Hi ***, Per our conversation last week, I am writing a respond to the complaint you received from [redacted] *** [redacted] came to my school, visited and enrolled her child [redacted] to start coming three half days a weekAlso was turning three on the 10th of November & she asked me if his first day of school can be on his birthday, and I did agreed to start school and bring a cake to the children, which I don't allow cake and frosting at my schoolSince her son was not potty trained and turning three, I gave her the tuition for potty trained children $585.00/month instead of charging her $156.00/week for non potty trained, which is $670.00/month.I also waived the deposit so it will be easy for her to start schoolSo, her son came to school and we celebrated his birthday & when she came to the classroom to bring the cake, he was standing on the table and not listening to the teachersThe mother did not like the teacher telling her son to follow classroom roles and directionsAlso she didn't like the teacher talking to her about potty training, so she came to my office to complainI offered her to bring her son to the three years old classroom where all the children are potty trained & I told her that him being around children potty trained, it will help him to become potty trainedShe liked the idea & the following week she didn't bring him to school instead, she came to my office & told me that her husband didn't like the ideaI told her to give him a chance to try at least for two weeks & if doesn't work, I'll prorate the month and give you the tuition difference backShe decided to start after Thanksgiving & to start fresh in the beginning of December so I saved the spot for her for almost three weeks but she didn't show up to school & she called the school leaving a message with one of my staff that she wants her money backI told her that the application fee is no refundable, and according to my contract, tuition is no refundable if you didn't give a month notice and you didn't even bring him to school in December as we agreed & saved the spot for your childShe got made & she thread me to go to courtEnclosed is a copy of the contract agreementPlease feel free to contact me via email or call me at the schoolThank you so much!

per our conversation over the phone, I offered her to give her son a chance to try the preschool classroom for the three years old children and potty trained even her son was not potty trained. I charged her tuition for three and potty trained which is $585.00 from her starting day November 10th to December 10th since she changed her mind about November & I saved the spot for her son to start in December after thanksgiving in the preschool classroom.I also told her that after two weeks of trying, you have the choice to leave the school & ill refund  you the two week tuition and if she decided to continue, then I'll calculate tuition for the end of the month so we will be on track for January as everyone pay in the beginning of each month. Instead of bringing him to school in December, which I saved the spot for her son & I could gave the spot to another child, she decided to go to kids camp daily drop day care to save money.As a business owner, I have to stand for my contract agreement not just with her, but with all the parents at my school in order to keep the business running in correct and professional successful school on a strong grounds.I hope that you will look at it from my business point view and thank you vey much for taking the time to look at this case.please feel free to contact me any time! sicerlley, [redacted]administrative Director

Base on her previous response, She wrote that my son wouldn't follow rules in the classroom. So, therefore, it would not make sense to move my son to pre school classroom and I believe its not a proper recommendation.And it wouldn't make sense also to charge me less for a higher level of service. And there was no conversation about calculating the tuition for the end of the month so we will be on track for January.My question is  Why would she save the spot for my son when in fact I already informed them twice on Nov. 12 and on Nov. 19 that my son is not going back to school and we want our money back. My son was only there for half day or 3 hours of a 12 day trial period( which she confirmed it on the 2nd paragraph on her response) and the school wants my money for a month worth of tuition.And its not about saving money. Its about the well being of my son and unfair business practice. And the school just wasn't a right fit for him.She always talk about business. How about the welfare of my son? Shouldn't it be up first?

And she said that she has increase the tuition lately but she will give me the old price but don't tell the other parents. So, I wrote$735.00 including the registration fee. She did not give any receipt. And I just realized that I over payed her since my son went there on the 2nd week of the month and not on the 1st week. After Nov, 10, I decide not to send my son back to their school.Nov. 11, Veterans Day- no schholnov. 12, I called the school and talked to sheena and told her to tell [redacted] about my son not going back to their school and she was on vacation on that week. And I was told that she will be back on. MondayMonday came, no return call received.Nov,, 16 I called back again and talked to sheena and she said she already informed [redacted] nov. 17, I called again and talked to sheena again and she said she will leave a note againnov, 18 I called 3x nov. 19 I went to her office and she offered for my son to go to the big class and I hesistantly agreed because I haven't talked to my husband. But when I got home, my husband said no and I immediately called her at around 2:14pm and told her that we want our money back and she said she will see.Dec 4, I made a follow up call using a different phone. And she said she will not give my money back.Dec8, I called again hoping she will change her mind to give my money back but no one answers the phone.Dec 11 , I called and she said she is with the student and I called back but the staff said she is gone for the day.Dec 17, I called again. [redacted] is the one who answered the phone and said that [redacted] is busy.dec 18, I called again and talked to [redacted] again and [redacted] said she she was told to tell me that I cannot get my money back. And I told to please tell [redacted] that Immoving to the next level.

Review: I enrolled my son last Nov.4 2015 at Arbor View Montessori School in Roseville Ca. His first day was on Nov. 10 2015. I dropped him off on that day at around 9am and he did not cry. Before I left, I talked to the teacher. And she asked me where I work? And I told her I work in a hospital.I am a nurse. And she asked me how old is my son? And I told her, "He is three today" and she said "How come he is in this room and not in the big room? And I replied," Because he is not potty trained yet" And she said, "Huh? He is not potty trained? You should know better because you are a nurse." My tongue was tied at that moment. I feel like I am a bad mother. So, I diverted our conversation to another topic. I told her that I will be back to give a small treats to the kids because its my sons birthday. And she recommended to come back at around 10:30 to 10:45.

I came back at 10:30. The teacher opened the door. I smiled and asked the teacher "how is my son?" Non-verbally, she turned her head and rolled her eyes to her left shoulder telling me to go ahead and take a look at my son. True enough, my son was climbing on the small table while the other kids were on the circle sitting on the rug. And the teacher immediately told me that my son doesn't listen to her, doesn't form a circle and he is everywhere. And she also said that [redacted](the head of the school) wants to talk to me. And I went to [redacted] and we talk the same thing what the teacher told me. When I got home, my brain was debating if I want my son to continue to be there considering the attitude of the teacher. And I feel that the teacher doesn't like my son.

On November 12,I called the school and talked to [redacted] and told her to inform [redacted] that my son is not going back there anymore. And she said that [redacted] is on vacation at that time but she will definitely inform [redacted] about it.On Dec 4, 2015 I talked to [redacted] on the phone and she told me that she will not give my money back because if she will do that,all parents will be doing the sameDesired Settlement: It is fair enough that the school would give me a refund considering that my son was only there for 1 day. And it is still within the 12 day trial period that Lydia was talking about.
