[redacted] requested Invisalign treatment (clear removable orthodontic appliances) in my office and the workup was performed on (photos, impressions, consult, and explanation and demonstration of treatment details)My office manager demonstrates and explains to everyone how much dedication and patience the treatment requires as it is to be worn at all times except when eating and brushing and takes quite a bit of getting used to, so patients will understand it is a commitment.We presented the Clincheck (computer vides and explanation of the individual's treatment from start to finish) on She accepted the treatment and came to my office on for delivery of the removable aligners and placement of the attachments on some teeth to control the movementShe called after a few days and said her tongue was discoloredShe sent me a photo and I assured her it was not a problem, that it was something called "brown hairy tongue" and would shortly disappearShe called soon after and stated she cannot tolerate the Invisalign and wants to cease treatment and remove all attachmentsShe came to the office an and my hygienist and myself did full exams and saw absolutely no damage to any teethI did not hear anything again until when she called the office requesting all her money back, stating we damaged her teeth, etcI asked her to return to show me the damage, or at least send me a report from the dentist she said agreed, but she never didWe subsequently corresponded multiple times via email and neither side was budging in their positionsSince we were getting absolutely nowhere , in good faith and in an effort to puta this whole thing to rest, I sent her a release to sign offering a substantial refundShe refused to signetThe offer is still on the table

[Your Answer Here] Before starting Invisalign orthodontic treatment I asked about all the possible risks of such treatment and neither Dr Cochin nor his office manager informed me about themExplanation of how much dedication and patience the treatment takes is not the explanation of the risksInvisalign has an informed consent form which describes all the risks and it is supposed to be given to every patient by the doctor prior to starting the treatmentDr Cochin did not give me the form and did not inform me about the risksI would have never started this treatment if I was fully informed about the risksI called the office after a few days because of all the complications that I developed due to Invisalign: my gums were very swollen and inflamed, my speech was impaired, I developed a TMJ problemDr Cochin told me to get used to itHe never informed me about the possibility of these problems among many others prior to starting the treatmentI did not make a mistake, it is a doctor’s responsibility to fully inform his patients about all the risks prior to starting the treatment and Dr Cochin did not do itI am not coming back to Dr Cochin for any future dentistry and asking for the full refundI paid the entire amount for the treatment which was supposed to be months but was stopped after daysI came to the office on 04/**/because I was still having issues caused by Invisalign treatmentDamage to teeth where Dr Cochin removed Invisalign attachments is evident but he and his office staff denies itI am asking for the full refund and will give Dr Cochin a receipt for itThe release form is completely irrelevant

I remain firm in my contention that there was no lasting damageI find it totally unlikely that any untoward affects would not shortly disappear after wearing these removable aligners for only a maximum of daysI have removed hundreds of these attachments from the teeth and never seen or heard anyone mention that the teeth were damaged, and this case was no exceptionWhy did she not call to tell us they were damaged, or baring them to our attention when she returned for her hygiene appointment, where both times I carefully examined the teeth and saw no damageAs stated in my prior response, we have already corresponded back and forth like this and good faith I have sent a release form and offered a refund in order to put this behind us once and for allShe is refusing to sign, calling it "irrelevant"

She accepted the treatment and came to my office on 3/**/17 for delivery of the removable aligners and placement of the attachments on some teeth to control the movement. She called after a few days and said her tongue was discolored. She sent me a photo and I assured her it was not a problem, that it was something called "brown hairy tongue" and would shortly disappear. She called soon after and stated she cannot tolerate the Invisalign and wants to cease treatment and remove all attachments. She came to the office an 4/*/17 having worn the appliances for less than a week, and maintained her insistence that she wants to stop the treatment. I pleaded with her to try to get used to tem as it is common to have these accommodation issues, but she insisted that she would not. She said she is an interpreter and cannot speak well with them and could not be convinced otherwise. I removed the attachments under magnification, (the same way I have removed hundred of them at the completion of treatment) and was certain there was no damage to any of her teeth. I explained that I must pay Invisalign fully up front and she stated that she knew she made a mistake and did not want a refund. I however insisted on he taking a $1500 refund on the spot and told her I would give her a substantial amount of future dentistry to make up for some costs defrayed. She returned for a hygiene appointment on4/**/17 and my hygienist and myself did full exams and saw absolutely no damage to any teeth. I did not hear anything again until 6/**/17 when she called the office requesting all her money back, stating we damaged her teeth, etc. I asked her to return to show me the damage, or at least send me a report from the dentist she said agreed, but she never did. We subsequently corresponded multiple times via email and neither side was budging in their positions. Since we were getting absolutely  nowhere , in good faith and in an effort to puta this whole thing to rest, I sent her a release to sign offering a substantial refund. She refused to signet. The offer is still on the table.
