I am being billed for services which were not only improperly performed but also caused damage to my property (pool liner, cover) in the process.

I have been using this pool company to maintain my above ground pool this summer at a home I purchased in May and was renovating but not living in yet. In October I asked them to winterize and cover the pool. I provided the cover and brackets to attach the cover to the deck as it had been the prior year by previous owners. When I checked on the pool a few days after they covered it, they had just tucked the pool cover up under the ledge of the pool and had a thin wire wrapped around it running through the eyelets in the cover. To me and my boyfriend it did not look like it would hold very well for winter but I did not say anything at first because they are the pool "professionals", not me. About a week later there had been some rain so we went over to the house to check on things and see if there was standing water on the cover. The previous owners had left a small pump to remove excess water from the cover etc. There was some standing water on the cover so we did pump some off. It appeared as if the water level was well below the skimmer and I messaged the pool company about this. We noticed that the cover had come off the edge of the pool in places where the wire was not holding from the weight of the rainwater and it appeared that the water level in the pool was lower than it was at the time the pool was covered. This was hard to tell since it was still mostly covered but it was down a good foot or two past the skimmer and had been well above it when they covered it. The pool representative assured me that the cover was properly installed and that the pool level was correct and we must have "pumped the water out of the pool". This is a long oval 4ft pool probably 18-20ft long. I assure you we could not have pumped that much water out with that tiny pump. The water level continued dropping and the cover started to tear as it caved around the entire pool. The representative and I communicated again and there was some disagreement on whether or not the pool had been covered properly and why the pool was now leaking when it had not been before they covered it. She finally offered to have them come back out and re-cover it. I told her not to bother if they were going to do it in the same manner because I knew it would not hold. At this point, my pool which had no leaks on the day they came to cover it now has a leak somewhere which I suspect happened when the steps were moved in the process of covering the pool, the water level which I paid the city of Longview to fill the pool is now practically ankle level, and with that all of the chemicals that were added to winterize the pool are now gone and wasted. My pool is no longer covered adequately, it has caved in around every side and with that all of the chemicals that were added to winterize the pool are now gone and wasted. It will cost me a significant amount to repair the leak and refill the pool plus the chemicals to get it back in condition when spring arrives. I do not feel I owe any balance due for October services as not only did I not get those services done properly I now have a damaged liner and an empty pool.

With all that said, they are still trying to bill me for winterizing the pool and covering it and I don't think I owe them a dime for those services since not only is my pool not winterized (there is no water left to be winterized), it is also not covered and all of the winter weather and rain will now be filling my empty pool resulting in no telling what kind of further damage. I pay my bills on time every month. I have always paid them the day I receive their invoice but I do not feel responsible for these charges.

Desired Outcome

At minimum, a zero balance due on the last invoice sent for these services.

Liner from the beginning of the service was leaking which we repaired on July 30th the leak in liner that was patched was located by stairs. Our technicians cover pool on 10/15/2019 we later received a message on 11/11/2019 from ms *** " I tried to pump the rain water from the top of my pool cover and it just kept getting lower and lower. She attached pictures as well and cover up was done correctly from pictures. We responded water level was left like it was at time of cover. And you shouldn't have any problems taking rest of rain water off cover if you do give us a call or if you need a technician. She responded ok thank you. Then she stated water level had we down we stated if it went down that much then it could possible mean she has a leak in the pool. On November 13th she contacted us again with new pictures of cover falling in. We sent technicians out to see what happened and they stated either when she touched the pool pumping the water out to much water was pump out or she has a major leak as she had back in July. We stated for a leak repair if she has a leak cold water dives are $600 which we do not do she would have to contact someone else. We cover pool in October no issues with the cover up came up till she message us pictures of her taking water off cover. Attached are picture that was sent to us on the 11th of November of the start of her draining rain water of the pool cover and last picture on 13th of November of after pool was drained half way or has a major leak. We have contacted her for her past due account for the cover up that was done correctly on 10/15/2019

As well a week later from cover up as she states in her statement would have been on 10/22/2019 as Pool was covered on 10/15/2019 and she did not contact us till 11/11/2019 of concerns after she begin to drain rain water of pool cover.

The company states that the pictures I sent on November 11th shows the pool cover was done correctly. This is inaccurate. You can see in the pictures gaps of the pool cover that are sticking out from the wire which can allow wind and rain to get underneath. Again, I had provided them with the brackets and screws I wanted to be used to secure the cover to my deck as had been done previously. If you look at the second picture with the pool pump in it, you can zoom in and see the water level Is clearly well below the skimmer by a couple of feet. Prior to cover, the technicians came on a weekly basis to maintain the pool. If there had been another leak prior to the pool cover, they would not have added the chemicals to winterize it and would have contacted me to repair the leak and add more water before continuing like they had done in the past. The fact that they went forward with winterizing it then covering it confirms that the water level was full when they covered it and them moving the stairs tore the liner. How could I possibly cause a leak in my pool after they had covered it? And the pool representative was aware months prior in previous conversations that I do not live in the home so the fact that I did not contact her about it immediately is not out of the ordinary. It is a home I am remodeling and am not there every week.

Each day with a pool that has leaked previously can be different which she had previous leaking issues with pool as pool liner is one of the our dated style liners. And if the pool started leaking from area that was previously patched which is possible once you start pathing a pool the patch could hold or it could not hold. Our technicians that went out to inspect the pool firmly believe pool water was pump out by customer when she began to take water off pool cover. If you look at the first 2 pictures you can see that there is a big difference between the first 2 and the last picture that was sent by customer later once water was took of cover

The pump was only on for an hour or so and was turned off on November 11th and never turned back on. That is a $15 water pump at best. There is no possible way we pumped the water from the pool with that tiny pump. I will send a picture later today once I go to the house to take one. If the pool was covered adequately from the start, even with a leak, we would not be having this conversation because the cover would have been tight across the top and not sagging into the pool and collapsing.

Pool was covered properly from the first picture that was took once pool was drained that is why cover began to sag into the pool. As well if pool is collapsing the reason behind that is pool does not have enough water that is the reason why you can not drain a above ground pool you can ruin liner or pool. Once again from the first picture that was sent there was nothing wrong with the covering of the pool once water was drained from pool cover.
