My apologies for not responding sooner. We have met with our warranty company to discuss what is and what is not covered.Concrete in North Texas can be affected by many variables that can cause stress cracks.If indeed, the stress cracks open up then a claim can be filed with the warranty

The Weather Channel reported inches of rain at the Dallas-FortWorth International Airport, smashing the old May record of inches in 1982"With this being said thevolume of rainfall supersedes the norm for us in North, Texas.Mr*** contracted with us to build a retaining wall.A subcontractor had previously built several retaining walls for Ashlyn Homes here at the Lago VistaCommunityIt was unfortunate that the retaining wall installer was beat by mother-natureJose, ourretaining wall installer rushed to finish the wall but it did not go well because he failed to support the wallbackingA few days later he tries again to repair the wall but it was too lateThe wall had swollen andopened up.As the wall was being built the yard was graded and the excess soil removed from the back yard to help restrain soil to unnatural slopesThey are used to help with slopes or hillsides and make them more boundAretaining wall by no means is it engineered or designed to hold water, slow water and or contain any water.In fact, the retaining wall for Mr*** was to give him a larger backyard and he told us he was going to installa big stone patio to the wall so it would be more like an enclosed patioThis would allow him to get the mostout of his yard.The retaining wall's price included materials, labor and equipmentSoils had to be graded numerous timesand stones had to be removedEach time a task was performed it costs labor and equipment to get the wallbuiltAfter adding the total spent on this wall it totals to approximately 8,dollars with no return oninvestment it was time to stopWe offered to have a different contractor come in and give his opinion as wellas his price to rectify the issues with the wall.After Mr*** did not plant his yard or install the trees, or put of a foot retaining wall at the top of his lot inthe rear ofthe property or French drains and catch basins we continuedSwells were in place to drain to bothsides of the propertyMr*** instructed us that we had to cut off the water flow to the right side of thehouse so all the water is diverted to the left side of the house.Even when Mr*** declined to have the wall repaired, I proceeded to have the sod company come in andinstall more sod free of charge to Mr*** in his backyardThis would not only give him a nicer yard but helpwith the soil washing away.Mr*** states in his letter that he had concerns about the drainage when he contracted the house but hiscommunications to us were that he wanted a small foot drain installed under the drivewayWe followed hisinstructions and cut the driveway from one end to the other the end a total of about feet as requested.It is a concern of how Mr*** changes what he will allow us to do and his level of satisfactionWe havefollowed the instructions to the "T" and then when it does not work he blames usAt this point we are limitedwith the requests by Mr***.Please note this is not the driving factor, but we have not received any payment considerationAshlyn Homeshas taken on the expense of all the materials with no deposit and all in good faith .Revdex.com*** ***

