Arnold's repossessed their vehicle prior to the contractually agreed upon time period.In the summer of 2015, I purchased a 1999 Jeep Cherokee from Arnold's Automotive. My monthly payment is $250 payable on the 3rd of each month. In November, my family was involved in an automobile accident involving our [redacted]. The accident was being handled very slowly by the other driver's insurance company. My wife and I were unsure whether [redacted] was going to repair our vehicle or we were going to have to have our insurance fix it. If our insurance completed the repairs, we would need the $500 deductible. We were holding onto Arnold's December payment because we knew that the decision from [redacted] was coming any day and we may, or may not, need the Jeep payment to help with the van repairs. We received a phone call from [redacted] on December 17th at 5:34 pm. On December 18th at 3 pm, Arnold's had my Jeep towed away from the school where I teach, leaving 2 of my children and I stranded there. I immediately called Arnold's and explained the situation and made December's payment. The final resolution was that Arnold's had the towing company drop my Jeep off in a fast food restaurant parking lot in Maysville, NC, 35 minutes from my home. I was then charged $175 for the service of picking up my vehicle and dropping it off far from my current location. I then had to deal with the humiliation of explaining to my boss and colleagues that the Jeep had been towed away for being two weeks late with the payment. I called Mr.[redacted] Arnold, the proprietor, and we discussed the fact that per our contract, I had 15 days to make contact or payment. My payment is due by close of business on the 3rd so I have until close of business on the 18th to make contact or payment. Arnold's was open on Friday, December 18th, until 6 pm but my vehicle was towed by 3 pm. Therefore he breached the contract by making the decision and the call to have my vehicle towed in prior to the agreed upon 15 day window. The $175 service fee should never have been an issue because the vehicle should never have been towed. This was $175 that I could not use towards my children's Christmas because I had to waste it on an unnecessary service charge. Desired SettlementI would like a refund of the $175 and an apology from Mr. Arnold for embarrassing me at my place of employment.
