To get a good idea of the truth of this complaint, all you need is common senseIt's not that complicatedBut it takes some explanation We signed a $35,design contract with Canaan Construction ( [redacted] ) and gave him a down payment of $17,Of this, [redacted] paid his first (low budget, incompetent) draftsman subcontractor $He kept the other $16, The design process was very bad, with a day process (stated in the contract) dragging into three monthsAbout ten weeks in, Canaan invoiced us for an additional $7000, although [redacted] had been clear at initial signing that the second half full payment would be made when everything was complete and the plans were permitted In the meantime, I had found out that Canaan was in dire financial condition and when he presented me with the $additional invoice I told [redacted] I knew about the problems he was havingHe admitted that he was in major financial difficultyIt was clear that he was invoicing us the $not because the work was done but because he needed moneyWe didn't pay, but we did try to still work with him because he seemed like a nice guy who was just in trouble Canaan Development (a new company started by ***'s brother ***) offered to step in and "save" the projectI was then invoiced $by Canaan Development for delivery of the first phase of my designI paid the $and the first 20% of the design (Schematic Phase) was deliveredIt had been done by the second subcontractor, an architect, who had been brought in after the first draftsman was a total disasterSome portion of the $- I believe $- was actually paid to the architect at that time But that was all that either version of Canaan (Construction or Development) ever delivered: the Schematic Drawings, which represented 20% of our $35,contract, i.e$worth of productAnd that percentage was specified in writing in the contract Then things stalled again and the design didn't move forwardI got contact information off the draft schematics and contacted the architect directly to find out why things were going so badlyHe told me that other than the $he had received he hadn't been paid by Canaan and he wasn't doing more work until he was paid what they owed him Considering that Canaan had received $21,from me to that point -and $within the previous week - I was extremely disturbed to find that only $had been paid to the one person who was actually working on my designAnd although they owed him money they had still pocketed $of my most recent $instead of paying their debts! I offered to pay the architect directly to finishHe agreed to work with me directly and forgive the additional money that Canaan owed him, in order to finish the projectThat is a far cry from Canaan claiming that the architect had been "paid in full," which is not trueThey didn't pay himHe released them from their debt so that he and I could move on When I asked [redacted] where all my other money went, he came back a week later with an invoice based on hourly billing of his personal time at $an hourBut there had never been any discussion of hourly billing, nor is hourly billing mentioned anywhere in the contractThe contract was for deliverables, which, because he wasn't paying his subcontractors, [redacted] hadn't been able to deliver ***'s hourly invoice was a fabrication, created after the fact because the money was long gone and [redacted] hadn't used it on our project [redacted] just spent our money Canaan is in deep trouble financially and [redacted] used our money to pay his other debts, hoping that he would be able to get more money later somewhere in order to keep our project going, just like a Ponzi SchemeHe and his brother took $21,000, used only $on the subcontractors, and spent the rest Of course, it's fair to say that [redacted] deserves some compensation for his time spent on my projectWith 20% of the contract delivered he could reasonably have had $for himself after paying the subs $But that still leaves $14,he misappropriated I don't believe [redacted] started as a scammer, but financial desperation has made him oneI've got the documentation to prove the chain of events [redacted] cost me major time, and moneyDealing with him was a disaster, because he's so far in debt that he can no longer manage a project normally Will I ever recover my money? Probably not, but at least this complaint can warn the next person before they get involved with Canaan If you don't believe me, just ask around the Oahu construction communityDo your research on Canaan, believe what you find out, and save yourself a lot of troubleThey are not the same company they were a few years ago

To get a good idea of the truth of this complaint, all you need is common sense. It's not that complicated. But it takes some explanation.
We signed a $35,000 design contract with Canaan Construction ([redacted]) and gave him a down payment of $17,500. Of this, [redacted] paid his first (low budget, incompetent) draftsman subcontractor $1500. He kept the other $16,000.
The design process was very bad, with a 30 day process (stated in the contract) dragging into three months. About ten weeks in, Canaan invoiced us for an additional $7000, although [redacted] had been clear at initial signing that the second half full payment would be made when everything was complete and the plans were permitted.
In the meantime, I had found out that Canaan was in dire financial condition and when he presented me with the $7000 additional invoice I told [redacted] I knew about the problems he was having. He admitted that he was in major financial difficulty. It was clear that he was invoicing us the $7000 not because the work was done but because he needed money. We didn't pay, but we did try to still work with him because he seemed like a nice guy who was just in trouble.
Canaan Development (a new company started by [redacted]'s brother [redacted]) offered to step in and "save" the project. I was then invoiced $3500 by Canaan Development for delivery of the first phase of my design. I paid the $3500 and the first 20% of the design (Schematic Phase) was delivered. It had been done by the second subcontractor, an architect, who had been brought in after the first draftsman was a total disaster. Some portion of the $3500 - I believe $1500 - was actually paid to the architect at that time.
But that was all that either version of Canaan (Construction or Development) ever delivered: the Schematic Drawings, which represented 20% of our $35,000 contract, i.e. $7000 worth of product. And that percentage was specified in writing in the contract.
Then things stalled again and the design didn't move forward. I got contact information off the draft schematics and contacted the architect directly to find out why things were going so badly. Considering that Canaan had received $21,000 from me to that point -and $3500 within the previous week - I was extremely disturbed to find that only $1500 had been paid to the one person who was actually working on my design. And although they owed him money they had still pocketed $2000 of my most recent $3500 instead of paying their debts!
I offered to pay the architect directly to finish. He agreed to work with me directly and forgive the additional money that Canaan owed him, in order to finish the project. That is a far cry from Canaan claiming that the architect had been "paid in full," which is not true. They didn't pay him. He released them from their debt so that he and I could move on.

But there had never been any discussion of hourly billing, nor is hourly billing mentioned anywhere in the contract. The contract was for deliverables, which, because he wasn't paying his subcontractors, [redacted] hadn't been able to deliver.

Canaan is in deep trouble financially and [redacted] used our money to pay his other debts, hoping that he would be able to get more money later somewhere in order to keep our project going, just like a Ponzi Scheme. He and his brother took $21,000, used only $3000 on the subcontractors, and spent the rest.
Of course, it's fair to say that [redacted] deserves some compensation for his time spent on my project. With 20% of the contract delivered he could reasonably have had $4000 for himself after paying the subs $3000. But that still leaves $14,000 he misappropriated.

If you don't believe me, just ask around the Oahu construction community. Do your research on Canaan, believe what you find out, and save yourself a lot of trouble. They are not the same company they were a few years ago.
