We are in contact with the owners on a regular basis, The weather has not been cooperating with us to do the project with the excessive rain we have been havingThis project cannot be done in excessive rain, cold weather and or snowWe are not willing to do a project that we will cause damageWe have an account with Pella windows do not need payment prior to sending them out

We did enter into a contract with the [redacted] s, They were told we are 60days out we got zoning permit as required, We also told them that the large propane tank had to be relocated and garage needed to be cleared out for us to start excavating they were told this on several occasions and the tank is still there and garage is full, The windows are in from Pella and will be installed when we have decent weather she has new born and don't want them exposed to the weather per her requestShe was told all windows would be working on at same time in order to get the project doneShe wanted us to do one window at a time but that is not cost effective for our companywindows came in on the 6th of January and weather has been very bad rain and below zero tempsThey have been trying to renegotiate contract after they they received lower quotes and wanted us to lower our prices, which we will notwe are shooting for next week install windows weather permitting

I am rejecting this response because: 1.) Yes, we were told that Medina Township Zoning had approved the zoning portion of the planned car garage addition. That was never disputed on our end. We promptly cleared out the garage and it has remained clear since September 2016, this has never been an issue. The contract states that "work shall begin on (or before) September 9, and shall be (substantially) completed on (or before) November 11, 2016. During this time we either went weeks without hearing from Brian or were given excuses of "staffing issues" within his company that were holding back start dates. Also during this time we continuously asked to see blueprints of the planned garage addition and laundry room project. Each time we were told that it was still pending approval with the Medina County Building Department. When I finally called the Building Deptto see what the hold up was, I was informed there was nothing pending for our address and in fact nothing had ever been submitted for our location. When I called out Brian on this he changed his story and said that he was having issues completing the blueprints and when he was completed with the design he would submit to the building department. He also then (this was toward the end of October 2016) informed us he couldn't start the excavating until our propane tank was moved. While I was extremely angry with yet another excuse, and blame being put on us, reluctantly called our propane company and scheduled for it to be moved. I told Brian we still would need to see and approve the blueprints as well as have approved permits on hand before we would allow him to start any excavating or other work at our property. We still have never seen any blueprints to sign off on and we have never been furnished with permits from the Medina County Building Department....hence the propane tank not being relocated.2.) Brian states that "the windows are in from Pella." They are not. Yes, the windows have been manufactured by Pella, but they still have not been released for delivery. I have been in constant contact with Pella and they will not schedule delivery of our windows until they are paid for. We still do not have a delivery date from Pella. The windows remain at Pella's warehouse awaiting payment. Weather has never been and issue, payment has.3.) I have never requested that windows be installed one at a time, I have no installation complaints at this time because we have no windows to install at this point!!! 4.) We have never tried to renegotiate cost since signing his contract. Cost of the project has never been an issue. The complaint filed and what has been discussed is that we paid Brian/Ashley Contractors almost months ago a deposit for a garage addition/laundry room project and nothing has ever happened since. He took our deposit and paid for a $zoning permit and nothing has happened since. We paid in full for his estimated cost to replacement and install 10 windows, also almost months ago. It took months just to order the windows and now weeks since ordering the windows we still have nothing. No windows even sitting on our property waiting to be installed. Brian has taken our money and given us nothing he promised per the signed contract. Back to my original complaint, we've paid upwards of $20,and Brian has taken our checks, cashed them and given us nothing. We want the custom windows that have been made by Pella delivered to our property and we want all remaining money returned to us for breach of contract and inability to complete agreed upon services in a timely fashion
