Complaint: [redacted] I am rejecting this response because: the car was only down a weekI understand if it was down 3weeks or a monthWhich doesn't make sense to tow someone car that was down a week and was going to take it to the shop MondayA person places of living shouldn't matter about a car being down a weekI've seen cars sit out here for months and never been bothered at all but my car was down a week almost and you all seems to mess with itThat doesn't make sense at all Regards, [redacted]

Please refer to page Paragraph that goes over parkingYou have admitted that the vehicle was inoperable and that is the reason is was towedUnfortunately, since your vehicle was not moved off property it was towedI’m terribly sorry as I stated before but you could have let us know even prior to the vehicle being stickered, so we could have tried to do something I understand the frustration with the air condition and we are working to get it resolved

Good Morning [redacted] , It’s unfortunate that we have been having trouble with your A/C unitYour A/C unit is a motor operating device that can become operable or inoperable at any timeWhen a A/C needs repairs honestly there is absolutely nothing we can do about that happeningThe unit breaking down is beyond our control however, [redacted] our maintenance technician has been working on your unit and parts have been hard to come byThank you for being so patent as I have been so patient awaiting the remainder of Marchs rentThe portal and things malfunctioning are just are beyond my control and all we can do is our best to fix the issueYou have been more than patient while we address these thingsIn regards to your vehicle you had admitted to our staff that it was a vehicle that had been broke downI wish you would have contacted us prior to the car being towed then we could have been able to do something about itAs soon as your vehicle is stickered by the tow company, it is your responsibility to contact the officeWe have to keep the property clean of vehicles that are not operating so we can open up the parking area for all residentsParking has been a problem recently only because we are so highly occupied at this timeSorry we were unable to help with this situationYour TVS that came up missing was this reported to the police? I am rejecting this response because:Regards to previous move out #*** upon reviewing records an initial move out statement was sent out from our office 5/4/to grand Prairie forwarding address left at move out(I provided a forwarding address as well as my apartment key- which is a charge on the bill attached) When moving out of an apartment at Arbrook Park we ask that you schedule a move out walk through about a week in advance with our office, (After reviewing the lease the above statement can not be found- a copy is also attached)if you desire someone to be present (it does state a repersentative could be request which I did and was imformed due to a change in management staff was limitedso I prove my contact information and was told I would recieve a call when the staff was availablei have not been contacted besides from *** ***) In the event a representative is unable to walk the apartment with you due to late notice we recommend that you take pictures of the apartment for your records( Picture were taken for my record which is why I have made this dispute) The move in condition form is vital when renting so you can note any prior damage that you may not have caused and We have no record of one being submitted for your apartment(it is attached to the lease that I still havethe lease states that only damages that are beyond wear would be my responsibilityOne of the two guest bedroom blinds was damaged and replace prior to moving out beyong that no aother damages exits)After no response to the move out statement being sent out, (reguest a copy thats been post dated, since I mentioned was not delivered to my address where I still recidethe move out file was sent to *** receivables on 6/29/and efforts to collect have taken on their part(the charges in the move out file is unlawfull and Arbrook apartment is primarily responsible for clain and harrasment that has followedI have reached out to *** after getting notice of this complaint and they have not received response from you previously I asked *** to attempt to reach you again(do not continue to ask this company to continue to contact me) If there are charges you are disputing please notify them so they can look into your concerns and get this resolved for youTypically landlord debts are sent to collection agencies and placed on your credit(this is an unlaawfull threat according to the after I reguested not to be contacted) Arbrook Park tries every effort to settle these debts so you are not penalized for something that can be taken care of between both parties of the lease contract(this is a statement since I was not contacted before this bill and then a debt collection notice was sent outnor does the notice states that I could dispute the charges) Please contact *** receivables and inform them of any disputes so we can work together to get this taken care of.(base on previous exchange with arbrook part apartment, no fair resolution can be reached without Revdex.com over seeing.)I could only attached four document but copies of all mention above can be provided.As have stated moving forward I would like my security deposit returned

The leasing consultants at Arbrook Park Apartments are consistent when following procedures and all guidelines when relaying pricing information to every prospectPrices can change daily and that is beyond our controlRegards to the screening department unfortunately we are unable to see what
exactly is on your creditWhen the results came back we offered the applicant the phone number to the screening department so they can review the decision process with the applicant but, the applicant refusedThe screening department will not disclose or discuss the applicant’s personal information with our staff which is why we give our applicants the resource to check into thisWe are in no way allowed to alter screening results for any applicantsWe allowed the client in question the opportunity to either accept the approval terms of the additional deposit or have to option to decline and we would refund the deposit /administrative fees that were put up for the apartmentThe applicant agreed to the terms and since then the applicant has been unreachableThe leasing staff has attempted to contact the applicant several times without responseIf you have any further concerns please don't hesitate to contact our office.Arbrook Park Management

