every disagreement; The two parties involved normally have their own different perspectives and then there are the facts / truth Thank you for allowing us to give you the facts regarding this dispute I believe these facts will show that Mr*** complaint is an attempt to use your influence to bully my company * Attached to this email you will find the written quote (*** Revised) regarding this project Note there is no mention of a Sherwin *** stain on this quote.* After Mr*** accepted our quote, we emailed him a detailed confirmation email (attached) that listed everything we proposed to doI would like to point out the second paragraph of this confirmation email It states, "We will be doing the following items listed on quote# *** Revised This confirmation email and the quote# previously indicated in this paragraph, consist of our entire agreement There are NO verbal agreements or implied agreements pertaining to this project" I would also like to point out the paragraph pertaining to the fence stain to be used It states, "We need your sealant / stain colorYou can see our sealant colors by clicking here: *** Also, here's a brief explanation of our colors; CLEAR sealant has no color (It will protect the wood but allow it to weather naturally), HONEY semi-trans colors the wood light brown, CEDAR semi-trans colors the wood a darker brown and REDWOOD colors the wood a redist-orange tintYou can also take a look at our Facebook page which has additional projects done in all of the above colors: *** Note this paragraph only references our in house stains and there is no mention of a Sherwin *** stain. * After reviewing the above confirmation email paragraph and links to our website, Mr*** was unable to pick a stain color so we told him we would sample the above colors for him after we arrive to do his project We started Mr*** project on or about 2-21-and sampled the above colors for him at that time.* On or about 2-23-Mr*** indicated that he did not like any of the colors sampled and wanted a Sherwin *** stain We verbally quoted him a price of $and he verbally approved the additional cost.* On or about 2-24-I saw that Mr*** had chosen to upgrade to a Sherwin *** stain We were about to send him an email confirming his addon of the Sherwin *** stain but I decided to call him first to try to talk him out this decision to upgrade to the Sherwin *** stain I informed him that the Sherwin *** product would not look as good or last as long as our in-house stain After a 30-minute conversation regarding the disadvantages of the Sherwin *** stain, Mr*** declined our in-house stain and again verbally approved the additional cost of the Sherwin *** stainI followed up our phone call with a project addon email (attached) that indicated his approval of the Sherwin *** stain that he selected and the upgrade charge Mr*** now says that he was in fear of a work stoppage if he did not accept the Sherwin *** upgrade charge Let the record show that when I called Mr*** regarding the Sherwin *** stain we had 95% of his project completed Also, let the record show that I did not say or imply to Mr*** that my company would walk off an almost $job that was 95% complete I've also attached a certified letter sent to Mr*** on or about 03-15-in response to his certified letter seeking a refund of the Sherwin *** upgrade charge The purpose of this letter was to refund him an amount overpaid to us by the company that financed his project and to deny his request for refund of the Sherwin *** upgrade charge I've included this letter for your review so that you can see the details of the conversation that Mr*** and I had before we stained his fence. As I stated previously I believe that Mr*** knows that his complaint has no merit and I believe that he is trying to use the influence of the Revdex.com to bully my company Bullying in school, personal relationships and business is wrong and my company will not reward it or tolerate it As I stated to Mr*** verbally before we stained his fence and stated again via certified letter, "As Good As New LLC was kind enough to stain his fence free using our in-house stain but we will not absorb the cost of the Sherwin *** product Like it or not, Mr*** and As Good As New LLC are in a relationship until his warranty expires We normally go above and beyond what our warranty says we have to cover for our good customers If the need arises we hope to be able to go above and beyond for Mr***.Thank you again Ms *** for the opportunity to share our side of this story Please let me know if you need anything else and I'll be anxiously awaiting your response.*** *** **As Good As New,LLCFounder and President

AS STATED PREVIOUSLY AND PROVEN BY THE DOCUMENTATION PROVIDED, MR. [redacted] COMPLAINT HAS NO MERIT.  I believe that Mr. [redacted] knows that his complaint has NO merit but insist on trying to use the Revdex.com to bully As Good As New LLC. As I said previously, "Bullying in school, personal relationships and business is wrong and my company will not do ANYTHING to reward Mr. [redacted] for this behavior."

