The customer and I had an agreement to perform work at his houseThe work was to supply and install furnaces and ductwork, a hot water tank, bath fans and a humidifier. I spent several days at the customers home and including my helper, have almost man hours invested in the jobThe
whole time the work was being done, the customer and I were communicating almost daily with texts and pictures and there was no trouble getting ahold of him and response times were quick. The customer had a concern on Saturday oct 1st *** *** *** *** *** *** *** and I responded immediatelyThere was no indication, ** *** *** *** *** *** *** *** *** however, I made it a priorityWhen I got there, his wife opened the door for me and obviously didn't feel the situation was bad enough to actually leave the houseThere was indeed a very small leak in an old pipe joint and I took apart the joint, sealed the threads and put it back together, problem solved, texted the customer and he texted me back with his thanksFor reference, if the customer ever feels there is a gas leak emergency, *** gas can be called 24/7. After a few more days on site, I was in my estimation, 90% complete on the installation, all supplies and equipment to complete the job were on site with the exception of around $worth of parts, and I had about - hours left to complete the work At 4:on October 4th I sent a series of pictures with a note that said "almost done" I called the customer at around pm and left a message that it was time for a payment and planned to complete the work the next dayAfter a few minutes I sent a text "to call me re: payment" as I find most people don't bother to listen to messages anymore The customer *** * *** ** *** *** *** ** ** *** *** stated he was busyIt's important to note here that the customer and I had a clear agreement that when I called him for payment, he was to pay The customer has stated this himselfand a half hours later, around 9:pm, I sent a text asking if he was still busy *** ***No response again I had not up to this point had any difficulty getting ahold of the customer and had a bad feeling about not being able get any kind of response when it was in regard to getting paidI sent one further text outlining that I had several thousands of dollars invested in his house and expected a payment as we had agreed. I can see in hindsight that I overreacted and a little patience on my part may have resulted in a different outcomeAfter a few more texts back and forth, and a total breakdown in any kind of decent communication, the customer asked me to stop the work and not return to the siteI made an attempt at an apology for my anxiety and stated a desire to complete the workThe customer declined and stated *** ** *** he would inspect the site and pay me for what I had doneAs this response was fairly arbitrary, I made a decision to place a builders lien on the home to protect the large investment I have in the project. I have a list of things required to complete the work and the time it would take me to complete :Permanent gas fixtures for furnaces and hwt hrInstall humidifier hrScrew bath fan to ceiling - electrician to wire w/ vent fan switch hrCut in upper bath fan- electrician to wire w/ vent fan switch hrCut hole in wall for basement bath fan hrGlue condensate drain line hrInternal drain for bsmt furnace hrAffix vent hoods to wall hrCap return openings for up and down systems hRun insulated flex for f/a intakes and bath fans hrInsulate vent hood for stove hrRun 3xsheet metal w/ caps for basement return to living room hrRun thermostat for basement furnace.25At this point, all would have been completed before the customer returned and we would have been ready for a preliminary duct inspectionI expected to work with the customer well into the customers progress of his project as I do with all my customers. The customer has made little jabs and statements regarding my name and reputation of the company, he is welcome to his opinion but I have not had anything like this happen with any other customer to date. The vast majority of my work comes from referrals and repeat business. I recognize much, if not all of this particular situation could have been avoided and regret it turned out this way. The customers desired settlement is to have the lien removedThis will be done as required by the land titles office once payment is received.A simple lien automatically expires after days in any event and unless the customer doesn't pay within a reasonable period of time, there is no need to file a lis pendens.The customer wishes to pay for the work as per the quote minus what it costs to complete. The customer chose to hire a low overhead independent contractor and has it in mind to go to a "big company" to complete the work and deduct dollar for dollar from the priceI will wait to see what that dollar amount is before accepting a "settlement" or not. Substantial completion of the work has been done and a significant dollar amount has come out of my pocket in good faith with the customers agreement to have me perform the workI expect to be reasonably and fairly compensated

I am rejecting this response because:I do not agree with John Molund’s statements as his representations of this situation are not accurate [redacted].  [redacted] [redacted]. Upon my inspection, I now understand why he was so anxious to secure my credit card number [redacted] [redacted] and attempt to coerce full payment prior to fulfilling his obligations, then attempt to coerce partial payment from me with threats of legal action as I was unable to inspect the quality of the work or see the progress of activities or have the city of Edmonton inspect the work. Synopsis:I see no option but to secure a established and reputable HVAC contractor to pull proper and sufficient City of Edmonton Natural gas and HVAC permits, remove duct work, re-insulate ceiling, repair all deficiencies including install properly sized duct and complete the natural gas work. I will deduct these expenses from the agreed upon price, dollar for dollar. I will also be deducting the cost of re-keying the locks as Molund refused to return my home key. [redacted] However, having a company clean up the administrative and mechanical mess Molund has created will increase costs for which he will be responsible for.
