I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.Note, I exhibited my consideration when I canceled ***'s 2/23/overnite shift (9pm-8am) on 2/20/(via my 5:20pm email), far ahead of the hours' notice that *** *** had mentioned."Ms ***..should be FULLY AWARE that we DO NOT ever negotiate the wages..." "As a kindness..we only charged $2/hr." I am literate and have been "AWARE" that ATC does "NOT" negotiate aides' wages; refer to my 2/9/email to *** *** after having read the contract in which I asked a question regarding the contract's verbiage. During this third "occasion" *** *** offered to talk with *** and stated she would get back to me as to an aide ie an HHA who may have been less costly than a CNA, as a basic aide was all that we needed. According to the contract, which I did not sign as opposed to ***'s claim, ATC's fee absolutely should have been $2/hras this third "occasion" with *** was "routine, non-exigent." ***'s first overnite shift was to start at 9pm on 2/9/15; I committed to *** during a telephone conversation with *** at about 11:45am on 2/7/15, clearly neither "exigent" nor applicable to the $3/hrfee which applies to "less than hours advance notice."Regardless of me taking time to write this, the second statement from RTC is once again entirely irrelevant to my complaint. I reiterate that at no time did I sign the contract or provide any signed document whatsover to ATC

The client signed a contract which was drawn up by a lawyer that clearly states that we do not negotiate aide and nurse rates. We cannot force someone to accept a lower rate as clearly spelled out in the contract. We were able to set up care on 3 separate occasions for the client last minute which...

were cancelled twice with less then 24hrs notice by Ms [redacted]. On the 3rd occasion we were able to set up care and Ms [redacted] is now asking for a decreased rate after it was clearly set by the sub contractor. As we are a referral company it is out of our scope of practice. We are sorry she was dissatisfied but this was clearly stated in the initial contract. We are glad for the opportunity to provide subcontractors to care for her loved one and saddened that the logistics of her role as a manager to her subcontractors was unable to be negotiated.
