Property obtained by false pretense.I contracted with the General Contractor [redacted] of Aspirations Building and he failed to complete or pay the sub-contractors or vendors. This resulted in my deposit of $15k being null and void but has been kept by [redacted]. I have paid the Sub-Contractors directly and have liens on my property from his lack of payment to the vendors and sub-contractors. Desired SettlementThe refund would be for $9,798.30 as he walked off the job on April 28th, 2014.Business Response The customer signed a cost plus contract , so who paid subcontractors is irrelevant. The Liens on the property are a result of customer not paying for subs or materials that went beyond the deposit. We did not walk off the job and the customer knows that. If Revdex.com needs more info on this they are free to contact me via email.Consumer Response The Contractor has not been to the property since May 2014. The funds provided were to be applied to the construction of the building. Aspiration's Building stopped paying the subcontractors and the suppliers and withheld $9,871 saying that it was used for other projects beyond [redacted]. The importance of who pays is foremost as $15,000 deposit was delivered to cover expenses of said subcontractors and suppliers. The building is still not complete nor is the Certificate of Occupancy been granted. At this time Aspirations Building is in default of $9,871 to the homeowner. Business Response I do not know whom said any monies were used for any other projects. Again , this is a cost plus project. The project continued as agreed upon by customer and contractor. The only reason there is not a C.O. is because homeowner used his own plumber to finish the plumbing part as the plumber we use would not cut through beams without an engineers letter. We are not in default of anything. The customer can call in for a C.O. when his plumber is done.
