I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
Complete fabrication and lies, they are making things up to cover up the fact they are extremely unethical, and are in violation of the contract. The contract was signed with the understanding I would overnight the deposit check which we did, there was no mention was made requiring a wire. Why would I delay the funds for the purchase this makes no sense then I would not be under contract. In Order to get a better price that generally is handled after inspections if necessary and I could always recover my deposit back after inspections. I did not have possession of the referenced business card I not sure I ever had one, we had no other knowledge of an different address to overnight a check I/we don’t know all your Newport Beach addresses and after looking there are many so We are not mind readers as to your addresses, that is not relevant anyway as we sent the funds to the address on the contract as required by law.

While the claim that Mr. [redacted] makes that the address on the sales agreement used was wrong it did not have any bearing on him losing the ability of purchasing the vessel. Mr. [redacted] signed the agreement in our current office, had Mr. [redacted]'s business...
card, with the current address and signed the agreement that the money was to be wired not mailed as certain inspections were to be done by him necessitating funds to be cleared into the account first. It would appear that Mr. [redacted] mailed the funds to allow him time to try and renegotiate a better price, knowing the seller was desperate and had to sell the boat immediately. Not only did Mr. [redacted] put the sale on hold wanting a price reduction he also canceled the inspections as he needed to respond to a offer on another boat. While he may have thought this was good strategy to get a better price it violated his position of sale allowing the boat to be open up to other buyers which were plenty as the price was already way below market. This was simply a matter of greed which back fired on him this time. Mr. [redacted] has filed a complaint with the appropriate state licensing department which if any wrong doing was done that they will deal with it but I'm not concerned that any wrongdoing will be found. Bottom line is we are here to serve and we have no problem with who purchases a vessel but we do have to follow the agreements and we expect both the buyer and seller to do so also.
