Here are some notes:MAJOR FLOORING ISSUES AND NOW ELEVATOR SHAFT FLOODED AND FULL OF BLACK MOLD.
*** Liability issue - tripped on floor and cut leg. If this was anyone else I could have easily been sued.
*** Floor is peeling up and pulling apart in multiple areas
*** Different installers on floors but same issues are occurring so likely not a installation issue

*** Floors are not connected properly per the Warranty Manager, Damon L., AS PER findings

*** The flooring issues began during pre-construction when they put quarter round around the baseboards (twice) and instead of taking out the flooring and relaying it they jammed it onto the sides.

*** The flooring peeling/pulling issues were raised during my first warranty inspection but was told to wait to see how the rest of the floor does. During each inspection I reminded them about the flooring concerns and they said they wanted to continue to wait. Once my dad cut himself, then they wanted to address the problem - which seems like negligence to me.

*** Poor workmanship just all around

*** Requested pictures and their findings during each visit but they have not supplied these too me
New issue that the contractor would have been able to see the water at the bottom of a elevator shaft but still put flooring down and only because of mold build up and tile not stick to floor they opened it up and found it full of water and black mold.

Desired Outcome

I would like a cash credit to put down a totally different floor ( tile) as they want basically replace lose tile and wait out warranty then pass the flooring issue to me the home owner. Ref the mold issue want this hole clean out a a certified mold expert to check venta and other areas of the house and make repairs and kill the mold that poor workmanship has caused.

To Whom It May Concern:

This letter is provided in response to your notice regarding case #XXXXXXXX, and received on 3/13/19.

Ashton Woods Homes is committed to building quality homes and stands behind its product and its warranty.

The home was completed and conveyed to the homeowner on 5/16/18 and the Materials and Workmanship portion of the Limited Warranty provided by Ashton Woods remains in effect.

The floor installation contractor and the flooring product manufacturer have inspected the vinyl plank flooring to evaluate the homeowners' current concerns. The flooring contractor and manufacturer have determined that the interlocking tabs at the head joints of 15-25 floor planks appear to be slightly raised and in need of replacement. Ashton Woods has agreed to replace the affected planks and to maintain the existing warranty for an additional six months following the repairs. The entire floor does not need to be replaced. This was discussed with and agreed to by the homeowner. Based on the homeowner's availability the repairs were scheduled for 4/15/19. Subsequent to this arrangement, the homeowner advised that nothing short of complete removal and replacement of the entire floor would be acceptable.

The condition of the elevator shaft pit has been inspected. Based on those inspection results, remediation will be performed by a Florida State Licensed and Certified Mold Remediation Company. All materials that need to be removed during remediation will be replaced. A letter of completion will be provided to the homeowner once the remediation effort has concluded.

Ashton Woods Homes stands ready to make the flooring repairs that were agreed to with the homeowner; and will arrange for remediation of the elevator shaft pit area by a qualified remediation company.

I completely agree that the interlocking tabs at the head joints of the floor planks are raised and in need of replacement, whether it is an installation issue or product issue. However, the top material of the floor boards is already peeling off completely in multiple areas, which they failed to mention.

In addition, the first level of flooring is in the worst shape, with multiple areas peeling up and the material pulling apart, likely due to the material sitting and connecting over the elevator shaft pit that was filled with water for almost a year(!). This entire level needs to be replaced any way due to the water and moister built up underneath.

Therefore, I have requested my floors (1st and 2nd floor) be replaced by AW with either a 'downgrade' (such as carpet) and get a credit back, or I will pay the difference to get any other flooring at this point to get this resolved. This FVT flooring is not acceptable due to the wear it has already shown in less than a year of ownership and the small extended warranty of 6 months just shows the lack of faith they have in how well this flooring will hold again. If it was 1-2 pieces, then I could be reasonable but it is well over the 25 planks they listed.

Is there a way to adjust this with my response. I DO NOT accept their response. This is my follow up:

Ashton Woods has not been in compliance with the deliverance of quality construction on site for property located at ***
I am writing to you in this day to advise of the following: I am very discontent with everything pertaining to the process, construction, financing *** and other situations with AW. It has been a struggle to have an open avenue of communication with anyone in AW. When it comes to meeting deadlines for the client to meet, there is no excuse. Unfortunately when the seller has to meet the standards to satisfy the customer needs no consideration what so ever. How easy is it to just brush it off your shoulders and make it seem so easy for such a big construction company to just not consider your voice. There has been so many discrepancies in reference to the property, it has been brought by communicating via e-mail and not even an acknowledgement as a courtesy for a response. Financing through AW preferred Lender which is *** was a nightmare, basically no willingness to work in behalf of the client, never Wells Fargo at the moment of pre-approval mentioned to lock rate, and therefore due to these circumstances we were unable to complete eligibility for financing. Last meeting with Builder/Contractor the expected date of completion was August 8, 2018 it was mentioned: "no I promise this will finalized", lock rate with Financial Institution is until this date, after this date the rate may or may not increase; more than $20,000 has been placed into this project. Well seems like with all the mistakes made on plans and other materials which the same workers have advised they are of poor quality, this has made the efforts of the workers to an outstanding job to make the transition of the construction smooth and effortless. All I have to say is that I have requested for the second time in two weeks a meeting and no response, I have been more than patient in this entire process. The interest for this Company to help the customer is not in the Agenda. This is very unfortunate. At the end the quote "It was a pleasure having business with you" will not apply.

Property is not meeting the requirements based on the contract, additions on the height on the laundry room has been altered, the same with the vent in the kitchen there was an issue there, tiles edges and terminations are horribly cut and the base boards not placed accordingly, cabinets in master bathroom too long, had to alter measurement for master shower. Ashton Woods advises no, there is no issue we will deliver the property as promised, how? If all these issues are still a concern and has not been corrected.

Desired Outcome

My main concern is that the property will be given to me with all the alterations not on contract pertaining to the blue prints, I am seeking for Ashton Woods to step up and accept the fact that the property is not up to standards within what was requested, there has been so many human mistakes along the construction that I am not happy with the performance and how the property is coming out, not what I expected at all. Terminations are very sloppy and inadequate, when calling the office and management all they say is we are up to standards and we are making this house according to delivery and dates. The house is worth over 305,000 and looks like a house of 150,000, the quality of the materials used are very cheap in comparison with other builders within the Community.

I will be speaking with our sales and construction team to understand what has occurred with this home during the building process. I will also reach out to the customers as well to find out their specific issues with the home as well.
