As for your deposit, it is a non-refundable depositI spent countless hours rebidding your house, visits to your property, meeting with sub contractors onsite, etc.Its really unfortunate that you’re the one who pulled the plug after I hooked you up with financing (because of your poor credit), and got you to the point of days prior to closing on your construction loan, that you decided to pull the plugI found out that I’m not the only one who he has done this toHe did have a contract with UBuildIt in Austin, and he did the same thing to. It’s hard to have a complaint from someone like this gentleman who tells you that he’s going to do all kinds of work on his house, makes you rebid the project, visit with him, and his wife, and makes promises that he’ll get better deals than the builderI would caution any builder that would build a house for this guy (*** ***).We are a great custom home builder! It’s unfortunate that no matter what information I give to you, or who I speak with at these companies, you will still reject what they have to sayYou can have your plans engineered, or not, and still get a structural warranty excluding your slab because it’s over years oldPlain and simpleIt doesn’t matter what you do to the slab, no one will warranty it because it’s over years oldHowever, you can get a warranty on the structure (like I said previously). I am rejecting this response because: The FHA requires a year warranty on the structure. If you can provide this I would consider the matter settled and we could move forward with the house; I have spoken or contacted every company that you have provided to me . Unfortunately, none of the companies you have provided can or will provide a year warranty on the structure. As per the year old slab issue. None of the companies have stated or said this has ever been an issue with this slab or any other slab . AHS even said they have warrantied houses with much older slabsPerhaps you might of been misinformed or were referring to another subjectA for a real example, my sister in law lost her house to the floods in Houston. The house was years old. Home of Texas Warranties, warranted the new structure when they rebuilt. They of course had the engineered plans still on recordIf you need documentation from any of the companies you have referenced , they either told me or wrote that they would be happy to provide that to me or you. As per cutting the slab. It could be considered under special circumstances, the companies you referenced would of course require proof that the plumber on site had the proper credentials and licences. Send a copy of *** ***'s license and we would have that ready in case you locate a company that could proceedWe would also need engineered plans of the cut and where the pipes would be placed. Let me know how I can be of any service in respect to the information I received from the warranty companies. Thanks for continuing to try.

Strucsure.com will provide the structure warranty for your house excluding the slab. Because your slab is over 10 years old, no one will warranty the slab. This company will provide the warranty for the structure. My general liability insurance will cover what we do for the slab for the plumbing. Call me if you have any questions. I spoke with a rep from this company in length regarding your situation. They confirmed to me that they would do the warranty on the structure excluding the slab, because it is older than 10 years old.

[redacted],I fully intended to give you a structural warranty. Like I previously stated, there are a number of companies out there that will give you one. It's just a matter of finding the right one. (2-10.com). I can't understand why you think your house will not get a structure warranty. The $5000 is non refundable, like I have previously stated. All the monies that you spent on previous work for your house was never a subject before, so I don't understand why you're bringing it up at this point. After all that I did for you, like getting you financed, spending time with you and trades at your lot, and the countless hours that I have put into your job for bidding, getting accurate numbers etc, I should bill you for my time, so please take into consideration of all the time spent on your job, and then you to decide not to build because you think that you can't get a structure warranty for your house, when in fact you can, is absurd! Its really unfortunate that you are complaining about something that you ultimately pulled the plug on, and are trying to give me a bad name. [redacted]It doesn't seem like I can upload his budget that clearly shows in there for his warranty. I have attached the copy of the budget for you to upload for me if you could.

stealing:*which subcontractors do you owe money to?*how much do you owe each subcontractor?*when did each subcontractor complete the work that you did not pay them for (even though we paid you)?*when will you pay them?For the funds you stole where no work was completed:*why do you think that you can keep money for work that was not completed or even started? *how much money did you steal from us for work to be completed that you never hired subcontractors to do the work?*what projects were supposed to be completed that we paid you for and no work was ever done?

If you still want us to build your house, we would gladly do it. We will find a company that will provide you with a structural warranty, so that we can proceed. That has always been our intention. Please contact me. You have my contact info.

We did intend to get you a structural warranty for your house through a third party warranty company. Also we did intend to build you a great quality home. We have done nothing but bend over backwards for you, from meeting on-site, numerous meetings with sub contractors at your property, to driving around with you to look at other possible builds, and getting you financing. It's unfortunate that your deposit is non refundable.

[redacted],It looks like you have decided to go another direction with the removal of your slab. I have spent more than enough time with speaking with the companies that I have given you. If you want us to build your new house, I would have to reconsider the terms. We have bent over backwards trying to help you build your new house, but it seems like you will disregard any, and all information that we provide. I am rejecting this response because:    Unfortunately, 2-10 warranty will not provide a structural warranty on an existing slab without engineered foundation plans and a soil report.  The slab was poured in 1996 without engineering unfortunately.  [redacted] was the original builder, he confirmed that Engineered foundation plans and a soil report never existed. I will be glad to provide you with his contact information upon request.  I corresponded with 2-10 at length, and will gladly provide the correspondence that confirms what I have stated here.       Please provide another warranty company that will provide a structural warranty and I gladly let you build our house.  I feel that it is never too late to make amends. I've seen your work and am still impressed.  We  still have a contract.  Due to the length of time that has  passed, our loan was converted back to an FHA loan which requires a structural warranty company to be provided by the builder.  We just wanted our 5000.00 back if they couldn't provide a structural warranty  but would gladly have [redacted] and [redacted] build our house if they can provide it.  I had offered [redacted] a bonus if he could make this happen, and would still gladly pay it.  We know now  that [redacted] was doing the best he could and he was always upfront and honest with us. We still have a contract and would gladly forgive him and continue with the build.  We have thought long and hard about this and realize we were way to hard on [redacted], and unfair to him.  I hope he can forgive us.  I also hope we can make amends even if he doesn't build our house.  I regret having ever not having  trusted [redacted].  If this does work out, I would definitely increase the amount that [redacted] would make. To be quite honest,  we are desperate and haven't found another builder that even comes close to the customer service and quality [redacted] had provided for us. [redacted] is a really nice guy, and deserved better that the treatment I gave him. [redacted]

Complaint: [redacted]I am rejecting this response because:  The company you intended and told me via text and to the Revdex.com, AHS i.e. American Home Shield,  [redacted] doesn't provide structural warranties.  I have attached their contract and website as proof of their inability to provide structural warranties.  I also contacted Texas Home warrant this is the company [redacted] intended to use first ,  I spoke with [redacted] (1/19/2018) he is an agent at Texas Home Warranty, he informed me that he had been dealing directly with [redacted] , concerning the structural warranty on our home.  He informed that [redacted] had not provided the 10,000 dollar bond required to secure the warranty and did not provide [redacted] with the engineering drawings on our slab.  Our slab was poured in 1996 and no drawings were done on said slab and no drawings were available.  Is was clearly impossible to provide a warranty on the structure of the home to be built.  Further, [redacted] ,  had sent me a promissory note (see second attachment)asking to borrow 20000.00 dollars ,  I believe he was trying to secure the home warranty due to lack of capital. Needless to say, this inspired a considerable lack of trust between us.  Since no warranty was ever intended to be placed on our home , and lack of due diligence on [redacted]'s part , I would like my 5000.00 dollars refunded.  We also spent considerable monies on engineers, slab grinding, slab extensions, materials all for naught.        Regards, [redacted]
