I have reviewed the response
made by the business in reference to complaint ID *** and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
[ had been looking at comfortable cars for quite some timeI started doing evaluations for a Mercedes SLI been to the local dealership *** motorsTest drove a brand-new SL At that point in time I started looking at purchasing the carA close acquaintance informed me that he had a very good friend that he grew up with in Europe who was trying to sell his SLHe also happens to be a car dealer and owner of automotive solutionsAt which time he had told this acquaintance that he had purchased the car new After he had purchased the car for himself this acquaintance had seen the car many times and was always told that it was newHe said that he kept the car pristineIt was purchased for his wifeSo the acquaintance arranged for me to meet the Dealer at his house where he kept the carThe acquaintance and I met the dealer at his house to take a look at the carThe car looked fantasticWe had a long talk regarding the carI asked him specifically along with the acquaintance are there any issues with the car he said "no"He said the only damage and the car was a little scuff centimeter in the clear coat and you had to take it out in the sun to see itI told him I do not need to see the car out in the sunHe insisted on showing me the car to show me the one problem that was with itSo he drove her car out of his garage and pointed out the small scuff on the hoodHe stated never been accidentsI said I have some interest in purchasing itHe gave me a price of $50,I started doing research and this was in line for a SL with 22,milesI called several times on the phone to discuss the carHe wanted to have me come down the test drive itSo I went down to automotive solutions and test drove the carI like the car a lotI asked him why he was trying to sell the car and he said his wife was pregnant and that she needed to get in an SUV otherwise he said he would never sell it because it was "pristine"Again I asked him if there been any problems with the car and he said "no", never had a problem"I did decide to go ahead and purchase a carI went down to his place of business, Automotive SolutionsWe started filling out paperworkAfter all the paperwork was done, I presented him with a check for the carHe then did the title workAs we got up to walk out with the Keys he states "Oh, by the way I need you to sign this piece of paper it just says that the car had a small accidentI asked him what you meanHe said it had a scratch left front bumper and a flat tire but you can see its "pristine"So I signed the piece of paper he took it awayIt was paper was just a with several boxes and nothing checkedHe said "this really does not mean anything they just make us do this"He stated that I did not need a car fax because I could see how "pristine it was"I could not pick up the car at that point in timeHowever I came back to the dealership with my wife so that we could pick up the carWhile we were there I made him explain the accident was in the carHe told her the same thing"The car had a scratch in the bumper and a flat tireThat is all it wasYou can see it is pristineIt nothing serious"I had no reason not to believe himHe invited me to his homeHe asked me to see the car outside of his garageHe insisted I test drive the carHe had told his good friend that it never been in an accidentAbout months later I was having the car serviced at the local Mercedes dealershipWhile it was at the dealership unfortunately the car was stolenWhen the dealership management came to talk to me about this they asked me about the carThey told me that it was a salvage car at which point time they asked me if I knew what that meant and I said now I had no idea what that meantThey asked me do I know what I told vehicle means and I said noI had never been told the car was totaled or involved in any kind of serious accidentThey asked me what were you told I said I was told the car "had a minor scrape and a flat tire on the passenger front side"At which point in time they said he did not explain to you that the car was salvaged I said noThen they said you know what the value of a salvage car is I said noThe research done was on non-damage carThey told me that the salvage value for that car is actually under $22,They stated that he more than doubled the value of the car when he sold it to meFurthermore they told me was there should have been stickers and postings directly on the car stating that it was a salvage car and I said there were noneThey told me that all salvage cars sold from the dealership must be marked with stickers and postings on them for identification that is visible to customersThey asked me did he explain what a salvaged or total car meant I said noThe car was recovered about weeks later with minimal miles added to itThere was no damage to the car per *** Motor*** motor was kind enough to redo the clear coat where the scratch had been they replaced all the rims and wheels they did notice that some under coating was not replaced when the car was repaired from its significant accidentThey also gave it a year warrantyHowever they could not pay me the price of the car because they stated that it should never been sold for more than double what its valueThat was inappropriate and unethicalThey can only pain me for the value of a salvaged SL Had the car never been stolen I would have never found out that it was a salvage vehicleThis was never explained to me from the Dealer himselfHe did not post on the car that it was salvagedI had spoken to him on more than occasions at which point in time he could have told me that the car was in an accidentHe intentionally chose to deceive me and with hold information until after I had given him a check in cash for the car, received the keys for the car and then he chose to present me a paper saying "it had a scratch and a flat tire, but it was in pristine condition"Furthermore he had told my wife it was only a small scratch an flat tireAgain he had an opportunity at that point time to say that it was salvaged/totaledHe told his own Good friend that the car never been an accidentAgain having every opportunity to be honest about thisFurthermore he charged me over double the value of the carAgain making it clear that he was hiding that it was a salvage vehicleThis is an and ethical behavior of not presenting the damage in the appropriate fashion, not explaining what the damage was not only to myself but to other peopleHe intentionally withheld presenting me with a car fax knowing that the car had been salvage/totaledHe then charged a price that was more than double the value, with himself knowing the car was salvaged/totaledFurthermore he has a legal obligation to explain/disclose all information along with the required posting of salvaged/totaled markings on the carI would like to get what I paid for originally from him or charge the price of a salvaged SL$22,The car has not been driven since I received it from *** motors who did a total of $worth of routine maintenance, replacement and proper repair of the original accident the car was inThey also provided with another key ( I purchased it with only one key as the spare was missing) at $valueThey also added a two-year warrantyI also like him to do proper car marking and disclosure when he selling cars making sure that he actually tells potential buyers about his products so this does not happen to a another person]

Response: As the business owner I strive to make every customer satisfied to our best ability. We sell used cars and every once in a while they will have issues. The lady that bought a car from us came in to purchase a Lexus but instead saw this car and fell in love with it. She than took it to her mechanic to have the car inspected, upon his satisfactory inspection she was advised by her mechanic to buy the car which she did. As far as the extended warranty she purchased from a company other than ours we have no control over. When the customer stated there was a issue with the car we offered to install the faulty part if she purchases it, cost of the part is equal to labor cost to install. This option did not work for the customer. When buying a used car you need to consider that it might need repairs in the future and the seller in not responsible for repairing or maintaining your car. As mentioned earlier we tried to help but the customer felt that this was entirely our responsibility which we disagree on. We hope to come to a conclusion. Sent on: 1/23/2016 10:39:32 AM
