addressed to you by [redacted]. We operate a self storage facility at the [redacted] near Aspen, Colorado. Mr. [redacted] rented a storage unit at our facility. We believe the rental commenced when friends or roommates of Mr. [redacted] rented a unit in his name and placed items presumably owned by Mr. [redacted] in that unit on July 25, 2012. The standard rental for this unit is $85 per month. Mr. [redacted] confirmed and ratified his rental of the unit and the amount of the monthly rent both by making some rental payments and otherwise. For example, in his letter to you he asserts that paid the rent on this unit by having his bank make automatic monthly payments. Mr. [redacted] immediately fell behind in his payments commencing on September 1, 2012. Although our agreement provides for the imposition of financial penalties, he repeatedly fell behind. Although he became liable for penalties pursuant to his agreement with us, we agreed on more than one occasion to waive the penalties when he became in arrears by as much as 2 months. After several repetitions of this practice and a prolonged failure by Mr. [redacted] to bring his account current, we tired of dealing with his procrastination, exercised our right to lock his unit, and started an exchange of correspondence, a copy of which is enclosed with this letter. At the same time, Mr. [redacted] initiated a series of telephone conversations with our management in which he made a series of threats and false accusations, including a claim that we had stolen a bottle of whiskey from his unit. We considered his attacks sufficiently threatening that we reported his conduct to the Pitkin County Sheriff's office, which advised us that Mr. [redacted] has an extended arrest and conviction record, which caused us even further concern. Incidentally, you will note from the enclosed documents that Mr. [redacted] has also accused his former roommates of stealing his property. 
At this time, Mr. [redacted] is indebted to Aspen Mini Storage in the amount of $417.00, his unit remains locked, and his letter to you is simply the latest chapter in our relationship with him. 
Sincerely, Aspen Mini Storage  Aspen Mini Storage 105 Woodward Lane Aspen, CO 81611 January 15, 2015Dear [redacted]: We recently left a voice mail with you regarding your nonpayment of December 2014 and January 2015 storage rent. This voice mail apparently precipitated your telephone call this morning in which you claimed we had stolen items from your storage unit and stated that you would be commencing legal action against Aspen Mini Storage in the event you were not compensated for your loss. 
As you know, we have been attempting for over a year to persuade you to bring your payments current. Since you began renting with us on August 1.2012, on average you have been over 80 days late. Throughout the course of your renting with us, we have left numerous voice mails with you seeking payment, some of which were on 9/21/2012; 11/9/2012; 12/14/2012; 1/22/2013; 5/30/2013; 7/22/2013; and 10/4/2013. In response to our numerous phone messages, you called our office on September 16, 2013, and spoke with our manager. In that conversation you asked us to work with you, and allow you to make payments to catch up within 30 days. We worked with you and accepted your commitment to bring your account current. We waived all late fees as stipulated by your lease with us. We did this to help you. We also informed you that if you failed to bring your account up to date within 30 days as you promised, we would proceed with the auction process. Your account was not made current within the specified 30 days. Finally, when it became apparent that our efforts were not succeeding, we placed our own red lock on the unit and made preparations to auction the contents pursuant to the provisions of our lease agreement. 
To the best of our knowledge, your unit was securely locked with your own padlock until November 15, 2013, when we exercised our right to enter and inspect it. We disturbed nothing. We took nothing. We conducted a partial inventory and replaced our lock on the unit. We saw no alcoholic beverages in the unit and certainly did not remove anything from the unit. 
So there will be no misunderstanding, we intend to proceed to auction the contents of your unit, or otherwise dispose of them. You can, of course, prevent that by paying the rent currently due. Should you choose to do so, we will ask that you remove the contents of the unit and vacate the premises immediately so that we can make the unit available for rental. In the event you choose to commence an action against Aspen Mini Storage, we would appreciate being advised of your lawyer's contact information so that our lawyers can communicate with each other. Sincerely, Aspen Mini Storage  NOTICE OF DEFAULT AND DEMAND FOR PAYMENT DATE: 1/15/2015 FROM: Aspen Mini Storage, 105 Woodward Lane, Aspen, CO 81611 TO: [redacted] ("Occupant") [redacted] 
[redacted] RE: Storage Unit [redacted] ("Storage Unit") This notice is given to the above named Occupant as notification that continuously for a period in excess of thirty days Occupant has been in default of the obligation to pay rental on the Storage Unit identified above. The sum due as of the date of this notice is $ 302.00 and this sum became due on January 15, 2015. • $170.00 PAST DUE RENT: December 2014 & January 2015• $82.00 LATE FEES @ 2.00 per day which continues to accrue daily• $50.00 RED LOCK FEEDemand is hereby made for payment of the amount due within twenty days after delivery of this notice. As of February 2, 2015, the total amount past due on your unit is now $417.00. • $255 for Dec/Jan/Feb @ $85/month• $112 late fees accruing @$2.00 per day beginning on Dec 5th 2014• $50 red lock fee
The deadline for remitting past due payment in full for your unit is February 9th 2015. We will proceed with auction and/or disposal immediately after this deadline if payment in full is not received by this date. Additionally, be advised that if full payment is received, we will remove the red lock and you will need to vacate the unit immediately. We have consistently attempted to work with you in the past, waiving hundreds of dollars in late fees and allowing for special payment arrangements. We are no longer able to do so. 
We also sent you a certified letter on January 15, 2015 responding to your claim that we had stolen items from your unit. As we vehemently stated in this letter, we did not. To reiterate, should you choose to commence an action against Aspen Mini Storage, we would appreciate being advised of your lawyer's contact information so that our lawyers can communicate with each other. 
Lastly, please be advised that we have filed a report with Pitkin County Sherriff's Office regarding your verbal abuse, intimidation and threat of our manager. We will not tolerate this and we will pursue any and every course of legal action against you should you continue with this type of behavior. Sincerely, Aspen Mini Storage
