Refund was not fully refunded as business held back 1.8% of deposit for credit card charge. We made a deposit for the work to be completed when the business had time so no date was set and we were told it would be done when they had time between other jobs and we were local so it could be done by this summer but again, no specific date. The deposit was made of $2800 which *** had stated by the business and was written in the quote that a deposit of half was to be paid for secure the quote. We paid by credit card and was not given any specifics of any refund policy. After about 3 weeks of waiting and trying out several samples then deciding we did not want to go with the product, we informed the person we had been dealing *** with that we did not want to have it done and wanted our money back. He said they never had to make a refund and if we wanted one, it was going to be not a full refund as he had to pay the credit card company a charge. He was going to charge us $140 if we wanted to get a credit on our credit card which we could not believe so we suggested giving a cheque back to us and he said he could but still had to charge $50 to cover his cost. My wife told him on the phone that this was not disclosed to us at all and there was not even a date set for our job to be completed. We did not know of any policy concerning this and was not written anywhere in his quote to us and was never spoke about in our phone and business visits with him. *** said he would be writing in the refund policy from now on in his quotes, however we should not have to be penalized as nothing was stated as such for us.
Initial Business Response
They called us last year for a quote for their job which we made a home visit to measure and discuss options/colour schemes and then provided them a quote valid for 30 days for their two decks and front walkway, they did not commit at that time. They called us again this year asking for the job to be done, in the spirit of customer care we permitted the year old estimate to remain in place for them despite it being clearly marked good for thirty days, we then put their deposit through on credit card machine. We made another home visit and provided more samples for them to consider and they chose another blend that was slightly higher in cost and when we presented the new blend it was accepted by the husband at an additional $1000 and that he would run it by his wife. He also informed us that the extra $1000 was within their total budget for this project and we were pleased to come in within their budget while providing them an even better colour scheme than what was presented the previous year. When his wife returned home that day she called us and said that she wanted to cancel the entire job. She showed up at our office for this refund but neither myself or *** our salesman was here to approve this cancellation. We discussed this matter amongst ourselves and we agreed that we would release them from their agreement and again in the spirit of customer care not charge them the full 20 percent restocking fee for the cancellation and only charged them $50 for the initial credit card fees for deposit towards the contract (our hard costs charged to us by the credit card company for the initial deposit processing and then the refund process). We have costs that must be acknowledged and we did not cause these costs we acted exactly as instructed by the client each time, spent time on several home visits with them trying to meet their needs. We feel that we have behaved quite reasonably and fairly in this matter.
