Scam
Scott took my money and promised to provide specific services and support, primarily marketing. We received a few reasonably promising leads at first, but then he changed his method for lead-generation, and although the number of leads increased significantly, they were essentially just a list of names and numbers from a phone book.
The leads were supposed to have already been contacted, interested in selling their business, and expecting our call. None of them had been contacted, so the "follow up" was a cold call, and the prospects were mostly not even small businesses. One was a publicly traded company. One was a Chinese electric utility company. When he had defaulted on pretty much everything he had promised, it was always someone else's fault. I'm a very patient person, and I offered him a lot of time and many different ways to make good on his obligations per our contract, but the only option he was willing to entertain was for me to give him more money. Once I made clear that wasn't going to happen, he stopped responding to my calls and emails completely. He has a history of folding up his tents and starting a new business (Business Service Network; AS Radin and Associates; North American Alliance of Business Brokers; Global Alliance of Business Intermediaries, Envoyz, Certified M&A Intermediaries; Broker Worxx, Seller Concierge, etc) leaving his former associates behind and holding the bag.

He will give you a guarantee in writing, but that's not worth the paper it's printed on. When he doesn't uphold the terms of the contract you'll have to get in the back of a very long line to get any of your money back. He'll claim that the people who write negative reviews here and elsewhere are people who were merely unhappy with the arrangement, or underperformed, or are out to get him for some reason. He will also claim that many of the reviews are from the same individual. You only need to do a public record search on his name, or A.S. Radin, or North American Alliance of Business Brokers, or any of the other versions of his companies that he's left behind to see that there are many people and companies who have current lawsuits pending against him.

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
Scott's assessment is inaccurate on the following pointsI hired an employee, supervised at my own office to help me run the campaigns, since the campaigns required some technical knowledge and training. This was NOT in any way a violation of the agreement, and Scott was fully aware of it and never brought the concern to my attentionThe marketing campaigns were not successful after the 1st few attempts using Scott's 'system'. Furthermore, Scott refused to RELOAD the marketing campaign, which was contrary to the terms of our contract. ALL marketing expenses related to the teleblasting camapaigns that Scott sold me on (and to which we contractually agreed to) were cut off within the first few months. Scott did NOT live up to his part of our agreement. He's failed to address this critical issue in his response. EVERY SINGLE LEAD GENERATED BY SCOTT'S MARKETING "SYSTEM" WAS FOLLOWED UP WITH ON MULTIPLE OCCASIONS! We ran the campaigns exactly as instructed, but without success. The accusation that I did not follow up with each lead procured by the marketing is simply not true. Scott and *** were given access to my leads database and could see exactly all the notes I was making on following up with each of the prospects. I did not stop communicating with Scott; to the contrary, I had asked him to reload the marketing campaign so we could procure the needed leads, and he refused and stopped responding altogether.I've suggested several ways Scott could rectify his breach of our agreement.

Mr. [redacted] purchased the territory under a one year agreement that ran August 2013 to August 2014. At the end of said agreement we - NAABB - decided to move on. His territory was not resold until late November 2014. The accusation that I resold his territory prior to the end of said agreement is...

simply not true. As for the paid  territories themselves, Mr. [redacted] purchased a single territory under said agreement and I provided him all three AZ territories under the one purchase price because, at that time, I felt he would be a benefit to our network. After Mr. [redacted] completed training we funded multiple marketing campaigns to which Mr. [redacted] had a third party running the marketing campaigns which breaks a term in the territory agreement. Soon thereafter when the campaigns were run Mr. [redacted] sent both [redacted] our Marketing Director  and myself a very derogatory email that the marketing system did not work. Upon a thorough review it was determined that Mr. [redacted] and/or his third party did not run the marketing system properly which resulted in well over 30 leads that were left in the system and not followed up on. By not following up on said leads then Mr. [redacted] broke a second contingency built into the territory agreement. I then sent an email back to Mr. [redacted] that the error was on his end and that said leads were never touched and requesting an update. Once this all occurred Mr. [redacted] stopped communicating with me which broke a third contingency in the agreement. The next email I received from him was after his agreement expired to which he was informed that the territory agreement would not be renewed. He subsequently contacted our Marketing Director [redacted] trying to work a back door deal to use the marketing system without my knowledge. Independent confirmation of these details can be gotten from our Marketing Director [redacted] at ###-###-#### or by emailing same to [redacted].com.Mr. [redacted] was never told he could use the marketing or support systems at the end of one year if there territory was not renewed and while it is true the 1 year agreement is for the brokers benefit in the event they wanted to branch out on their own, that did not include using the system. It is intended to allow a broker to branch out on their own without the commission splits and without NAABB involvement. As for the assertion that my intention is to mislead in order to resell territories for profit, very little profit is made from the territory fee rather we capitalize on the success of the brokers via a small commission split. So what Mr. [redacted] writes is polar opposite our goals.Mr. [redacted] never made multiple attempts to contact us after the first few marketing campaigns after he was made aware of his error on the leads system and it the broker's responsibility, not NAABB, to remain in good standing and regular communication with us. I am sorry Mr. [redacted] felt compelled to file this complain 8 months after his agreement expired however it is not a right to renew a territory and territories are only renewed for those whom are productive, provide regular communication and provide proper leads follow up. As such I stand by our decision and wish Mr. [redacted] luck but we have moved on toward a productive AZ territory.And as previously stated, inependent confirmation of all these details can be gotten by our Marketing Director [redacted] at ###-###-#### or by emailing same to [redacted].com.
