December 28, 2016Dear *** ***,Please be advised that this firm represents ARK by KormanWe were asked to respond to a complaint filed with your agency by a tenant who is complaining that he has to walk through puddles when it rains; that his requests for maintenance are ignored, that he was
forced out of the apartment without reimbursement when his bathroom was repaired and remodeled; that upon renewing his lease his carpet was not shampooed and his chandelier was not replaced as promised and that his rent was raised.This tenant moved into apartment *** on July 19, pursuant to a one year leaseAt the time the tenant moved in, he completed a mochecklist and noted, “AC runs very loud only in bedroom'A maintenance technician was sent to the apartment and found that the central air conditioning unit was operating normallyIn an effort to ease the tenants concerns about the sound of the unit, the technician cleaned the condenser coils and added additional insulation to the closet walls where the unit was located to reduce the sound of the blower when the unit was runningThat work was completed on August 6, Since that time, the tenant has not made any additional complaints about maintenance issues with the HVAC system and the Management Staff has no records of any calls from this tenantUpon receipt of this complaint from the Revdex.com, the Regional Director sent the tenant an email advising him that this is the first time she was made aware of any maintenance issues and asking to schedule a time for a maintenance technician to enter the apartment and inspect the HVAC unitAs of the date of this letter, the tenant has not responded to that email to schedule an inspection.This tenant never complained that puddles of water form on the sidewalks when it rains to Management Staff prior to submitting a complaint to the Revdex.com and Management Staff have never received a similar complaint from any other tenantsIn response to this complaint, the Property Manager will have a contractor inspect the sidewalks to see if there are ponding and pooling problems beyond the ordinary when it rainsIf there are, the sidewalks will be repaired.This tenant made a complaint about his bathroom tubManagement Staff sent a technician to investigateThe repair required that the tub be replaced entirelyAt that time, Management Staff decided to complete a bathroom remodelIn addition to replacing the bathroom tub, the tile walls, the bathroom floor, the vanity and the sink were also entirely replacedWhile this remodel was being completed, the tenant was provided with another, separate, private bathroom to use until those repairs were completedThe tenant never complained about the remodel or having to temporarily use another bathroomUntil this complaint, the tenant never requested a reduction in his rent. Prior to the expiration of the initial one year term of the lease, Management Staff sent a lease renewal letter to the tenantThat letter advised the new monthly rental rate and that a new, brushed nickel dining room chandelier would be installed and that he could have a complimentary carpet cleaning for the entire apartment upon receipt of his signed renewal formThe tenant never provided Management Staff with the signed renewal form or called to schedule the installation of the chandelier or called to schedule the carpet cleaningThe complaint filed with the Revdex.com was the first time that Management Staff heard from this tenant on the issueUpon receipt of the Revdex.com complaint, the Regional Director sent an email to the tenant advising that when he provides the signed lease renewal, Management Staff will schedule installation of the chandelier and the carpet cleaningAs of the date of this letter, the tenant has not responded to that email or provided the signed lease renewal.Management Staff has not had any complaints from this tenant's neighbors about missing shingles or flooding when it rainsManagement staff is not aware of any missing shingles or flooding, and, if that were the case, those issues would be repaired immediately, In addition, no other tenants have complained that their clothing was ruined because of puddled rain water on the sidewalkFinally this tenant has recently been late with a rental payment and the Management Staff waived the $late feeConsequently, Management will not be refunding any money to this tenant or to his neighbors.Very, truly yours,
