I am rejecting this response because: We are going to have to agree to disagree in the behavior or Mr [redacted] when he came to our property for inspection We had witnesses inside the house and will verifying he was rude and aggressive the moment he showed up for inspection With that said, he didIt do any inspection of the area while there if he would have he would know that the damage is more that 6"-8" it spans 5'X6', but seeing how he proceeded to tell us we did not know anything and our engineer didn't know what he was talking about, my husband and I knew he was not there for a solution Mr [redacted] nor any of his staff have ever tried to resolve the issue of our sinking concrete slab This is also not where the gas line was trenches, this is where the ramp the tractor went down was trenches.To address the statement I would not let them use our water is a poor excuse to avoid the issue that the soil was not packed correctly We did not spend 50k for a pool and 12k for landscaping and then tell them they cannot use our water His statement is blanent lie to place blame on us for their poor work in this area.I would also like to state, that we love our pool and have had many family fun days enjoying it, unfortunately we have an area that was not properly prepped and is causing damage to our deck we would like addressed and fixed We are not unreasonable people, we are respected professionals in our own fields of work, however it is Mr [redacted] 's unprofessional behavior and unwillingness to even consider that this is clearly a prep of the soil issue based on facts.my husband and I will accept the out come of the CSLB outcome as well

On 10/23/we excavated the pool per our records, and we completed it per contract (installed the interior) on 12/19/We also obtained the final inspection 01/08/- I do not recognize any contact from Mr or Mrs*** about the decking issue prior to 01/10/referenced phone contact to our office? Per our construction methods, the "ramp" area is water soaked and tamped with a mechanical compactorDuring the time frame of construction, the whole State of California had been in a draught for approx 4-years, and the soil moisture content had been depletedThe amount of rain we have had since Dec has created many issues with concrete work especially in highly expansive soil areasOur concrete waranty is for one year, which expired on 12/19/2016, which is prior to Mr& Mrs [redacted] referenced inspection by their insurance "engineer"and when I recognize them contacting our office for warantyAlso at the time of concrete prep, many customers were complaining about us using their water to saturate the soil, for proper compactionI will personally visit the site, and evaluate the condition of the work performed 12/03/approx months ago

I am rejecting this response because: Aquos Pools has mistated the time frame for when I mad the first complaint about about the large crack in our concrete pool deck on June 5, at 9:am (six months after our pool was completed), I email *** *** at *** regarding the large crack in our deck and on June 5, at 4:pm, I received a response from *** *** acknowledging my concerns. This was after several phone calls that were not returned from the *** at the main office. Then after more phone calls and not hearing back from anyone from Aquos Pools since June 2016, on October 9, at 12:pm -. I emailed *** *** again regarding the deck problems. Still I did not hear back from anyone, so I called the City of Brentwood and inquired about the issues with our deck and wanted someone to come to review the damage and I was told I should contact Aquos Pools and the engineer they worked with. On November 15, I sent an email the *** to file a complaint about the deck problemsThis is when I finally got a call from the lead Foreman for Aquos Pools who then took about a month to come out and assess the damage to our deck. The first thing he did was hand us a piece of paper that says Aquos pools does not guarantee concrete work and proceeded to be aggressive with my husband and I. I told him that I was home during the entire project and my landscaper was present when the concrete was being prepared and they did not use a tamper or an electric tamper to pack the dirt and although he was not there, he claimed that was not true. I told him, I have pictures and video of the entire process and he did not care, just repeated it was not their problem. I asked the foreman if he would want this crack in his patio and he said no he would want it fixed. I have been working with my insurance company to see if I could have them cover the damage due to poor workmanship and was just able to get the engineering report completed June 2017. My husband and I have been trying to resolve this with Aquos Pools for a year now and I felt I had no other option than to file a complaint with the Revdex.com as well as the CSLB*** *** ***

We did agree to replace the caps, and we still will do the repair. The weather this year bottle necked our schedule badly, and the last time I spoke to [redacted], they had a party planned for Easter that would have interfered with repair. I will contact [redacted] this week to schedule access for repair on...

caps to be made, and follow up with cleanup of deck area.

I did evaluate the engineering report provided, and the area where the measure tape goes under the concrete is where the gas & landscape trench are at. It appears to be 6" to 8" wide, and our tractor ramp is usually 8' wide. During the compaction and watering of the soils on the project, the owner continually complained that we were using her water/ as the city was in drought restrictions at the time. The concrete would and has bridged over the trench, since the trench settled from the extreme amount of rain/water that all of Brentwood and northern California has received @ Dec 2016 to March 2017. I never questioned the result of the engineer report, as I had not seen it when I visited the property, but I questioned the TYPE of engineer their insurance company had sent out. I would like to have another opinion that is not biased, since I expect the insurance company is not excited about paying to repour the whole concrete deck area, as the homeowner has requested.  I also never said we would not remove and replace the areas in question, but I did say the cracks look normal to the area/type of soil, and that our construction agreement specifically says we do not waranty/guarantee concrete from lifting-settling-cracking-chipping-color or discoloration. I expect the CSLB to send out an expert to look at the work, and we will abide by their decision. This customer was in a posture of wanting to fight me, and all I wanted to do was evaluate their claim. I am not required to allow my employees to be degraded, and expect reasonable courtesy from our customers.
