Ms*** ***, bought a Ford Taurus from us on 08/24/ We sold this vehicle In good faith and in compliance with New Mexico Statue 57-16A-Used motor vehicles. Section 55-2-NMSA 1978.Implied warranty of merchantability before the earlier of days or
miles after the vehicle’s delivery. E. If the implied warranty of merchantability described in this section is breached, the consumer shall give reasonable notice to the seller within thirty days of the date of the breachBefore the consumer exercises another remedy pursuant to Chapter 55, Article NMSA 1978, the seller shall have a reasonable opportunity to repair the used motor vehicleThe consumer shall pay one-half of the cost of the first two repairs necessary to bring the used motor vehicle into compliance with the warrantyThe payments by the consumer are limited to a maximum payment of twenty-five dollars ($25.00) for each repair.We received a phone call a few days after the purchase date, from Ms***, her boyfriend and mother in law, complaining about the window not rolling down and the cluster light not working We informed them to bring the vehicle for repairs The vehicle was inspected and the cluster was repaired, the window was tested and was working fine no repairs were necessary( We have receipts from an authorized and licensed mechanic attesting to this claim) The vehicle was return the same day to the customerShe was very happy and satisfied and we never heard back from her againThat is until this Revdex.com complaint New Mexico Law Section 57-16A-paragraph B- D.D. An implied warranty of merchantability does not extend to damage that occurs after the sale of the used motor vehicle that results from:a nonconformity is the result of abuse, neglect or unauthorized modifications or alterations of the motor vehicle;In this section it clearly states that if the vehicle repairs fall withing the limited warranty statue and if the dealer is informed within this time frame, it must first be authorized with no alterations of the motor vehicle Ms*** made no additional claims with Arian Auto Sales that fits the time frame of the limited warranty with the exception of what has been mention in this letter If Ms*** had open a case with Arian Auto Sales withing the limited warranty time frame, any repairs if needed that are in compliance with state law would had been approve and authorized to be repaired by a licensed and approved mechanic In this case Arian Auto Sales was never informed, by Ms ***,of any additional claims with the exception of the first claim she made that was taken care of From that point on we never heard back from Ms*** until she filed a claim with the Revdex.com days from the date of purchased.We disclosed all the information of this vehicle to the best of our knowledge and it was sold to her in good faith. Ms*** signed documents and was given a copy of her rights as consumer and was explained the Limited warranty of New Mexico; Statue 57-16A-Used motor vehicles. Section 55-2-NMSA 1978.We been in business for many years and this is the first time a complaint has been filed against us We are always try to accommodate our customers and we have our record to attest to this.
