I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

[Your Answer Here]
Rebuttal to Vendor's Response: I’ve purchased 3 shirts from ARI in the past. All 3 shirts were measured by various salespersons at ARI and sent out for alteration. All 3 were measured with my arm relaxed at my side. However, when they were measured, a little extra room was given in the sleeve for sufficient length to allow a full range of motion of the arm. I was told that this was the standard measurement procedure and that the purpose of the cuff is to prevent the sleeve from falling over the hand given this extra length. Indeed, all 3 previously purchased shirts were tailored perfectly, and they fit perfectly. In regards to the sleeve length, these shirts fit in the same way that every shirt I’ve ever worn has fit. The current shirt under dispute was recently purchased from ARI and has the same general fit as the other previously purchased  shirts. However, this shirt was tailored with sleeves 4 inches shorter than the previous 3 shirts. The sleeves are clearly too short. Indeed, with such significantly shorter sleeves, it is no wonder that I can’t raised my arms while wearing this shirt. I’ve attached photos comparing the fit and sleeve lengths of the currently disputed shirt with an equivalent shirt previously purchased from and altered by the same store. The photos make it clear that the sleeves were improperly altered, leaving the sleeves 4 inches too short. While the [redacted] of ARI claims that the shirt under dispute is properly altered. However, if the 3 shirts previously purchased and altered by ARI have sleeves significantly longer than the shirt under dispute, then either: 1. All three previously purchased shirts were altered improperly by ARI leaving the sleeves too long.OR2. The current shirt under dispute was altered improperly by ARI, leaving the sleeves too long. Based on the observation that I was satisfied with the previous 3 shirts and they fit as any other shirt I’ve ever worn have fit, it is clear that option 2 is correct. I purchased the shirt from ARI, their salesperson took the measurements, and sent the shirt out for alternation. The alterations were entirely arranged by ARI, were done improperly, and ruined the shirt to the point where it is no longer wearable. Thus ARI has the entire responsibility for the improper alteration and destruction of the shirt. It is also the [redacted]’s choice to set the price he charges the customer for alterations, and the price in no way changes the store’s responsibility for improperly conducting their alterations.  The [redacted]’s response to my Revdex.com dispute claim clearly attempts to discredit my complaint about the fit of a shirt by implying that I was ill-tempered when in the store. I would like to point out that when I arrived in the store, everyone was speaking in a calm and quiet voice. The conversation volume was escalated to that of an argument by BOTH the [redacted] and myself.  However during the conversation, the [redacted] mocked me claiming I was “absurd” and that I looked “ridiculous” when I demonstrated the shirt didn’t fit by raising my arms. I at no point insulted the salesperson or [redacted] in return. I feel the [redacted] was the person who was rude, and I was shocked at how unprofessionally he conducted business. This however has nothing to do with point of this complaint: the store charged me for a shirt, improperly altered it to the point of being unwearable, and refused to issue any sort of credit or exchange for the damages they inflicted.

[redacted] purchased the shirt and jeans on sale for a total of $345 instead of $590. On top of that we gave [redacted] free alteration at a cost of $75. While measuring him for the alterations we take measurements while your arms are by your side and not raised, such measurements do not exist. it...

is just not possible to have a shirt fit good while standing normally with your arms by your side and while they are raised, you can only choose one or the other, it is normal for a shirt to move back a bit while raising your arms. [redacted] kept on raising his arms above his head to prove his point while arguing his case with a loud voice, we just don't conduct our business like that. We are here for 15 years, sold thousands of shirts and this is our first complaint with the bureau, it speaks for itself. Further more these items are final sale and not eligible for return or exchange.

Review: I purchased a pair of jeans and a shirt from this store (total of approximately $400). Both shirt and pants required altering to fit properly. The pant legs needed to be shortened. The shirt sleeves needed to be shortened. The sales person ([redacted]) took the measurements and sent them out for alteration. I had to pay for the clothing in full prior to alternation, which I did so.

I returned to pick them up a few days later. I brought them home, and tried them on and found that the alterations had been done incorrectly. Both the shirt sleeves were too short and the pant legs were too short. The shirt sleeves were literally unwearable. When my arms were down by my sides, the cuffs of the shirt came to my wrist and looked fine. However, normally shirt sleeves have a little extra length to allow for motion. Indeed, the shirt sleeves were hemmed so short, that I could not raise my arms above waist level. The cuff would slide down my arm, to the point where it could no longer slide, and my arm was stuck from moving any further. If I unbuttoned a cuff, the shirt sleeves would rise up to literally the middle of my forearm. They were obviously short. The jeans were also too short.

I returned the next day to show the clothes to the sales person, [redacted], who had helped me purchase them and who took the measurements for shortening. I showed him the problem, and he told me that they looked fine to him. When I showed him that I couldn’t raise my arms, he asked me why I kept raising my arms. He kept asking, "who raises their arms?” When he asked, “why would you want to raise my arms?" I offered the example of hailing a taxi. He told me that I looked “funny” with my arms raised, and again claimed it was an unnecessary motion. He told me they looked fine when my arms were at my side, and that should be sufficient. I was shocked with the absurdity of his claim, as I feel that raising my arms is a natural occurrence within my day - actually quite necessary. I’ve also purchased many shirts in my lifetime, some from ARI, and I can raise my arms in all of them. He told me he wouldn’t return or exchange the shirt because the length was fine, and that I would have to speak with the [redacted], [redacted].

I returned a little later when the [redacted] was in. He also told me that the length was fine. He also asked me why I would want to raise my arms. When I offered the same example of hailing a taxi, he also told me I looked strange with my arms raised, and told me no one hails cabs with their arms these days - he proceeded to demonstrate how I could hail a taxi with my arms below my waist: using a smartphone app. I told him that I had previously purchased 5 shirts from the store, all of which had been altered, all of which allows a full range of arm motion, and all of which I would be happy to bring in as an example of a properly tailed shirt. I also mentioned that I’ve been wearing shirts my whole life, and I’ve never had one that fit so poorly.

The [redacted] told me I was being both ridiculous and unreasonable and insisted that the shirt was fine. The conversation escalated to shouting on both sides. He told me that he would not make a return or exchange for the shirt, that I shouldn’t expect to raise my arms while wearing the shirt, that I don’t need to raise my arms in general, that he has been in the business for a long time, that I have no expertise to tell him the shirt was altered incorrectly, and that my complaint was absurd. He told me he had 4 children, only had a little bit of time to spend in the store, and had no intention of wasting an more of his time to listen further with my complaint.

He cut off the conversation, and I really had no further course of action. It turned out that it’s quite difficult to formulate an effective line of reasoning for a complaint when the other party involved refuses to acknowledge that a proper fitting shirt should allow for arms to raise above the waist. We didn’t even get to the jeans - I was able to walk in them, so how could I complain?

I purchased $400 in clothing, they were ruined during alteration (ordered by the store, not myself) to the point where I can no longer wear them, and the [redacted] of the store refused to remedy the situation. I also have no means to make an argument with the [redacted] of the store. He adamantly claims that I don't need to raise my arms above waist level in a given day - how can I make a logical argument necessitating a return with a person who makes such an absurd claim?Desired Settlement: I seek either a refund or an exchange for the clothing. I would be happy to exchange for an equivalent shirt and pair of pants that are unaltered (I can arrange to have a new shirt and pants shortened on my own).