MESSAGE:Revdex.comSummit Avenue, Suite 700Fort Worth, TX 76102Below are my answers to Mr*** comments on his letter (not dated) to you in responseto complain Noon a drainage system at *** *** *** *** ** ***, TXIwill address his comments as they appear on his letter.Paragraph 1: Introduction of his company, my congratulations for his eight years of servicein his business.Paragraph 2: Mr*** stayed that I refused several options that he presentedHe iscorrectAs I address his options I will explain the reasons for which I refused each option.Paragraph 3: Mr*** is a percent correct; he cannot control Mother Nature, neitherIFor that reason I didn't press for a completion date on his work, in fact I suggested to waituntil the weather clear up.Paragraph 4: As Mr*** said, it was unfortunate that his contractor failed to support thewall's backing, not mention that the wall did not have any foundationHe had two changesto make it rightThe back of wall was not prepared correctly from the beginning, neitherfixed at the time it was repairedWhat will insure me that a third time will be a winner?Paragraph 5: Mr*** explained that a retention wall is used to help in the retention ofsoil to unnatural slopesWhy this wall fail to hold the dirt coming from the top of the hillallowing water and dirt going behind the wall, permitting the wall to swell from the bottomup? The problem came from the top of the hill which lacks a proper drainage to move thewater away from the center of my propertyAs you can see in the attached pictures thehouses at the top of the hill does not have a proper drainage on their back yard allowing thewater to run freely into my propertyIs there a Planning and Development office thatoversees land developments and assess the pros and cons of each project or It is the soleresponsibility of the developer to plan ahead to prevent possible natural disasters as in thiscase an unexpected large amount of rain?Paragraph 6: Yes, the retention wall gave me a bigger back yardUnfortunately, becausethe drainage situation it has been very difficult to decide which plan will work with theamount of water coming across the patioPlease see attach pictures of the water thataccumulates in the patio and a picture of the landscape that we was planning to installAsyou can see, I cannot attach a stones patio to the wall because it will not allow me space togrow the plantsA cover patio will not work either unless a drainage system re-route thewater away from the middle of the patio.Paragraph 7: Mr*** claim that he has expended $8,in the process of buildingthe retention wallThe sub-contractor he hired to build the wall charged him $5,forhis workIn accordance with Mr*** he was going to recall the check used to pay thesubcontractor, because the work was not completeAs a result the sub-contractor absorbedthe cost of the wall as his lossMr*** claimed that he hasn't received any compensationfor working in the wall, he is correctBut it is also true that he did not performed/fulfill thejobIt was Mr*** who decided to quit the job and we agreedHis original cost of $10,000will cover the sub-contractor work as $5,and $5,as Mr*** earnsHerecommended another contractor who offered to patch the wall for $8,more or lessIdisagreed with the contractor, because the wall was patched once already, and does not haveback supportAnother patch will be a temporary fix until the next rainy season bless our land.Paragraph 8: Another point of view in which I agreed with Mr***: I haven't build thetwo feet fence on top of the hill to force the water to run away from the center of myproperty, (something that Mr*** promised to do) It was brought to my attention that doingso will divert the water to my neighbors' homes and intern back into the middle of my yard.In addition I will be transferring the problem from my property to my neighbor's propertywhich is a lack of respect for them and is not in accordance with my principles of lifeAftertalking to several contractors it was concluded that the best way to do so is building adrainage system running pipes along the side of the property to the main drainage in thestreetThe estimated cost for this job is $20,which includes labor, gravel, 0" pipes,cements and miscellaneous suppliesBase on this situation and the condition of the wall itwill be a waste of time and money to work in the landscape to be removed later on to allowthe construction of a drainage system.Mr*** constructed a small swells in both sides of the property to drain waterPer myrequest he cut off the flow on the right side of the property and diverted to the left side.This was a common sense decisionThe water flow was running to the right side of theproperty and then turned to the left in the middle of the patio, where most of my plants weregoing to be planted; to reach the main drainage on the street which is in the left side of thepropertyThe mud and sludge that Mr*** claim he removed from by yard was theneighbor's new soil and seeds he added to his back yard and the rain flushed into my backyard.Paragraph 9: Mr*** employees or sub-contractor laid down sod, which make the patiolooks betterIn accordance with Mr*** this was grass that he owned me and was includedin the price of the houseThe sod was laid on top of holes and rocks on a ground that was notpreparedWhen I mention to Mr*** he got upset and walk awayAs it looks right knowthe grass is growing over rocks and bumps.Paragraph 10: I disagree with Mr*** in his statement that he was unaware of myconcern about water running down the hillIt is a little hard to believe that he forgot that Icancelled the initial purchase of the home, right before escrow, because I was concern withthe drainage systemIt was Ms***, (real estate agent working for Mr***) and Mr***himself who insured me that a proper drainage system will be installed and that there will beno water problemsIn fact both stayed that rain in this area is never a problemBase ontheir words I decided in good faith to purchase the houseI contacted Mr*** *** fromSupreme Lending and asked him to process the paperwork to purchase the houseHe interninformed me that it will take a little bit longer because I had cancelled the original purchaseand he had to process the papers againAlso per Mr*** suggestion we didn't include thecost of the retention wall together with the cost of the house, since it will delayed thepurchase of the houseWe decrease the down payment on the house by $10,to coverthe cost of the wallCan Mr*** remember this? At the present time water from thehouses above my property is coming to my property as you can see in the attached pictures.The drainage in the front of the house, on the driveway, was a communication with Mr.*** via Mrs***He filled my requestNot familiar with the area or the rain I made arequest for a French drainage to go under the cement at the entrance of my propertyThissystem proof to be ineffective, since the water does not run to the main drainage, instead itstay in the area by the mail boxThis is my fault for not doing more research on theconditions of the areaMr***, an experience contractor was unable to judge the situationbefore it happenMost of the houses in the area have cement pipes drainage under thedriveway, I didn't realized that until the French drainage was complete and the water wasstuck near the mail box.Paragraph 11: Mr*** is concern with my level of satisfaction and what he is allowed to doin my propertyI simple expect a job "well done," not a super jobI didn't ask for a job outof the ordinary or out of reach, just something that look complete and on the standard of areasonable good tasteAt the present time when we have company the first question theyask is: What kind of work is this? Thru my military and civilian career with the Department ofDefense on military installations, I learned to perform any tasks, in the best of my ability;under any circumstancesMy pride is to do the job once and completed to meet and exceedthe requirementsI don't believe in hand-outsI like to pay for what I get, but yes, I expectto pay an equivalent to the job performed.Mr*** team responded very quickly to various complains: a leaking roof, when a subcontractorcame four times to fix the problemHe also was very prompt to fix a leak on awindow that allowed water to come inside the office, and another lick in the garageTherewere many other calls for minor repairs on which his response was very effectiveWe thankhim and his team for their responses.Paragraph 12: Mr*** hasn't received any payment for his work, neither the subcontractorthat worked on the wall and took a lossAs I said before, I'm willing to pay for ajob that is properly completedWhen I moved to this house I had a dream, this was going tobe my castle to spend the rest of my life, and instead it has been a nightmareFour monthshave passed and the dream is vanishing.Mr*** is a contractor with eight years experience in the construction of housesHehas the experience and knowledge of the terrain where he is going to buildI felt he and Ms.*** missed lead me about the drainage and the situation to run the water away from thehouseI'm forced to fix the drainage system before I sell my house and I'm forced to tell anybuyer by law of any problem in the propertyMr***, neither Ms*** didn't follow thisrules because their interest was to sell the house, money was their only interest.It is my experience that the best way to handle any situation in a timely manner is byproviding as much factual information as possibleI would like to invite you and an inspectorto visit my property, along with Mr***I will be glad to show you hundreds of picturestaken during the rainy seasonIt also includes the flow of water in the area and how itaffects other residents

I am rejecting this response because: The spalling of the concrete was not addressed.  Concrete is coming up and flaking off because of the way the concrete was finished.  Recommend remove and replace.  I paid addition money out of my pocket before closing for a larger driveway, that was done very poorly.  Most all tenants in subdivision having the same exact problems.Tile has been replaced.  Request reimbursement of $80 for cost paid to contractor.

Repairs to Mrs. [redacted]'s garage floor were completed on February 26, 2018.  Ashlyn Homes reimbursed Mrs. [redacted] $750.00 for the extra concrete poured during the build process of her home and $80.00 for the tile repair paid for out of her pocket.   Thank you. [redacted]...