In counter to Mr. [redacted]’ response, I would like to make these statements for further clarification and to illustrate his continued unethical business practices: 1.  Misrepresentation of stain selection/offer Mr. [redacted] states that his cover email that referenced the attached quote #[redacted] Revised should be considered part of the agreement.  The quote stated it was “limited to transparent and semi-transparent stains.”  Nothing on the quote states it only pertains to stains that he had on-site at his business or shown on his website. Ms. [redacted], during her sales calls, had referred us to the website and we had stated those stains were not what we wanted. That is when she had said we had the option to choose from thousands of stains at Sherwin [redacted] in order to convince us to select As Good As New for our fence replacement. Mr. [redacted]’ email attached to the quote also refers to the ability to view the stain choices on their website, but does not directly state these were the ones that applied to the free sealant in the quote. Since the offer to select a Sherwin [redacted] stain was made before either accepting their project or their construction of the quote, they were fully aware this had been discussed and represented as a choice. (Dates and content of these discussions are evidenced in the phone transcripts.) Mr. [redacted] seems to think that putting a statement in his email that “there are no verbal agreements or implied agreements pertaining to this project” allows his staff to give any description about what the work would include so as to influence the customer’s decision, and then just negate what was offered later to conduct business however he decides.  Further, we were specifically not allowed by As Good As New to actually select a stain until after construction began in order to see it on the wood that would be used. (Also in the phone transcripts and in his response to the Revdex.com.)  This is not a common practice and is a device to make the buyer so committed to the project that they would be hesitant to object to changes from what was expected. The misrepresentation of their sales offers and their actions to make changes difficult to refuse amount to what is called a “bait and switch,” which is an unethical business tactic. 2.  Mr. [redacted]’ “project addon email” It is revealing of Mr. [redacted]’ business ethics that the “project addon email” mentioned in his Revdex.com complaint response is dated February 24, 2017, but the document properties for its transmittal show that the document was both created and modified on June 19, 2017 (attached).He also labeled the email “Response Required” but is unable to supply my response because the email did not exist.  The lack of my response indicates that acceptance was not made.  The phone transcript of February 24th shows my initial reaction of non-acceptance to this extra charge which did not concur with what we had been told was included.  I was coerced into approving the charge when I realized the situation I was put in and that I would have to address the issue after construction was complete. Falsifying correspondence is another example of unethical business practices. 3.  Project completion discrepancy / possible stoppage Mr. [redacted] states that the project was 95% complete on February 24, 2017 when the stain issue developed.  In truth, only the back fence had been built (212 ft).  The side fence had been torn down but not replaced (171 ft) and the front fence panels/gates were torn down but not replaced (22ft / 14 ft).  This is in no way 95% complete.  We have a date-stamped video that can verify this.   This meant our property was vulnerable from the street and through a large expanse by our neighbor’s yard.  Although Mr. [redacted] had not specifically said he would “walk off”, his statement on correspondence dated February 11th that delays would cost $90 per day as well as the harsh and dismissive responses (to our surprise and dismay upon hearing about the added charge) was clear indication that he would not hesitate to enforce that consequence (stoppage).  Therefore, we were coerced into accepting his demands to ensure completion of the fence rather than face a lack of safety/security of our property.  Any other method of correction, whether hashing out our agreement with As Good As New or trying to find assistance elsewhere would have incurred delays and substantial costs.  As stated in my phone transcript, he had us “over a barrel” because either we went forward with his tacking on the added charge or we would be paying delay charges or cost duplication with another vendor. 4.  Name-calling We are insulted with Mr. [redacted]’ assertions that trying to find equity in a business transaction is “bullying.”  I have been a San Francisco business executive and my wife has been both a social worker and a high school educator over the last 30 years.  Calling someone a “bully” has become a hot button and Mr. [redacted] is using the schoolyard tactic of calling “bully” to deflect from his own guilt.  This was his reaction instead of the normal good business practice method of recognizing that there had been a miscommunication within his firm (admitted by Ms. [redacted] in the phone transcripts), giving good customer service by accepting responsibility and making a fair and equitable concession (I did offer to split the cost), and using the incident as an opportunity to upgrade his policies for customer communications and correspondence.  I have to question why the cost of accepting their responsibility is so great that he is unwilling to find mediation even up to this point.
