Jennifer, was very new to our company and didn't go the extra mile to contact Emory on your behalf so you could schedule an appointment to view the unit you were interested in. Since that happened Jennifer understands better how to handle these situations so a customer doesn't get frustrated and put off from seeing one of our properties. I understand your frustration and apologize that you had a frustrating experience with our company.

Complaint: [redacted]I am rejecting this response because: The home owners mail is registered at this address and all her mail comes to this address.  The other statement I reject is that the owner signed a release to speak to us the renters.  If this had nothing to do with us then in the court paper work BOTH my husband and I's name's were on the court paperwork.  We were also asked to come down and sign a paper stating we will be responsible for this debt.  We have paid well over the amount of 6,600.00 that was the court order that was to be paid on June 1st 2016.  But we were served the paper work on 5/31/16 at 7:15pm. To date we have paid 7,500.00 and the HOA's attorney has requested twice to settle.  So for around the clock to say that they weren't able to speak to us is an incorrect statement along with the court paperwork that was served to this address.  This again was addressed to my husband and I and we had to sign for the paperwork.  We have again requested photos of the parking violations along with any communication/letters that had been sent etc.  Around the clock and the HOA have not responded- and shown any proof.Sincerely,[redacted]

On my balance sheet clearly show that I paid in full my balance then in the lawyer sheet is a new charges that I do not agree with. Why I need to pay more legal fee when I have a legal notarized contact that I will pay a certainly amount, I did pay in full then [redacted] firm is charging new legal fees, why? My account balance is positive , done with this agreement. Requesting Around The Clock charge my HOA dues like any other resident of [redacted] in Maple Valley, WA . I am requesting than HOA to be responsible for Law firm to have responses for me because is Around the Clock who is allow to have this charges to me.

This is a Homeowners Association matter that involves the Board of Directors for the community association and the property owner who is responsible to comply and cooperate with the Rules and Regulations. If an owner rents his/her property he/she is still the one liable to the homeowners association for all assessment charges and any activity on the property. Your landlord should have been the one responding and communication with the board of directors. The owner should not have put the burden on you to respond and try to resolve the issues. What goes on at a property is between the board of directors and the property owner. All information relating to billing, outstanding debts, and compliance issues is confidential. We do not have the authority to release information to anyone other than the owner. All assessment, late fees, and responsibility for payment is the responsibility of the owner. It is never a tenant's responsibility. The tenant has no legal obligation to arrange for assessment payments or be involved in a collection matter. If the matter is to be resolved, it has to be done by the legal owner. Your request for photos, communication/letters is not something we are able to provide. Again, the owner needs to work with the board of directors to resolve the issues. If the owner wants any charges waived, he/she must request it in writing and send it to the Association board of directors. These issues cannot be resolved with a tenant. Hopefully, the owner has communicated with the board of directors by now and has worked through the issues.

The Association Manager who manages the communi8ty association where the customer who filed the complaint was on vacation until September 11th. I have had the opportunity to discuss the homeowner's complaint and develop a response...

but now it seems my time is up to respond.
 
If I may, I would still like to provide a response.
 
As the management company hired by the Homeowner's Association to provide accounting services, we posted the charges we received from the lawyer who was hired by the Association to collect past due assessments. When the homeowner called James at Around The Clock, Inc. to ask about the charges she was referred to the attorney at [redacted] so they could explain them. The attorney did speak with [redacted] and sent documentation to help explain the charges that were still due. The charges were valid. The Association has to pay all of the legal fess and homeowners are required by their governing documents to reimburse the Association for legal cost for collecting past due assessments. It is NOT Around The Clock, Inc. who charged the owner, it was the Association.  Around The Clock, Inc. does not have the authority to remove Association charges. The homeowner needs to speak with the Association's Board of Directors to ask if the charges can be removed.

The issues [redacted] is disputing relates to fines and a collection matter that are between the owner of the house and the homeowners association where the property is located. [redacted] is not the owner. She is a renter. A renter is responsible to their landlord who owns...

the property. The owner is the person who is legally obligated by the Association's CC&Rs and is the responsible party for all assessments and enforcement issues. We are the management company for the Association. We are not the ones who accessed fines and started legal action to collect unpaid assessments. If there are unresolved issues, the owner of the property needs to meet with the board of directors and the attorney to request information, not the renter. The Association does not arrange payment plans with anyone other than the property owner and does not provide documentation to some one who is not the owner. If there is a question about a violation notice or fine, the renter may ask his/her landlord to request information from the Association. A renter has no legal authority to request information or ask for fees and charges to be removed, or to be reimbursed. A renter is never billed for assessment or legally liable for them. This matter is between the Association and the property owner.
