures, emails, and many texts to ShawnHe's been out on a few occasions and each time he says he will work with us, do us rightHe's now refusing to fix the problem
The concrete has continued to settle so much so that it is visible from above the surface of the water There are now cracks forming in the yard/ground in that area We have documentation and photos to support our case
Will be looking to file a lawsuit
