I am rejecting this response because:There is no solution being presented, and the information being provided by MrSmith is falseThe facts involving this matter are as follows:#There was an agreement made between myself and MrSmith for the Logo branding system AND the website design for a total of $1000. #There was never an agreement on a breakdown of cost for the services#I specifically asked MrSmith in our meeting if there was a deadline in which the website information needed to be submitted for completion and he told me NO. #My personal matters are of no concern to MrSmith (i.ethe fact that I had a test to take that he said I didn't inform him about for the beginning) I have no obligation to disclose that information to himI knew what my upcoming weeks looked like, and I knew what I had to focus on, which was why I made sure to ask about a deadline from the beginning. #I gave MrSmith a specific date in which I would have all the information to himHe initially agreed to this date and then presented me with the option to not move forward with the website and he would keep my $deposit as payment for the branding systemI made it very clear to him that this was not an option, as I would have never paid $for the branding system alone, and the only reason I entered into contract with him was because I felt that the $for BOTH services was a fair amount. #It was only AFTER I rejected this offer from him that he began to make claims about the breakdown of service prices and that he would was no longer willing to do the website at allInitially when he presented it, it was an offer of accepting the $I had already paid for payment of the branding services that he had completedIt wasn't until after I rejected that he made it a demand and provided me with a falsified invoice that I had never seen and had never agreed to. #Even on the *** receipt from my initial payment, It states that the $was a DEPOSIT for the services
Sincerely,

Complaint: [redacted]
I am rejecting this response because:
There is still no resolution being presented, and now the company is making unnecessary and completely false accusations about my character. Attached you will find the receipt from [redacted] that specifically says that the payment I made was a DEPOSIT for services. At this point, only a small part of the project has been competed, and I do not wish to do any further business with ArtWurks Unlimited. I am requesting 100% of my funds be returned to me immediately. I understand that he may normally provide branding services for $400-$600, but I had absolutely no intention of paying that price just for the logo design. The agreement has always been $1000 for the logo and the website design, therefore since Mr. Smith has stated that he will not fulfill that agreement, I believe I am within my rights to request a refund.
Sincerely,
[redacted]

Ms. [redacted] is not entitled to a refund. This has already been explained. She is also making false statements in her complaint and response.Being untruthful with only damage her credibility and  her business. The project invoice is attached. I have nothing further to say about this matter.

[redacted] was referred by a close friend. Ms. [redacted] hired me to create a Branding System (logo & 7collateral pieces, cost $600) and a Single Page Website (one page responsive site-cost $700). Ms. [redacted] indicated she had a small budget, so I agreed to create the Branding System...

at a discounted rate of $500, and create the single page website at $500 making her project total $1,000. When presented with the option to get the logo by itself (cost $400), or the the branding system with collateral pieces (cost $600), she opted for the branding system. At our initial meeting, we discussed in great detail, everything included in the branding system and the site, what my responsibilities would be and what her responsibilities are regarding content. She indicated that she would be forthcoming with feedback on concepts during the design process, and equally forthcoming with the content for the website.  Because she is only offering two services(personal training, strength conditioning), I figured this would be a simple task. More than once, I even offered to help (in writing) her create the content if she was unsure of how she should engageher visitors. She refused my help. The logo was completed and met her approval. Her business card layout was completed and met her approval. Ms. [redacted] indicated she needed more time to decideon the (6) remaining collateral pieces. After about 10 days (still no collateral choices or site content), she called me to inquire about a new project for a gym website, she said she had a new job offer (with a different company than her own),and she wanted quotes for new branding and web presence for the new gym. I let her know that I would like to complete her project before I would consider another, even though she pressed for quotes. She then made appointments on two separate occasions to bring DryFit apparel to plan placement for printing...no call, no show both times. She told me she had secured a date for a photo shoot, for web imageswith a photographer I referred to her and later found that to be untrue. She then told me she would withhold content for another month because she had to study for a test. This behavior raised a red flag. After another two weeks pass by (still no collateral choices or site content), It seemed as if I was getting the run around with regard to this project, so I offered (in writing) that if she would like to pay the remaining balance for the project,($500) then she could take up to 90 days if needed, to submit content for the single page site, or, I could just complete the branding system (which her initial deposit covers) and she could move forward with someone else on thewebsite when she was ready to do so. She replied (in writing) that if I did not want to complete the website, she would rather I not build it. We were in agreement that I would not be building the site. I kept the branding system at thediscounted rate ($500), even though I would not be creating the website. She then demanded that she should get more than what is included the branding system because she doesn't "feel" that it's worth $500. I explained to her that she was entitled to the (6) remaining collateral pieces (as included inthe branding system), but no refund or other print services. When I explained that her logo alone is worth $400, she became argumentative and threatened to "make things difficult" for me. I am still waiting for her (6) remainingcollateral choices, which I doubt will ever come.We viewed the two following pages at my office, on a 24 inch monitor, at our initial meeting before any work began. She was made well aware of what was included in her branding system and was in agreement before her initial deposit was made.Branding & Identity: [redacted]Web Design: [redacted]I did not draft a written contract for this project, due primarily to the size of this project, and the referral source. This experience has taught me that a written contract is crucial to every project going forward, regardless of any verbal agreement.
