I spoke directly with the consumer on September and again on September 19, When the contract for work at the consumers' home was negotiated on July 29, it was agreed that we would provide and install replacement windows at $each (which comes to a total of $3850.00.) At that time additional LABOR was discussed but was not agreed to or paid for The ADDITIONAL LABOR charges were itemized on the proposal for later reference IF the homeowner decided to have the door work done.The windows were installed on or around August 18, and my company was paid $shortly thereafter The homeowner did not contract for the additional labor nor was it paid for during or after the completion of the installation We made a follcall to her after the contract was completed and paid for to see if she wanted the additional work done at which time she expressed that she was not financially able to have the work done at that time and would call us at some future date if and when she was prepared to have the work done I am attaching a copy of the letter that we sent to her in response to her demand in to complete the contract as she interpreted itIn consideration of her medical situation in (as stated in her letter to you) we did not require any deposit or up-front payment before the windows were installedNormally, we ask for a payment of 1/to 1/of the contract price at the time to contract is signed.While it is regretful that the customer has a health issue and now, two years later, has the opinion that additional services were pre-paid for, we cannot provide the requested services at the extreme discount being requestedWe did offer to provide the additional services to the homeowner at the price that was quoted in as a compromise to her complaint which was not accepted We also offered the services at $which was not accepted.Regards, [redacted] The Window Men, Inc

I have reviewed the response offer made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below As a consumer all I can go by are the estimates/quotes and bills provided to me by The Window Men My paperwork all indicates that the contracted price of $included installation of windows and labor for installing and wrapping several doors in my homeEach item is clearly denoted, but only the door labor is itemized with prices, on my copy of the estimate/quote When the windows were complete I was presented with a bill/receipt containing line items for both window installation and door labor If the door labor was "extra work to be contracted later" then why was it itemized on my final bill? If the contract was for windows at $350, as Mr [redacted] claims, why did I not receive an estimate that clearly indicated the cost per window? In fact, I had no documentation at all of the per window price until I disputed this in September When I first spoke with The Window Men in September the only "proof" of "contracted" window price was a hand written note scribbled on Google Maps directions to my home stating the cost was $per window.I firmly believe that The Window Men are trying to break a contract that clearly states labor was pre-paid and never performed They cannot produce signed estimates without the door labor included in the final cost Nor can they produce any documentation that says I agreed to pay $per window They also clearly itemized the door labor on my final bill which was promptly paid.The supporting documents provided in this case by The Window Men are all notated after the fact with details I did not recieve at the time of contract When originally approched with the discrepancy, the only "proof" Mr [redacted] had of the cost of the windows was a hand written note on Google Maps directions to my home In any contract work the controlling document is the estimate/quote In this case, my estimate/quote clearly itemizes windows and additional door labor at a cost of $ I paid $promptly with a cashier's checkI do not expect A+ rated businesses to dispute clear estimates and matching bills Regards, [redacted] ***

No resolution was ever offered.  I have an itemized  estimate for work and a matching bill for the same work that was promptly paid in full.  The business owner obviously refuses to honor his own contract.  I have no choice but to file legal suit.
