I talked to Mr [redacted] a few times on the phone and offered to replace the mattress he purchased through the warranty processThe only exception will be that the mattress must not have any stains, and standard delivery fees do applyWe have included a copy of our store policy, which clearly states, "There is absolutely NO RETURNS on bedding including mattresses..."

Per our posted store policy, "...there is absolutely No Returns on bedding including linens." Additionally, in the "Warranty" section of said store policy it is stated, -The manufacturer, not by Mattress Showcase, upholds all warranties." We offered to
assist Mr***, and gave him *** & ***s numberThere is nothing more we can do to help Mr*** with his warranty process

I thank you for wanting to be a go between in finding a solution to my complaint. I read the response given by Mr. Dale Schroeder ( Dale ) to my complaint. Dale states to have spoken with me two times and that a store policy supports his position. It is correct, Dale and I spoke on the phone two times and both times he hung up on me. I spoke with Dale the first time when I realize it was clearly evident that the mattress I had purchased just few weeks earlier was caving in on one side. Dale reply was I had two choices, one to go to the store and select a more expensive mattress and pay the difference or accept an exchange for one of the same. Dale added that if I was to select another of the same, he and I will have the same conversation few months down the road. To this I replied that I being on disability live on a budget that does not allow me to ray more than the 525.00 dollars I have paid him, so selecting another more expensive mattress is not an option. To the second option I replied that I was much distressed to have to have the very conversation we were having, much less having to have the same issue at hand few months down the road was certainly something I was not going to have, therefore I told him that the mattress is going to get worse everyday and that I wanted him to come, get the mattress out of my house and return my 525.00 dollars I paid him in cash. I also suggested that I was willing to take the mattress to him, his reply was that If I brought the mattress to the store, he was going to dump it to the trash bin.  Dale hung up on me.
I called the Attorney General office to discuss this kind of practice/behavior and while they did offer support, they suggested that I would try one more time before taking actions. Under advice, I called Dale and left message. The following day, Dale calls me and tells me that he had spoken with [redacted] representative and was given permission to exchange the mattress for one of the same, to which I replied why would I want to do that if you, Dale told me that if the mattress was exchanged for one of the same, he and I would have had this very conversation few months down the road. I explained to him that I had spoken with The Attorney General Office because I want him to come and get the sinking mattress and return my purchase price in the amount 525.00 dollars. His reply was you really want to stick that mattress into my throat............. and other words...... Dale hung up on me for the second time. In regard to the store policy, Dale is now hiding behind, a store policy is as good as its disclosure. If you do not disclose and if you do not provide a copy to each customer, the policy is non existing. In my case, Dale and I never did discuss store policy, nor was I ever given a copy of such a store policy. I must add, that if Dale had disclosed to me that " There is absolutely NO RETURNS on bedding including mattresses..." I would have run as fast as I could run considering my being disable. I am to undergo surgery on this [redacted] and trust that Dale will have time to schedule a time to pick up this mattress and return my money upon my return (few weeks). Should this not happening, I here, give notice that I WILL TAKE LEGAL ACTION upon my return.
