DEAR ***, IN OUR SINCERE DESIRE FOR A POSITIVE CONCLUSION TO THIS DISPUTE I ASKED MRDAN RANDALL A SALES ENGINEER WITH THE SHERWIN-WILLIAMS COMPANY TO MEET ME AT THE JOBSITE FOR AN "HONEST CRITIQUE OF OUR WORK AND ANY REMEDIES THAT HE WOULD SUGGEST". I HAVE BEEN CALLING MR*** FOR THE LAST WEEK TO NO AVAILE AND COULDN'T LEAVE A MESSAGE BECAUSE HE DOESN'T HAVE HIS VOICEMAIL SET UP. WE ARRIVED AT ABOUT 1:ON FRIDAY September 18, WE WERE WALKING UP TO THE HOUSE ON THE SOUTH SIDE AND WE COULD SEE ONE SPOT WHERE THE PAINT FLASHEDTHIS IS A PLACE WHERE A REPAIR WAS MADE WITH SPACKLING AND IT WAS PRIMED AND PAINTED BUT SOMETIMES IT TAKES SEVERAL COATS OVER THE SPACKLING TO NOT FLASH, WE THEN WALKED ACROSS THE FRONT OF THE HOUSE AND ARRIVED AT THE SIDE DOORJUST AS I WAS ABOUT TO KNOCK HIS GIRLFRIEND CAME OUT OF THE HOUSEI INTRODUCED DAN RANDALL TO HER MENTIONING THAT HE IS WITH SHERWIN WILLIAMS COSHE PROMPTLY STATED "WHATS HE KNOW ABOUT PAINTING"SHE MENTIONED JOE WAS WITH HIS MOTHER WHO WAS ILL AND I OFFERED MY CONDOLENCES, SHE WAS VERY AGGITATED ONCE AGAIN AND TOOK US TO THE BACK OF THE HOUSE WHERE YOU COULD PLAINLY SEE SOMEONE HAD STRUCK THE HOUSE WITH A METALLIC OBJECT CAUSING SCRATCHES IN THE PAINTTHIS CLEARLY WAS NOT DONE BY A PAINTING CREW BUT BY SOMEONE TRYING TO DEFACE THE WORKSHE MENTIONED THAT AREA ON THE SOUTH SIDE OF THE HOUSE WHERE THE PAINT FLASHED WHERE THEY MADE A REPAIRSHE THEN SHOWED US THE INITIALS SOMEONE SCRATCHED IN THE PAINTTHESE INITIALS DO NOT MATCH ANYONE ON MY CREWSTHEN SHE SHOWED US A PLACE ON THE BACK OF THE GARAGE WHERE THERE WAS A 1/4" BY 3' AREA ALOG THE EDGE OF THE SIDING THAT WASN'T PAINTEDTHEN ON THE NORTH SIDE OF THE GARAGE WHERE THEY HAD A SIMILAR 1/4" AREA SEVERAL FEET LONG ALONG THE DRIP EDGE OF THE VINYL SIDINGTHIS OCCURS WHEN THE SPRAY MAN USES THE WRONG ANGLE WITH THE SPRAY GUNNONE OF THESE PROBLEMS CONSTITUTE A COMPLETE REPAINTALL THE ISSUES WOULD NOT TAKE A PAINTER MORE THAN A FEW HOURS TO RECTIFY AS LONG AS SOMEONE DOESN'T MAKE MORE DAMAGE THAN THERE PRESENTLY IS, I TRIED TO EXPLAIN TO MR***'S GIRLFRIEND THAT THE REASON I HAVENT BEEN ABLE TO DO THE REPAIRS MYSELF IS THAT I HAVE A STAFF INFECTION ON MY RESIDUAL LIMB HATS LEFT OF MY AMPUTATED LEG) THAT I HAVE BEEN FIGHTING FOR THE PAST COUPLE MONTHSALSO THAT IT HAS IMPROVED TO THE POINT THAT I COULD BE ON THE JOB TO MAKE THE REPAIRSSHE DIDN'T SEEM TO ACCEPT THAT EITHERHOWEVER I AM STILL WILLING TO MAKE THE REPAIRS MYSELFI HAVE EVIDENCE FROM PEOPLE BESIDE MYSELF THAT WHAT I AM SAYING IS TRUETHE HOUSE HAS BEEN PAINTED WITH A GREAT PAINT THAT WILL LAST FOR YEARSI AM WILLING TO DO ANY TOUCH UPS TO DEFICIENCIES IN THE PAINTIF THAT'S WHAT THEY WANT, IF THERE ARE ANY QUESTIONS PLEASE CALL. the complaint of Ms. [redacted] is as follows:      On or about March 19, 2016 Picasso provided Ms. [redacted] with a Proposal for painting and carpentry work for the property she owned at [redacted], Cleveland, Ohio.  On March 25, 2016 Ms. [redacted] accepted the proposal and provided Picasso a deposit to start work.   Picasso started the project on April 18, 2016 with the men starting prep by scraping and priming with an oil primer which is a standard good practice for a repaint of a wooden structure.  The home was built in the late 1800's making over 120 year old structure.  It is very ornate and detailed however the house was in deplorable shape due to a lack of maintenance over the years.  A considerable amount of the wood was weather worn because of its age and lack of maintenance.  The structure has been painted many times with oil lead based paint.  Typically if a house is latex paint they grind down the surface some to smooth it out.  However Picasso was unable to grind much of the house do to the age and safety concerns with exposure to lead based paint.     An additional problem was the unreasonable expectations of the owner.  Picasso believes that Ms. [redacted] compared her price with other jobs in the area.  However her project was different due to the age and detail of the structure and the existence of lead based paint. The contract approved by Ms. [redacted] specified that all Carpentry and Masonry repairs are to be billed at $45/hr., plus materials.  Ms. [redacted] continuously requested the Picasso perform additional work that was not in the scope of the contract.  Picasso attempted to work with Ms. [redacted] to complete contract items and additional items that were not in the original scope of the contract which added time in the amount of an additional 4 - 5 days to complete the project.     On about April 29, 2016 Picasso was at a point that it would typically get a punch list from the owner.  They walked the house with Miss [redacted] made the repairs she requested.  Ms. [redacted] said she would talk to Picasso after the Historical Society reviewed the structure. At that point, Ms. [redacted] provided a check for half of what she agreed to pay and refused to provide the balance or a punch list.      On May 4th Picasso inspected the house to find the North side of the house had damage to the paint caused by the owners.  Picasso brought in 4 men to make repairs and repaint the damaged area.  At that point Ms. [redacted] demanded that Picasso stay off her property and threatened to contact the police if Picasso returned.      Picasso attempted to resolve the matter, and Ms. [redacted] refused resulting in Picasso filing a mechanic lien against the property in the amount of $4,907.16.  Picasso continues to attempt to resolve the matter with Ms. [redacted] through counsel.Based on the above, request is hereby made that you resolve the matter in the favor of Picasso and close the filed.Thank you for your attention to this matter. Jim Z[redacted] James A.
