Complaint: [redacted] I am rejecting this response because: This did not resolve my matter [redacted] told me that he would mark my verbal response on the 22nd as me giving my official notice and did not tell me that I would be required to provide it additionally in writingSince he accepted my verbal remarks over the phone on the 22nd I consider it unfair that you all refuse to accept my month verbal notice to vacate made to H***I will be moving out on the 15th of March Regards, [redacted]

I am rejecting this response because: It is not my fault that your employees are incompetent and did not advise me during our conversation that I needed to fill anything outIf she wouldn't suggested I fill out a form or write something down I would've done it that day because, like I have already said, *** and I purchased a house and were committed to not renewing our leaseI will be contacting your property management company because the matter has still not been resolved and I feel like my boyfriend and I are being treated unfairlyI'm sure you already have people who are waiting to move into our apartment so I will not be paying any fees because you will not be losing any money.I would be more than happy to take this matter to court

Good Afternoon,I just got off the phone with *** regarding this issueI was told that he was never given advance notice that his lease was coming up for expiration and that he forgot to put his notice inI did let *** know that we send out renewal letters at least days in advanceIt
looks like the letter we sent to the door of #*** was sent on December 22nd, which is actually days in advance of the lease expiringI have attached a copy of this letter which states, "If you do decide to move out, please provide us with at least a day written intent to vacate." This same policy is outlined on the first page of the TAA Lease Contract which is also attachedAt this time, we still have not been provided with a notice in writingAs a courtesy, I would be more than happy to back date the notice to February 22nd when you spoke to my Assistant Manager, *** pending that I receive written notice within the next hoursI certainly apologize that you believe we have been unfair in this matter, however, it is ultimately the resident's responsibility to know when the lease is expiringWe have done our part by providing an day notice that the lease was set to expireIf they have any other questions, please do not hesitate to contact me.Thank you,*** ***

I will be moving out on the 15th of March.

Good Morning,Again, I understand your frustration. Unfortunately, as we do not have ANY documentation that you spoke to [redacted] and she does not recall the conversation, this does not suffice as sufficient notice. This is the precise reason that we require all notices to be in writing. Our employees speak to hundreds of people a week and cannot be expected to recall each conversation. Additionally, yesterday I was told a different reason notice was not submitted by [redacted] over the phone which was that he forgot because we did not remind him the lease was expiring. I did provide the renewal letter that we sent to the door with more than enough notice on the response yesterday. Please note that it does state on the letter that we require a 60 day written notice if you are planning on moving out.  As I stated yesterday, I am happy to honor the notice from the day you spoke to [redacted] (2/22), however, I MUST receive a written notice as backup in order to honor this date and it must be submitted before close of business today. We cannot put an apartment back on the market to lease until we have written authorization that the resident is vacating. This protects the property from (for example) leasing an apartment to someone else and then the resident coming back and stating that they never gave notice and are not moving out. If there is nothing in writing from the resident, there is no proof that notice was indeed submitted. You are certainly free to move out at anytime you wish, but please understand that you will be charged back for insufficient notice if the requirements of the lease contract are not fulfilled.At this time, I have no other information to provide and only ask that a written notice be submitted as soon as possible. If you are not able to come in and fill out our formal notice, you are welcome to email me a written notice at [redacted] Thank you,[redacted]
