This accusation is entirely false This resident applied on 5/31/and let us know they were coming for an internship at BYU for the summer semester (see attached acceptance letter in their name) We let them know of some temporary housing we have for the spring/summer semesters and they applied The rent was $450/mo for a fully furnished bedroom apartment These apartments are normally BYU single student housing during the fall/winter, but we rent them out just during the spring/summer months to BYU married student couples who might be coming to finish their degree, coming for an internship or need a place while they look for permanent housing, etc Attached are their applications and lease (the same email that is used on the application is the one that filed this complaint - so it is coming from the same person - not some random person whose social security number has been stolen as the complaint is suggesting) Of course all sensitive information has been blacked out for protection This person had a contract that they defaulted on and they are attempting to slander our name and falsely accuse our company of "stealing social security" numbers which they provided through an electronic system We are sorry their plans changed and they didn't want the lease, but defaulting on a lease, then falsely accusing a company of something that has and never will happen is completely dishonest and incorrect We firmly stand by our application, contract practices This is an attempt to bully a small, family owned company by giving accusations They contacted our company days ago again looking for housing Of course, I would recommend that no one rent to them, as they will not uphold their lease and make accusations against you We have been left with no other choice other than to turn his account over to collections in an attempt to collect the lost rent

[redacted], I will assist in helping to clarify our position on this situation.  You are correct that you originally signed a contract with another landlord.  Our client purchased your property in the summer of 2015.  At the time he purchased the condo he was under the impression...

(as were we) that the security deposits for each tenant ($100) would be transferred at closing. This is very typical and happens more often than not.  After closing we were informed by the real estate agent and the new owner/landlord that the old landlord had specified damages (nail holes in the walls and other "damage" the old owner  claimed you did to the condo, along with the other tenants).  I remember specifically (it's been over a year now), but the main issue was nail holes in the wall that he claims you guys did when you hung things on the wall throughout the condo.  This was in part what we received from the real estate agent regarding the deposits....."with a $100/ person deposit. From what I was told by title today, from the original $300 deposits there is only $32 left based on work the seller did to have the condo repaired...."  The old owner used the remainder of the security deposits and there was nothing left (essentially) that was given to us. My suggestion is that you reach out to your old landlord and require him to refund you the monies since he is the one who kept them - he kept the money, he did not transfer it to us, so that we could refund it to you.  We never received anything to begin with because he kept your deposits.  We have tried to convey this in the past.  Because you have his contact info we would request that you request the money from how actually kept and took the funds.  We do not have anything left to refund after having the carpets cleaned, etc. after you moved out of the condo.  If you need his contact info again, we are happy to give that to you so you can reach out to him.  Thanks, Hilary

[redacted], We apologize that you feel your deposit refund is an error.  However, after working with our office for several weeks, we gave you several detailed responses on what your deposit covered and why you had an outstanding balance.  You are correct, that you rented from us for 2...

years.  You are correct that you received an email stating you could use your deposit towards your last month's rent (now at the end of your 2nd contract after renewing with us last year), however, the email also stated that you could do this only IF your account balance was current.  You state in your complaint that you received an email saying that your "deposit would go towards my last month's rent."  Then, in your next sentence you say "they used $350 of my deposit to pay for my rent without notifying me at all" - we sent an email letting all of our students know they didn't need to pay their last month's rent and they could use their deposit to cover this as long as their balance was current (as in you didn't owe any late fees, cleaning fees, etc).  You had an outstanding balance on your ledger since last fall, which you didn't ask about or address until earlier this month when we did your deposit accounting and then you had an outstanding balance.  At the end of your first contract your deposit transferred to your new contract in your new apartment, however, you never paid the balance owing from your previous contract to bring your deposit to a full amount.  The deposit accounting was done at the end of your first lease and transferred to your new ledger, you could see this each time you logged into the system to pay rent, utilities all throughout last year.  It states on your running ledger "Security Deposit" and you saw that you only had $333 (approx) transferred from your previous contract.  We do expect for you to be reviewing your ledger and asking any questions throughout the year, but it seems you didn't address it or review it until the end of your first lease.  The apartment cleaning of $90 is for 3 hours of cleaning areas that were not cleaned when you moved out.  I'm sorry if your roommates left without cleaning and you had to do the bulk of the cleaning.  As a BYU grad, I can assure you I understand having roommates who didn't clean or do their fair share, that happens, and I'm sorry.  We feel that posting balances to your ledger which you were logging into all last year was communicating that your balance was not the full amount.  We feel all of the charges are correct on your account statement and we're sorry you disagree.  We feel we have communicated this in detail as we have about a dozen emails between our office staff and yourself explaining this several times.  We wish you all the best in the future, Hilary D[redacted]Aspen Ridge

[redacted], You are correct that you no longer had access to your first contract's online account after that contract ended.  However, on your new contract's account (where your security deposit was to have been $700) there was entry onto your ledger on 12/1/2016 of a charge and credit of $335.22 labeled "Security Deposit."  You logged in this same day to pay your December rent.  You should have seen this on your account and asked us why was there a difference or why wasn't $700 credited to your account rather than $335.22.  For privacy purposes I cannot post a true copy of your ledger, but the ledger you were given at the end of this year's contract on your deposit refund accounting shows this credit/charge/entry onto your ledger back in December of 2016.  We do try and hide things from our residents, but we expect them to reach out to us if they see an issue with their account and we will address it at that time.  It was entered on your ledger (which you viewed every month for at least 8-9 months after it was posted) and you didn't ask about it until September 2017.Thanks,Hilary D[redacted]Aspen Ridge Admin