I am rejecting this response because:my car was added to my lease a year agoThe car you guys had towed was only sitting their about a week because it had broken downIt was one thing that needed to be fixed on the car so I don't understand why tow for sitting there a weekNo tags or nothing was expiredAlso the capital towing company I spoke with they only tow for unauthorized parkingI'm not understanding that at all my car was authorized for parkingSo for it being down for almost a week shouldn't have anything to do with it at all for being thereAlso the air been out almost months on April 1stFiling on my insurances for somewhere to stay shouldn't have to do when I complain to you guys I dont know how many timesPaying all this money a month and isn't getting things fixed in a orderly fashion is bad business

Please refer to page 3 Paragraph 21 that goes over parking. You have admitted that the vehicle was inoperable and that is the reason is was towed. Unfortunately, since your vehicle was not moved off property it was towed. I’m terribly sorry as I stated before but you could have let us know even prior to the vehicle being stickered, so we could have tried to do something.   I understand the frustration with the air condition and we are working to get it resolved.

Mr. [redacted], we appreciate you taking the time to share your concerns with us and we have not taken any of these instances lightly. You have most currently experienced some bad luck when it comes to the events leading up to today however, all of these unfortunate events are beyond anyone’s control....

The gates are limited access or privacy gates, in no way can the apartment community guarantee one’s security. Gates can become operable or inoperable at any moment. I’m sure you are also aware that we are not in control of anyone’s actions. Crime knows no address. The property lighting, I have not received one complaint in regards to this and this is the first time we are hearing of it. We do have a courtesy officer that does light checks of the property on a weekly basis; when issues are reported to us we take care of immediately since this is a security issue. If you know of a certain area that we need to address I will be more than happy to get that taken care of. I would like to now refer you to the Texas Apartment Association Lease contract that you signed and agreed to as of September 6, 2016 Lease addendum for remote control, card, or code access gate Paragraph 6. Goes over personal injury and/or personal property damage “Anything mechanical or electronic is subject to malfunction. Fencing, gates or other devices will not prevent all crime. No security system or device is foolproof or 100% successful in deterring crime. Crime can still occur. Protecting residents, their families, occupants, guest, and invites from crime is the sole responsibility of residents, occupants, and law enforcement agencies. You should first call 911 or other appropriate emergency police numbers if a crime occurs or is suspected. We are not liable to any resident, family member, guest, occupant or invitee for personal injury, death or damage/loss of personal property from incidence related to perimeter fencing, automobile access gates and or pedestrian gate. We reserve the right to modify or eliminate security systems other than those statutory required.”   Page 4 paragraph 24.4 informs you about Loss “Unless otherwise required by law, we’re not liable to any resident, guest, or occupant for personal injury or damage, loss of personal property, or loss of business or personal income, from any cause, including smoke, fire, rain, flood, water leak, hail, ice, snow, lightning, wind, explosions, interruption of utilities, pipe leaks, theft, vandalism, and negligent or intentional acts of residents, occupants or guest. We have no duty to remove any ice, sleet, or snow but may remove any amount with or without notice. Unless we instruct otherwise, during freezing weather you must for 24 hours a day: (A) keep the apartment heated to at least 50 Fahrenheit, (B) Keep cabinet and closet doors open, and (C) drip hot- and cold- water faucets. You’ll be liable for any damage to our and others’ property caused by broken water pipes due to your violating these requirements.”   We also advise you to review the security Guidelines for resident’s addendum; This addendum goes over security guidelines and states: “we disclaim any express or implied warranties of security. We care about your safety and that of other occupants and guest. No security system is failsafe. Even the best system can’t prevent crime. Always act as if security systems don’t exist since they are subject to malfunction, tampering, and human error. The best security measures are the ones you perform as a matter of common sense and habit.” It also informs you that if there are any burnt out building lights to inform us in writing. Refer to your Lease addendum for requirement of renter’s insurance. This addendum reiterates we require you to obtain a renter’s insurance policy. It is very informative on what you can do to protect you from cataclysmic events. I am also asking that you don’t take my word for it, please read this legal binding contract you signed and seek legal advice if you don’t understand something.   We want to thank you for acknowledging the fact we worked with you because we went way beyond our responsibility to aide in financial ramifications you endured because of these occurrences. You are not locked into any lease contract, please refer to the lease addendum for early termination of lease contract for more information. As far as your concerns to the previous criminal history of the complex. The apartment complex does not have to disclose the information about the murder committed on property back in 2010. We only have to disclose such information if asked and in this particular case, you did not ask. This information is also public record and [redacted] was informed that she could go to [redacted] to check crime rate in our area when touring the property for the first time. There was absolutely no violation of tenant rights in this case. I hate that your experience has been less than satisfactory however Arbrook Park has addressed everything as we should. I am rejecting this response because: the car was only down a week. I understand if it was down 3weeks or a month.
