This letter is in response to the complaint filed with your office against Ashworth Home Builders, LLC by [redacted].
Per the description of the complaint, my response is as follows:
1. A final walk-through was completed July 1, 2015, with punch list items completed from that list on same date. Present for walk-through: [redacted] (homeowner), Andrew F[redacted] (builder) and two employees of [redacted] (sub-contractor).
2. A 6 month walk-through was done February 3, 2016. Homeowners refused to sign walk-through list to verify list was conclusive. Present for walk-through: [redacted] and [redacted] (homeowners) and Michell F[redacted] (builder representative). Homeowners later submitted a different walk-through list, dated February 18, 2016.
3. Water leaks in basement addressed. Plumber and HVAC contractors both sent out for inspection, repair done March 18, 2016 per HVAC contractor.
4. Mudroom: Original homeowner's plans called for "lockers" in alcove of mudroom area. Homeowners elected to have this area omitted due to costs. However, during the building process, the homeowner requested a built-in bench be constructed in this area instead. The bench was constructed and finished per homeowner's wishes. Ashworth Home Builders, LLC has notified homeowners on multiple occasions, that this area was constructed and completed as agreed upon and no further changes will be made.
5. Ashworth Home Builders, LLC has been willing to repair other items on list, with exception of the mudroom and have communicated this to homeowners several times, but are unable to get a submitted or signed list without the mudroom issue.
Solution: Ashworth Home Builders, LLC will accept homeowner's submitted list dated February 18, 2016, with the exception to the mudroom. The mudroom was completed and finished per homeowner's wishes at time of construction. Repairs can begin on other items listed with acceptance of this solution by homeowners.
Since the completion of the home, multiple emails and certified letters have been exchanged with the homeowners concerning issues on both sides. If you require any further information or details to the above, please contact me. Thank you.

The end of construction walk through was conducted very hastily with only [redacted] present at the time. Mr F[redacted] called to say he would be coming to do some repairs that we had spoken about. It was not a scheduled walk through so both home owners were not present. There was no punch list. Both parties agreed to items that needed addressed verbally. It was informal and nothing was signed or written.
The 6 month walk through should have been completed January 1, 2016. It was not completed until February 3, 2016. It is now the end of April and only one item of the 37 on the list of repairs is complete. Mr. F[redacted]'s wife conducted the walk through on February 3, 2016. At the end of the walk through she asked us to sign her list. We are neither legally or contractually obligated to sign any documents at this time. There are obvious trust issues, and we will not sign anything until the work is completed to our satisfaction. This work falls under the original contract and should be completed with no additional paper work. The builder is paid in full for all services. We are not asking for anything that is not on the original plans.
As far as the mud room is concerned, Ashworth Builders has been paid in full and a finished mudroom is on the plans. We aren't certain what he's referring to when he said we elected not to finish this because of cost. It's our understanding the changes we requested were even to the lockers. We verbally agreed to changes from the original plan of lockers to a bench, beadboard, hooks and shelves. Mr F[redacted] asked [redacted] to draw a sketch. Attached you will find the sketch along with a photo of the current unfinished mudroom. Also attached is an email from Mr F[redacted] refusing to complete any work on the list until we sign. Many things we agree to verbally were either never completed or resulted in an extra charge at the end of construction. If Mr F[redacted] does not want to finish the mudroom according to our verbal request, it needs to at least be completed accrording to the building plans. The punch list dated February 18 was the original list with no changes. We did not submit anything additional after the February 3, 2016.

Ashworth Home Builders, LLC is willing to schedule all other repairs listed on customer's letter dated Feb. 18, 2016, submitted by customer, with exception of mudroom. We ask that the customer contact Ashworth Home Builders, LLC to schedule these remaining repairs.

We accept that the builder is willing to fulfill the requirement of addressing the items requiring repair. However, the mudroom remains unfinished. What can we do to get this completed according to the building plans?
