I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear belowI take issue with Dr***'s recollection of the facts regarding this complaintArts and Crafts Dental charged me a fee that was not allowed under the terms of their in-network agreement with *** *** for the service they provided. Therefore, under the terms of their in-network contractual relationship with *** ***, they were clearly and unambiguously not able receive compensation for this fee, whether they felt they deserved it or not. Dr*** should fully understand that by agreeing to take *** *** insurance, he has contractually agreed to accept their defined fees for service
Attached you will find Dr***'s initial letter to me for review in this matter. I challenge his language that I was 'disrespectful' and 'abusive' to his staff. I was merely a consumer who, well within my rights, attempted to educate his staff about the terms of his agreement with my insurance provider, *** ***. His staff clearly had faulty information and perceived my persistence as rudeness - which is certainly was notI would recommend that Dr*** better educate his staff about the terms of his dental insurance agreements and their fee schedules, and instruct them speak correctly about the terms of such agreements. This education would, perhaps, help his staff appropriately handle any future discussions with patients about billing discrepancies and patient rights. I will consider this complaint resolved when I receive a written letter (either as a separate attachment in this forum or sent to my home address) from Dr*** acknowledging and apologizing for the billing mistake made by his staff and asserting that I was well within my rights to receive a refund for the amount I had over paid his company. This letter should also include the warranty language he provided in this forum, expressly: "Arts and Crafts Dental will honor our one-year warranty as we do all of our services; the crown on Mr *** was set on Nov 11, and will expire on Nov 10, This one-year one-time warranty, is for use, wear and tear, excludes recurrent tooth decay and any excessive forces that would fracture a tooth."

Arts and Crafts Dental regrets the miscommunication with this patient. We strive not to have these miscommunications, however, they usually involve a lack of understanding about dental insurance. The patient and their insurance company have a contract. We are not part of that contract. We attempted to politely explain our patient’s insurance plan to him. Instead he grew abusive in repeated calls to our office staff. This has created an environment of distrust, which has necessitated that we dismiss him from our practice. We don’t feel comfortable treating a patient who does not trust us to be honest, nor rely on us to provide the best quality treatment in their best interest. Arts and Crafts Dental will honor our one-year warranty as we do all of our services; the crown on Mr [redacted] was set on Nov 11, 2014 and will expire on Nov 10, 2015. This one-year one-time warranty, is for normal use, normal wear and tear, excludes recurrent tooth decay and any excessive forces that would fracture a normal tooth.
