Again this complaint was responded tooNo money will be refunded or Tree replacedThe warranty is not unconditionalCustomer must care for Tree as specified when purchased and plantedThis customer did not water Tree all year and it turned brown and diedTherefore voiding warranty

I am rejecting this response because: My husband specifically asked the guys who planted the tree what needed to be doneThey did not tell him that he needed to resume the weekly watering in the springHe was told it only needed to be done till winter.

I am following up because this case was closed because J*** Arbor Hill Tree Farm said he didn't provide a product or service to me *** or my husband,***I respectfully submit the following document with pages that provide proof that he did sell to me and my husband a product and service that include: 1) The statement/Invoice given to me and my husband by Arbor Hill Tree Farm L*** when we paid $by VISA credit card for the spruce tree and installation fee on 5/22/15, 2) Credit card statement showing purchase of $posted on 5/25/Arbor Hill Tree Farm Cottage GroveMN as well as a copy of the VISA cards my husband and I jointly own, 3) detail of the purchase transaction at Arbor Hill Tree Farm from credit card statement showing $purchase, and 4) property tax statement for showing both my husband and myself as taxpayers at the property the whole was dug, ***, Woodbury, MN
My husband and I wish to pursue this as a complaint

I do not accept Jerry ***'s responseIn my opinion this is a true measure of a business owners integrity and ethics which in this case is "blame the victim"The owner (Jerry ***) is the so called "expert" of tree selling and installing not me as a consumer, therefore, in my opinion it is his duty to ask us the proper questions if he is going to dig and install a treeOn the MN GopherOne site the excavator Jerry *** was suppose to make a detailed inquiry and inspection into the work siteJerry Kdid not even ask us if we had a sprinkler systemHe asked us to indicate where we wanted the tree and we indicated where we wanted itJerry *** used an auger without properly inspecting the area or asking us any questionsAgain, in my opinion this business owner is the "expert" in installing trees and he did not properly do his due diligence in even asking if we had a sprinkler systemHe did not use the equipment carefully, which is evident because he damaged the sprinkler lines along with other damage to our lawn (and neighbor's lawn in back of us) and landscape edgingThe other big issue here is that Jerry *** was very disrespectful, swore at us (with my year old son in hearing range), and ran away without finishing the installationThis business did not take responsibility for damaging our property or finishing the installation and in my opinion tried every which way to avoid responsibilityHis contract that we executed does not state that the homeowner is responsible for neglect or damage on the excavator's partIf we had known that Jerry *** would not be honorable and ethical and take responsibility for damaging property then I surely would not have hired himIt amazes me how a business can operate so irresponsiblyI purchased a product and installation service in good faith only to have to pay additional money to fix damage that the business caused and is clearly responsible for fixingI still believe that the owner Jerry *** needs to pay for the damage he has caused to our property

There are many logistic issues associated with planting treesArbor Hill Tree Farm is responsible for getting public utilities marked before we digHomeowners are responsible for identifying & marking private lines such as irrigation systems & selecting locations for trees to avoid these lines
If lines are damaged when digging, ends are exposed & flagged so they can be easily repaired by an irrigation contractor at homeowners expense

Given that the customer admitted to not watering the tree in the spring after the tree was planted we will not be replacing the tree Our warranty states, "All Nursery Stock is Guaranteed for year, Assuming Proper Care is Provided To the Plant Material." Failing the
water a living organism within a year of transplant is not proper care.

Customer has selected a replacement tree and installation date scheduled
