[redacted]
Initial Consumer Rebuttal /* (3000, 11, 2015/10/26) */
(The consumer indicated he/she DID NOT accept the response from the business.)
In response to [redacted]'s email I contacted the Revdex.com for someone to pour concrete. [redacted] from [redacted] and Wayne A[redacted]'s on behalf of [redacted]. I had [redacted] coming out to do an estimate and Wayne A[redacted] called and did his estimate over the phone. So I went with him instead and cancelled [redacted]. With the first pour Wayne was arguing with my General Contractor [redacted] when he asked that he center the concrete to where the stairs would be going. He was throwing his hammer and refusing to change it again. [redacted]
As for calling [redacted] to check it out, it was about a 1 week not 2. The problem with the first was the grade of the sidewalk as well as the dips and hills that were throughout the sidewalk. [redacted] came out and verifyied all of this and agreed to the repour. I have to take some responsibility for this as I was letting my General Contractor handle this instead of me being outside myself. I was not feeling well that day.
Then [redacted] is stating that I paid for 1.0 yad3 when I paid Wayne for 2.1 yd3 [redacted]. I even brought this up to him on the phone when we were talking before the repour and they both insisted that I only paid for 1.0 yd3. As for the replacement, Wayne was not able to get the grade down so we discussed this and went with the steps instead. While he was pouring he agreed to keep the concrete smooth under the steps without the need to stamp. As you can see from the pictures I sent to both Revdex.com and [redacted] that is not the case. I asked him why and his response was that no one is going to see it. But my response was that it collects water and will freeze and crack the cement. Plus when Wayne removed the cribbing the top of the sidewalk was not rounded and rocks were showing throughout the pour. Also in the pictures I sent to both Revdex.com and [redacted]. I called Wayne and asked why he didn't round the corners and he said I didn't ask for it. So if I didn't ask for it then why did he round the edges of the back sidewalk? I also asked him about all of the rocks showing through, the rounding of the corners that he tried and the grinding of the steps (also all in the pictures) His response is that when he puts the sealant on with the Baja colour it would fix it all up. The reason I didn't call for a week was that Wayne did not return to my project to seal it on the day he indicated which was Oct 1, 2015. Neither did he come on Oct 2 to Oct 6th to complete withthe sealant. I couldn't get a hold of him via texting or phoning. He did not return either communication. So when [redacted] emailed me asking how it is I sent him the email that I have forwarded to Revdex.com. I called [redacted] as his request on his response email. I said that he could come out and see the job, just that Wayne was not allowed back. I also said that he could have someone else come out to seal it and fix the job as Wayne had explained to me that the sealant would fix all. [redacted] said to me he would have to think about how to proceed and that is the last that I heard from him. The only contact I have had regarding this is from [redacted] with case number [redacted] and name [redacted]. Which was on October 7th, @ 2:20 pm leaving a message. I returned her call and left her a message on the same day @ 4:30 pm and have not heard back from her as of today's date Oct 26th, 2015
As for the delivery ticket which I forwarded to Revdex.com was not the signed delivery ticket by the driver and by Wayne's kid [redacted] who actually signed the sheet. I did not receive a delivery ticket for the first pour as well or any type of invoicing for either job as [redacted] indicated that he would send to me, so not sure what he is talking about there. As well I invited [redacted] out to inspect the job as to which he has not come and there was no offer of a third party engineer to come out and inspect. So I have no idea what he is talking about here either. There is no correspondance to back up his story or phone calls as well. Like I said I have not heard from him since Tuesday, October 06, 2015 when he responded to my email message, which I have all forwarded to the Revdex.com. He has not made one attempt at mediating the situation. As for dispute between contractor and consumer, [redacted] is the one that contracted or sub-contracted Archer's Concrete so he is infact responsible for the job. Consumer's can only rely on [redacted] to send out contractors that are able to do the job properly and this being the second time around, me being the consumer would expect the best product that I expect for the price that is paid. So in actually I paid for 2.1 yds3 the first pour. Based on my remeasurment of the second pour which measured out to approximately 2.5 yds3 both times (all measurements sent to both Revdex.com and [redacted]) it is my estimate that in actuality I only owe for .4yds3 which I am not willing to pay for a badly done project. [redacted] So I want my money back in full. [redacted]
